SPE601-19-R-0310
Answers to Industry Questions:
1) Since a filter will be in line per the military specification is individual trailer particulate testing required? Also, to confirm – Argon testing is waived?
Answer: Yes, each trailer must be tested IAW with the specification requirements for particulate. Per the SOO the Argon testing is NOT required.
2) Can you provide a more detailed demand schedule? Such as typical daily demand other than over 3 trailers per day? Also, can you provide a test schedule or anticipated demand usage?
Answer: Demand schedules vary based on testing requirements. 3 trucks per 24 hour period is an estimated minimum. Per the SOO, after contract award, LM designated POC will actively communicate with supplier to identify anticipated periods of increased usage well in advance.
3) Is there typically detention at the site?
Answer: Detention is very rare at site. Only happens under forced closure exercises which are very rare.
4) Given the risk aversion expressed by Lockheed Martin personnel in placing the entire site volume requirements with one supplier, would the DLA consider revising the solicitation to divide the entire requirements into smaller volume awards?
Answer: The requirement remains unchanged, and one (1) contract award will be made IAW with the terms and conditions of the solicitation.
5) If DLA determines that the answer to question one is no, alternatively, would DLA consider a shorter term period of performance award, 4/1/19-9/30/19, or until year end FY2019, in order to give DLA Energy and Lockheed Martin additional time to determine how best to reduce logistical and supply risk and then re-solicit based on a revised statement of objectives which could provide for a primary supplier as well as a contingency supplier as discussed in the site visit meeting?
Answer: The requirement remains as solicited, and will be a five (5) year contract award.
ADDENDUM TO 52.212-1 -- INSTRUCTIONS TO OFFERORS -- COMMERCIAL ITEMS
(DEVIATION 2018-O0018)

Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors.
The Offeror must be registered and current in the System for Award Management website (https://www.sam.gov/portal/public/SAM/); no exceptions.
Failure to meet a requirement or adhere to an instruction may result in an offer being ineligible for award.
Submission of Offers:
a) Interested parties capable of providing the specified product and services must submit a written offer via email directly to the Contract Specialist, Roman Bernal (Roman.Bernal@dla.mil), and the Contracting Officer, Stephanie Faulkner (Stephanie.Faulkner@dla.mil), not later than the solicitation due date and following the instructions within this solicitation. Failure to agree to the terms and conditions of the solicitation may result in the offeror being removed from consideration for award.
i) As the Government intends to award without discussions, Offerors are advised of the possibility that their proposals may be found unacceptable if exceptions are taken to the solicitation requirements. Clarification of Government requirements should be requested by the Offeror by submitting questions and/or recommended changes not later than 10 calendar days after issuance of the solicitation. All exceptions to the solicitation requirements (including the SOO) and supporting rationale shall be identified as such and consolidated into an overview section of subject volume. An overview section is only required if the Offeror takes exception to any requirement in the solicitation. The overview section will not be included in the page count.
Exception(s) to solicitation requirements may require the Government to amend the solicitation to reflect requirement change(s). If the Offeror takes no exception to the stated requirements, a statement to this effect shall be included in the respective volume.

(End of Provision)
Addendum to FAR 52.212-2 Evaluation -- Commercial Items (Oct 2014)
BASIS FOR CONTRACT AWARD
This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures.
Evaluation will be in accordance with Federal Acquisition Regulation (FAR) 15.101-2, as supplemented by the Defense FAR Supplement (DFARS), and the Defense Logistics Agency Directive (DLAD). Technical or past performance tradeoffs will not be made and no additional credit will be given for exceeding minimum acceptability. Contract award will be made to the Offeror deemed responsible in accordance with FAR 9.104-1 and whose proposals conform to the solicitation requirements. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
a) Offeror proposals are evaluated in accordance with the evaluation criteria. The Government intends to award one firm fixed priced requirements type contract. All Offerors must be technically acceptable and have an acceptable past performance rating to be eligible for award consideration.
b) Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the specific evaluation criteria contained in the solicitation. Non-price factors to be evaluated shall be technical capability and past performance. In accordance with FAR 15.101-2(b)(3), proposals will be evaluated for acceptability but not ranked using the non-price factors.
c) Award will be made to the responsible, technically acceptable Offeror with the lowest total evaluated price for all clins in the solicitation, , including options, if contained in the solicitation. Only one contract will be awarded for all the CLINs specified in the Schedule. Where the Government is soliciting for a group of CLINs, such as on a regional basis, as well as for individual customer locations on a f.o.b. destination basis, more than one contract award may be made as price evaluation and award will be made on a customer location by customer location basis.
d) An Offeror whose proposal is evaluated as acceptable from both a technical capability perspective as well as for past performance will be considered technically acceptable.
Bernal, Roman R CIV DLA ENERGY (US) To comply with legal comments above, changed the language to try to make more clear one award.
Boehm, Suzanne Brangan CIV DLA ENERGY (USA) To me, this is unclear whether we are awarding all CLINs to one contractor as a group, by individual locations, etc. May consider clarifying.
e) The Government intends to award without discussions. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, Offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision.
If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award. The Government reserves the right to conduct discussions.
EVALUATION FACTORS
FACTOR I: TECHNICAL CAPABILITY
Technical capability will be measured against requirements specified in the solicitation. As such, technical capability is considered acceptable when the offeror’s proposal is in compliance with the requirements of the solicitation. Criteria used to judge acceptability are as follows:
(A) Daily Production capability of proposed fill plant(s).
(B) offeror’s ability to meet the logistics required to fulfill the product deliveries.
(C) offeror’s in-process quality control procedures that will ensure the production and delivery of on-specification product.
(D) Offeror’s proposed quality sampling plan that will be implemented to assure individual shipments made under this solicitation meet the product quality requirements stated in the applicable specification or product described.
(E) proposed supply commitment if the offeror is not the manufacturer of the product to be delivered under the contract or is proposing to provide product from a fill point or production facility other than one owned and operated by the offeror.
(G) Offeror’s ability and plan to meet specifications of MIL-PRF-27401G -7 Aug 2013 and in particular how the contractor will meet paragraph 4.4.3 Particulate content.
Technical Factor Rating Table 1
Adjectival Rating Description Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
FACTOR II: PAST PERFORMANCE
The Government evaluation team will conduct an in-depth review and evaluation of all performance data obtained to determine the Offeror’s probability of meeting the minimum past performance solicitation requirements. The team will confirm past performance data identified by the Offerors in their proposals and obtain additional past performance data, as necessary, if available, from other sources.
Past Performance shall generally include verification of performance with the Offeror’s past and current customers, to include Federal, State, and local Governments as well as private entities. The form entitled Contractor Performance Data Sheet may be used to provide relevant and recent performance history pursuant to this solicitation. The Past Performance evaluation is an assessment of the Offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment will be based on the Offeror’s record of relevant and recent past performance information that pertains to the products and/or services outlined in the solicitation requirement. Past Performance shall be evaluated in accordance with FAR 15.305 and DFARS 215.305; however, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Past Performance Table below. However, offerors without a record of relevant past performance or for whom information is not available may not be evaluated favorably or unfavorably on past performance. Additionally, past performance data may be obtained through the Past Performance Information Retrieval System, similar systems or other Government departments and agencies, questionnaires tailored to the circumstances of this acquisition, Defense Contract Management Agency channels, interviews with program managers and contracting officers, and other sources known to the Government (including commercial sources). Offerors may be given the opportunity to address any negative performance information resulting from the past performance assessment inquiries.
Past Performance Rating Table 2
Adjectival Rating Description Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
NOTE: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror will not be evaluated favorably or unfavorably on past performance IAW FAR 15.305(a)(2)(iv). Therefore, the Offeror will be determined to have unknown (or “neutral”) past performance. In context of acceptability/unacceptability, a neutral rating shall be considered “acceptable”.
