To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors.
The Offeror must be registered and current in the System for Award Management website (https://www.sam.gov/portal/public/SAM/); no exceptions.
Failure to meet a requirement or adhere to an instruction may result in an offer being ineligible for award.
Submission of Offers:
a) Interested parties capable of providing the specified product and services must submit a written offer via email directly to the Contract Specialist, Tammie Campbell (Tammie.Campbell@dla.mil), and Contracting Officers, Roman Bernal (Roman.Bernal@dla.mil) and Deborah Baldwin (Deborah.Baldwin@dla.mil), not later than the solicitation due date and following the instructions within this solicitation. The offeror is responsible for confirming the successful and timely receipt of its offer.
b) The Standard Form 1449 must be completed, as well as the MANUFACTURING AND FILLING POINTS and TRANSPORT TRUCK AND/OR TRUCK AND TRAILER FREE TIME AND DETENTION RATES (AEROSPACE ENERGY) contract text and all certifications and representations contained in the Aerospace Contract Text, Section K in attachment 3, of the solicitation.
c) Document Content File Format – The minimum font size for the proposal pages is 12 point.
Proposals shall be submitted on 8 ½ x 11 paper, except for fold-outs used for charts, tables or diagrams, which may not exceed 11 x17. Required documents must be submitted via electronic email with a request receipt, and should be clearly marked as to solicitation identification and the Offeror’s name, address, CAGE Code, and DUNS number.
d) Do not send as an executable or .exe file. Email size shall not exceed five (5) megabytes.

f) Offerors shall assume that the Government has no prior knowledge of their experience and will base its evaluation on the information presented in the offeror’s proposal. Only the minimum amount of information required to provide for proper evaluation is requested. The proposals shall be clear, concise, and include sufficient detail to provide for adequate evaluation and substantiation of the validity of stated claims. Submitted documents must contain adequate https://www.sam.gov/portal/public/SAM/ mailto:Tammie.Campbell@dla.mil mailto:Roman.Bernal@dla.mil information to enable the evaluation team to fully ascertain the Offeror’s capability to perform contract requirements, must meet the requirements of the RFP, and must address the evaluation factors for award. The offeror’s proposal must convey to the Government that the offeror is capable; possesses sufficient technical expertise and experience; possesses sufficient resources;
and is able to plan, organize, and use those resources in a coordinated and timely fashion such that technical requirements will be achieved. The proposal shall not simply rephrase or restate the Government’s requirements. The Government will not make other than reasonable efforts to ascertain the meaning of a proposal submission, given that Offeror must follow these instructions for how to arrange and submit a proposal. Inadequate, incomplete or disorganized proposals may be found to be technically unacceptable, and evaluation of that proposal stopped, simply because the evaluators could not reasonably ascertain whether the proposal meets the technical evaluation factors of this solicitation.
g) All information contained in the proposal that an Offeror feels is proprietary should be labeled
“Source Selection Information—See FAR 2.101 and 3.104.”
h) Exceptions (price or technical) taken to the terms and conditions of the solicitation and/or any of its formal attachments shall be identified. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. Provide rationale in support of the exception and fully explain the impact, if any, on the performance, price, and specific requirements of the solicitation. Failure to agree to the terms and conditions of the solicitation may result in the offeror being removed from consideration for award.
i) As the Government intends to award without discussions, Offerors are advised of the possibility that their proposals may be found unacceptable if exceptions are taken to the solicitation requirements. Clarification of Government requirements should be requested by the Offeror by submitting questions and/or recommended changes not later than 10 calendar days after issuance of the solicitation. All exceptions to the solicitation requirements (including the SOO) and supporting rationale shall be identified as such and consolidated into an overview section of subject volume. An overview section is only required if the Offeror takes exception to any requirement in the solicitation. The overview section will not be included in the page count.
Exception(s) to solicitation requirements may require the Government to amend the solicitation to reflect requirement change(s). If the Offeror takes no exception to the stated requirements, a statement to this effect shall be included in the respective volume.
j) Any questions relating to this solicitation and its attachments shall be submitted in writing by email addressed to the Contract Specialist and Contracting Officer by 10:00 AM CST on 1 Nov 2019. VOLUME III- Price
Tailored FAR 52.212-2 Evaluation -- Commercial Items (Oct 2014)
(a) The Government intends to award one or more multiple Indefinite Delivery/Indefinite Quantity contracts resulting from this solicitation to the responsible Offerors whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
(i) Factor I, Technical Capability
(ii) Factor II, Past Performance
(iii) Factor III, Price
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
Addendum to FAR 52.212-2 Evaluation -- Commercial Items (Oct 2014)
BASIS FOR CONTRACT AWARD
This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures.
