About this file

This is a Standards of Conduct Declaration form (Form AG-010) required by the State of Hawaii for a contract opportunity involving statewide drug confirmation testing services for the Judiciary's Juvenile and Adult Client Services Branch, including specialty courts. The declaration serves as a compliance document wherein the contractor certifies under penalty of perjury their adherence to Hawaii Revised Statutes Chapter 84 (Code of Ethics). The contractor must confirm they are not a legislator or employee with a controlling interest in the contracting business, have not been represented by former agency employees involved in the matter within the preceding two years, and have not retained legislators or employees for compensation to obtain or perform the contract if those individuals participated in the contract's development or award.

The form requires the contractor to acknowledge that any violation of the Code of Ethics renders the contract voidable by the State and subjects any fees, compensation, gifts, or profits received through such violations to recovery. Contractors must provide their signature, printed name, title, and the contractor entity name on the declaration. If the contractor is a legislator or employee and the contract exceeds $10,000 in value, the contract must be awarded through competitive sealed bidding or competitive sealed proposal procedures under Hawaii Revised Statutes Section 103D. The form is a mandatory disclosure document that must accompany the contract submission through Hawaii's electronic procurement system (HIePRO).