Past performance shall be initially evaluated to determine whether the Offeror’s present/past performance is recent, and relevant to the effort to be acquired. Secondly, the past performance evaluation shall determine how well the Offeror performed on the prior contracts.
“Recency” is expressed as a time period during which past performance references are considered relevant, and is critical to establishing relevancy of past performance information. For purposes of this acquisition, “recent” is defined as contracts performed within the last five (5) years. The Government will not consider performance on an Offeror’s submission that concluded more than five years prior to the due date of this solicitation.
In establishing what is “relevant” for this acquisition, Offeror’s past performance shall involve performance history that was similar in scope and magnitude of effort and complexity of this acquisition. For this acquisition, the Government will utilize the following thresholds to determine relevancy:
RELEVANCE THRESHOLDS
DESCRIPTION
RELEVANT Contractor’s performance includes:
--Meeting specifications for production and delivery similar in magnitude (approximately 40,000 tons per year) of LN2 IAW MIL-PRF-27401G per year --Providing multiple deliveries of LN2 (or similar) AND --Demonstrated In-process Quality Control Procedures
FACTOR III: PRICE
The Government will evaluate the Offeror’s Price proposal as stated in this section of the solicitation:
(1) F.O.B. Destination product CLINs. For price evaluation purposes, the evaluated price of each CLIN for product 0001, 0002, 0003, 0004 AND 0005 (will be calculated by multiplying the estimated quantity by the proposed unit price of the product(s), which should include all costs associated with the offeror’s delivery of product to the location specified in the Schedule. F.o.b. destination CLINs are normally individual DLA Energy customer locations, unless otherwise specified.
(2) Non-product CLINs/subCLINs. For price evaluation purposes, the following non-product CLINS/subCLINs will be evaluated for award: CLIN 0006, 0007, 0008, 0009, 0010, 0011, 0012.
Each non-product CLIN/subCLIN’s evaluated price will be calculated by multiplying the estimated quantity by the offered unit price. Since only one award will be made, Offerors who do not propose on all non-product CLINs/subCLINs stated in the Schedule may not be considered for evaluation and award.
(3) Lowest Total Evaluated Price for F.O.B. Destination Requirements. Schedule B includes both f.o.b. destination product CLINs as well as non-product CLINs that are to be evaluated in accordance with the solicitation, the evaluated prices for all the non-product CLINs will be added to the evaluated price(s) of the applicable f.o.b. destination product CLINs to determine the lowest total evaluated price.
(4) I209.09 EXTENSION PROVISION (DLA ENERGY JAN 2012) is included and allows the Government to extend the period of performance for up to six (6) months on a unilateral basis. The method for evaluating the extension period and its associated quantities is to multiply an additional six months of requirements by the offered unit price and then to add that total evaluated price to the existing evaluated price for each line item.
The objective of price analysis is to ensure that the final agreed-to price is fair and reasonable in accordance with FAR 15.402. The level of detail of the analysis required is determined by the complexity and circumstances of the acquisition. Other than Certified Cost and Pricing Data may be requested if determined necessary by the Contracting Officer.
Completeness: The Government will evaluate the Offeror’s proposed pricing for completeness. A proposal is complete when all pricing data required under FAR 52.212-1 of the Request for Proposal and requested in the solicitation is provided in the format prescribed.
Balance: Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of price analysis techniques.
Reasonableness: The Government will evaluate the Offeror’s proposed pricing for reasonableness. The Total Evaluated Price (TEP) will include the total of all CLINS proposed, as well as, the extended pricing of the I209.09 EXTENSION PROVISION (DLA ENERGY JAN 2012). Price analysis will be used to evaluate the reasonableness of each Offeror’s TEP to satisfy the requirement mandated by FAR 15.305(a)(1). A price is reasonable if, in its nature and amount does not exceed that which would be incurred by a prudent person in the conduct of competitive business. An assessment of price reasonableness will be performed on the TEP using techniques and procedures described under FAR 15.404-1(b), Price analysis. The burden of proof for price credibility rests solely with the Offeror. Price proposals will not be rated or scored.
