SPE60221R0710 - 0001

The purpose of this amendment is to provide answers to questions from interested vendors and provide the per diem tanker rate. Additionally, the changes set forth herein are incorporated into Solicitation SPE602 21 R 0710. A conformed copy of the solicitation has been attached for your convenience.

1. The following questions were requested by interested vendors:

a) What are the MIL-STD or exact fuel specs for the AN8 and gasoline MUM required?

The MIL-STD or exact fuel specs for the AN8 and gasoline MUM are provided in solicitation and solicitation attachments in SAM.gov.

b) Does the Government have a vessel chartered separately (FOB Origin), or will the contractor be required to provide fuel and vessel delivery?

The Government will provide a vessel (FOB Origin).

c) When is the delivery window, and is that during lower sea ice periods?

The information is available on solicitation SPE602-21-R-0710 in SAM.gov.

d) Will this pricing period be used for the actual pricing of the cargo for invoicing purposes or just a demonstration of how the reference price is arrived at?

The pricing period is used for the actual pricing of the cargo for invoicing purposes only.

e) If just for reference purposes, what is pricing period of the cargo for invoicing / final pricing purposes?

It is for instruction purposes for how to invoice on the day of the lift of the cargo.

f) Is it 10 days preceding lift date or delivery date (both are referenced)?

It is for 10 days preceding lift date. The lift is the delivery date since it is FOB Origin per the solicitation.

g) Request for information towards the "Commitment Letter"

Requesting information on the legal weight this letter carries, because a QAR process is also initiated afterwards.

-compared to letter contract to US Gov -compared to letter of intent to US Gov

The legal weight the commitment letter holds is between Vendor and the U.S. Government if awarded a contract. If Vendor enters a legal commitment with a supplier, the terms and conditions will be administered between Vendor and its supplier (subcontractor). If a prime vendor’s supplier fails to perform at any time during the duration of a contract with the U.S. Government, the prime vendor will be held responsible as the prime contractor. In other words, the U.S.

Government holds a binding contract with the prime vendor and not its supplier.

h) Since the solicitation is governed by US Federal Law, it is safe to assume that the commitment letter and all other supported signed documents are too?

If a vendor bidding as the prime organization is providing product solicited from a source or refinery independent refinery. A supply commitment letter is required from the prime vendor on the sources or independent refinery letter head. The supply commitment should reflect evidence in the form addressed under L704 EVIDENCE OF RESPONSIBILITY (DLA ENERGY- BULK) (JUL 2019), under paragraph (C) pg. 69-70 of the solicitation.

i) Is there FAR or other statement we could use to gain a good definition? The one in the solicitation is general.

Please refer to solicitation note #10 and L704 EVIDENCE OF RESPONSIBILITY (DLA ENERGYBULK) (JULY 2019) pg. 69-70 of the solicitation. The supply commitment letter must reflect the structure as provided under paragraph ( C ) under L704.

2. All general solicitation questions will not be accepted after August 23, 2021.

3. The per diem tanker rate is $64,949.04. Solicitation note number 13 is hereby revised to read:

Solicitation Notes

13. Transportation is considered in the evaluation of all origin offers unless the solicitation specifically indicates otherwise in the Schedule. The transportation rate will be based on a nominal size U.S. flag tanker of approximately 30,000 Deadweight Tons (DWTs) and will be inclusive of time charter hire. The transportation rate will be an estimated market rate based on either market information, published prices, actual rates paid by the Government, or any combination thereof. This evaluation rate will be expressed as a daily rate of $64,949.04 for U.S. Flag time charter costs. DLA ENERGY will use evaluation rates along with mileage from Source Points to Destination Points to compute the transportation rates. This applies to all products.

4. All other terms and conditions remain unchanged.