Evaluation will be in accordance with Federal Acquisition Regulation (FAR) 15.101-2, as supplemented by the Defense FAR Supplement (DFARS), and the Defense Logistics Agency Directive (DLAD). Technical or past performance tradeoffs will not be made and no additional credit will be given for exceeding minimum acceptability. Contract awards will be made to the Offeror deemed responsible in accordance with FAR 9.104- 1 and whose proposals conform to the solicitation requirements. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
a) Offeror proposals are evaluated in accordance with the evaluation criteria. The Government intends to award multiple Indefinite Delivery/Indefinite Quantity contracts. All Offerors must be technically acceptable and have an acceptable past performance rating to be eligible for award consideration.
b) Awards will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the specific evaluation criteria contained in the solicitation. Non-price factors to be evaluated shall be technical capability and past performance. In accordance with FAR 15.101-2(b)(3), proposals will be evaluated for acceptability but not ranked using the non-price factors.
c) An Offeror whose proposal is evaluated as acceptable from both a technical capability perspective as well as for past performance will be considered technically acceptable.
d) A written notice of award or acceptance of offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
e) The Government intends to award without discussions. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, Offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision.
If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award. The Government reserves the right to conduct discussions.
EVALUATION FACTORS
FACTOR I: TECHNICAL CAPABILITY
Technical capability will be measured against requirements specified in the solicitation. As such, technical capability is considered acceptable when the offeror’s proposal is in compliance with the requirements of the solicitation.
Criteria used to judge acceptability are as follows:
(A) Daily Production capability of proposed fill plant(s).
(B) Acceptability of offerors ability to meet the logistics required to fulfill the product deliveries.
(C) Acceptability of the in-process quality control procedures that will ensure the production and delivery of on-specification product.
(D) Acceptability of Offeror’s proposed quality sampling plan that will be implemented to assure individual shipments made under this solicitation meet the product quality requirements stated in the applicable specification or product described.
(E) Acceptability of supply commitment if the offeror is not the manufacturer of the product to be delivered under the contract or is proposing to provide product from a fill point or production facility other than one owned and operated by the offeror.
(G) Acceptability of how Offeror will meet specifications of MIL-PRF-27401G -7 Aug 2013 and in particular how the contractor will meet paragraph 4.4.3 Particulate content.
Technical Factor Rating Table 1
Adjectival Rating Description Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
FACTOR II: PAST PERFORMANCE
The Government evaluation team will conduct an in-depth review and evaluation of all performance data obtained to determine the Offeror’s probability of meeting the minimum past performance solicitation requirements. The team will confirm past performance data identified by the Offerors in their proposals and obtain additional past performance data, as necessary, if available, from other sources.
Past Performance shall generally include verification of performance with the Offeror’s past and current customers, to include Federal, State, and local Governments as well as private entities. The form entitled Contractor Performance Data Sheet may be used to provide relevant and recent performance history pursuant to this solicitation. The Past Performance evaluation is an assessment of the Offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment will be based on the Offeror’s record of elevant and recent past performance information that pertains to the products and/or services outlined in the solicitation requirement. Past Performance shall be evaluated in accordance with FAR 15.305 and DFARS 215.305; however, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Past Performance Table below. However, offerors without a record of relevant past performance or for whom information is not available may not be evaluated favorably or unfavorably on past performance. Additionally, past performance data may be obtained through the Past Performance Information Retrieval System, similar systems or other
Government departments and agencies, questionnaires tailored to the circumstances of this acquisition, Defense Contract Management Agency channels, interviews with program managers and contracting officers, and other sources known to the Government (including commercial sources). Offerors will be given the opportunity to address any negative performance information resulting from the past performance assessment inquiries.
Past Performance Rating Table 2
Adjectival Rating Description Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
NOTE: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror will not be evaluated favorably or unfavorably on past performance IAW FAR 15.305(a)(2)(iv). Therefore, the Offeror will be determined to have unknown (or “neutral”) past performance. In context of acceptability/unacceptability, a neutral rating shall be considered “acceptable”.
Additionally, past performance data may be obtained through the Past Performance Information Retrieval System, similar systems or other Government departments and agencies, questionnaires tailored to the circumstances of this acquisition, Defense Contract Management Agency channels, interviews with program managers and contracting officers, and other sources known to the Government (including commercial sources).
Offerors will be given the opportunity to address any negative performance information resulting from the past performance assessment inquiries.
Past performance shall be initially evaluated to determine whether the Offeror’s present/past performance is recent, and relevant to the effort to be acquired. Secondly, the past performance evaluation shall determine how well the Offeror performed on the prior contracts.
“Recency” is expressed as a time period during which past performance references are considered relevant, and is critical to establishing relevancy of past performance information. For purposes of this acquisition, “recent” is defined as contracts performed within the last five (5) years. The Government will not consider performance on an Offeror’s submission that concluded more than five years prior to the due date of this solicitation.
In establishing what is “relevant” for this acquisition, Offeror’s past performance shall involve performance history that was similar in scope and magnitude of effort and complexity of this acquisition. For this acquisition, the Government will utilize the following thresholds to determine relevancy:
RELEVANCE THRESHOLDS
DESCRIPTION
RELEVANT Contractor’s performance includes:
--Meeting specifications for production and delivery similar in magnitude (approximately 40,000 tons per year) of LN2 IAW MIL-PRF-27401G per year --Providing multiple deliveries of LN2 (or similar) AND --Demonstrated In-process Quality Control Procedures
FACTOR III: PRICE
The Government will evaluate the Offeror’s Price proposal as stated in this section of the solicitation:
(1) F.O.B. Destination product CLINs. For price evaluation purposes, the evaluated price of each CLIN for product 0001, 0002, 0003, 0004 AND 0005 (will be calculated by multiplying the estimated quantity by the proposed unit price of the product(s), which should include all costs associated with the offeror’s delivery of product to the location specified in the Schedule. F.o.b. destination CLINs are normally individual DLA Energy customer locations, unless otherwise specified.
(2) Non-product CLINs/subCLINs. For price evaluation purposes, the following non-product CLINS/subCLINs will be evaluated for awards: CLIN 0006, 0007, 0008, 0009, 0010, 0011, 0012.
Each non-product CLIN/subCLIN’s evaluated price will be calculated by multiplying the estimated quantity by the offered unit price. Offerors who do not propose on all non-product CLINs and subCLINs stated in the Schedule (where one award will be made), or where a group of CLINs/subCLINs will be evaluated for award, or where the Schedule contains specific customer locations to be evaluated and awarded, may not be considered for evaluation and award unless the offeror proposes prices on all applicable CLINs/subCLINs.
(3) Lowest Total Evaluated Price for F.O.B. Destination Requirements. Schedule B includes both f.o.b. destination product CLINs as well as non-product CLINs that are to be evaluated in accordance with the solicitation, the evaluated prices for all the non-product CLINs will be added to the evaluated price(s) of the applicable f.o.b. destination product CLINs to determine the lowest total evaluated price.
(4) I209.09 EXTENSION PROVISION (DLA ENERGY JAN 2012) is included and allows the Government to extend the period of performance for up to six (6) months on a unilateral basis. The method for evaluating the extension period and its associated quantities is to multiply an additional six months of requirements by the offered unit price and then to add that total evaluated price to the existing evaluated price for each line item.
The Government may determine that an offered price under an option CLIN is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
The objective of price analysis is to ensure that the final agreed-to price is fair and reasonable in accordance with FAR 15.402. The level of detail of the analysis required is determined by the complexity and circumstances of the acquisition. Other than Certified Cost and Pricing Data may be requested if determined necessary by the Contracting Officer.
Completeness: The Government will evaluate the Offeror’s proposed pricing for completeness. A proposal is complete when all pricing data required under FAR 52.212-1 of the Request for Proposal is provided in the format prescribed.
Balance: Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of price analysis techniques.
Reasonableness: The Government will evaluate the Offeror’s proposed pricing for reasonableness. The Total Evaluated Price (TEP) will include the total of all CLINS proposed, as well as, the extended pricing of the I209.09 EXTENSION PROVISION (DLA ENERGY JAN 2012). The TEP will be the only discriminator among Offerors for the price factor. Price analysis will be used to evaluate the reasonableness of each Offeror’s TEP to satisfy the requirement mandated by FAR 15.305(a)(1). A price is reasonable if, in its nature and amount does not exceed that which would be incurred by a prudent person in the conduct of competitive business. An assessment of price reasonableness will be performed on the TEP using techniques and procedures described under FAR 15.404-1(b), Price analysis. The burden of proof for price credibility rests solely with the Offeror.
Price proposals will not be rated or scored.
Number of Awards Determination. The government intends to award one or more multiple Indefinite Delivery/Indefinite Quantity contracts to offerors determined to be responsible, technically acceptable. The Government will determine the number of contracts awarded, based on the price and technical evaluations. Each
Awardee will be awarded a group of tanks based on technical and price evaluations. The Government will determine the grouping of the 29 tanks listed in the SOO. For example, in the event that there are two awardees, there will be Groups A and B; in the event of 3 awardees, there will be Groups A, B and C.
