SP7000-21-R-1001
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in
Subpart 12.6 – Streamlined Procedures for Evaluation and Solicitation for Commercial Items as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a Request for Proposal (RFP) number SP7000-21-R-1001.
This notice incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC)
2021-02 effective 23 November 2020, and Defense Federal Acquisition Regulation Supplement
(DFARS) DPN 20201130 edition, and Defense Logistics Acquisition Directive (DLAD) Current to
Revision 5, and PROCLTR 2021-01.
This acquisition is UNRESTRICTED. The associated North American Industrial Classification System
(NAICS) code is 532420 and the small business size standard is $35 Million.
Defense Logistics Agency (DLA) intends to establish multiple award Indefinite Delivery Indefinite
Quantity (IDIQ) contracts with a 60-months ordering period and follow-on Task Orders for up to 60 months for leases of A3, A4, and production level Multi-functional devices (MFDs), accessories and office document devices. These devices include installation and removal, full-service maintenance, all consumable supplies (excluding paper), end-user training, reports, relocations, network functionality, and network security. The geographic scope includes the 50 United States, District of Columbia, Guam, and Puerto Rico.
In accordance with FAR 52.217-6, Option for Increased Quantity, the Contracting Officer reserves the right to increase the quantity of equipment and services at the awarded unit prices listed for each Contract Line Item Number (CLIN) of each task order, not to exceed 20% quantity per CLIN rounded up, over the first 48 months of the period of performance for each task order. This clause is applicable to each task order issued under the resulting contracts.
FAR 52.217-9, Option to Extend the Term of the Contract is included in this requirement and is applicable to each task order issued under the resulting contracts. Up to 60-month task orders will be issued under the resulting contracts. The options will be exercised at the end of each fiscal year. For example, if the up to 60-month period of performance on a task order is July 1, 2021 – June 30, 2026, the base and option years would be as follows:
Base Period: July 1, 2021 – September 30, 2021 Option Year 1: October 1, 2021 – September 30, 2022 Option Year 2: October 1, 2022 – September 30, 2023 Option Year 3: October 1, 2023 – September 30, 2024 Option Year 4: October 1, 2024 – September 30, 2025 Option Year 5: October 1, 2025 – June 30, 2026
There will be a total of two functional areas (FAs). Up to six Indefinite Delivery Indefinite Quantity
(IDIQ) firm fixed price contracts per functional area will be issued. Vendors may provide proposals for
FA1, FA2, or both FAs. Vendors must provide pricing for all CLINs in the FA they choose. Up to 6
IDIQs will be awarded per FA. If it is determined the same vendor will be awarded an IDIQ for both
FA1 and FA2, one IDIQ will be issued for both FAs. The guaranteed minimum is $100,000.00 per
IDIQ. The estimated program ceiling is a total of $702,153,470.00.
IDIQs will be awarded to the Lowest Priced Technically Acceptable (LPTA) proposals, subject to testing and approval.
The ordering period for the IDIQs will be 60-months after the date of award.

INSTRUCTIONS TO OFFERORS
FAR 52.212-1 Instructions to Offerors – Commercial Item (JUN 2020) applies to this acquisition in addition to the following:
1. To compete, the offeror must:
- Submit a maximum of one proposal
- Respond to all CLINs within a functional area, but are not required to respond to all functional areas
2. All submissions must include:
- Proposal must show proof of compliance with all requirements included in the RFP and Performance Work Statement (PWS). Proposals must include original equipment manufacturer (OEM) specifications of each proposed device. Specifications must be from the OEM and, at a minimum, address all technical attributes of the devices listed in the PWS.
- Attachment 2 – CLIN Structure must be completed and returned in Excel format. Must include unit pricing and OEM model numbers of proposed devices
- Attachment 3 – PWS Statement Compliance Form. Any exceptions must be noted on a separate attachment referencing the applicable sections to which an exception is taken.
- Attachment 4 – Full Text Provisions fill-in information must be completed
- Past performance information
- A subcontracting plan if the vendor is a large business
3. Proposal Format:
- Each proposal shall consist of six (6) separate documents specifically named: Cover Page, Technical, Past Performance, Pricing, Offeror Representations and Certification, and a Subcontracting Plan
- Please include the following statement on every page for Parts 2, 3, and 4 of your proposal: “SOURCE SELECTION INFORMATION – SEE FAR 2.101 and FAR 3.104.”
- No price information will be included in Parts 2 and 3
Part 1 – Cover Page:

Part 2 – Technical Requirements:
A. Offerors shall submit one (1) original copy and one (1) redacted version.
(The redacted version will be used during the technical evaluation and, therefore, it should be without company logo, identifying marks, and names. Failure to provide a redacted copy may result in a nonresponsive determination. The Government will validate Offeror’s redacted company information but will not make changes to the Offeror’s provided redacted proposal, either to add or delete redacted text/graphics/etc.).
OEM information, such as model numbers, does not need to be redacted.
B. In Part 2 the offeror must demonstrate compliance with ALL the Technical Requirements set forth in the PWS.
Part 3 - Past Performance:
A. Offeror is required to submit information, on a single page, identifying federal, state, and/or local Government and/or private contracts performed within the past three years, which are similar in scope and complexity to the effort described in this solicitation. Submit no more than three customer references for work performed that is relevant and similar in scope to this requirement. Include reference names, telephone numbers, email addresses, and a brief description of the work performed. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror shall state NONE.
B. In addition, the contracting officer will review the System for Award Management (SAM), the Federal Awardee Performance and Integrity Information System (FAPIIS), and the Past Performance Information Retrieval System (PPIRS) repositories in accordance with FAR 9.104-6(a), to determine contractor responsibility prior to making any award.
Part 4 – Price:
In Part 4 the offeror must submit a single unit price for each CLIN listed on RFP Attachment 2 - CLIN List in the space provided for the unit price. The offeror must provide a total monthly price for each CLIN [Total Evaluated Price Formula = (Quantity * Unit Price) * 60 Months]. Price proposals must reflect Firm Fixed Pricing. For evaluation purposes, a quantity of 1 each will be used for all CLINs.
The 60-month total price of all CLINs will be used to evaluate the lowest priced quote. Vendors must complete and submit Attachment 2, CLIN Structure and return in the same format. DCSO is seeking price reductions for the establishment of the IDIQs. Established IDIQ CLIN pricing will be considered the ceiling price. Further pricing discounts are encouraged at each IDIQ Task Order (TO) via a reverse auction.
Attachment 7, Estimated Quantities reflects only the estimated maximum quantities for each CLIN for the duration of the IDIQs, and is not the guaranteed minimum.
The estimated maximum quantities are provided for informational purposes only for offerors to understand the overall requirement potential.
Part 5 - Representations and Certifications:
As part of the offer, the offeror must include a completed copy of FAR 52.212-3 – Offeror Representations and Certifications – Commercial Items (NOV 2020)
Part 6 - Subcontracting Plan:
IAW FAR 52.219-9
4. Testing
- Unless previously tested and approved by DLA, all devices proposed in response to the contract shall be tested for compliance with Network Security as defined in the Performance Work Statement XIII. NETWORK SECURITY after award.
- The estimated time for testing is twenty (20) business days.
- Testing and approval shall be performed by the DLA Information Operations EMS
Division in conjunction with the Contractor’s assistance.
5. Quality Assurance: Delivery performance will be monitored, and the vendor will be presented with any issues that arise with a resolution completed within seven business days.
EVALUATIONS
FAR 52.212-2 Evaluations-Commercial Items (OCT 2014) applies to this requirement.
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Price, Technical, and Past Performance as stated within Evaluation Factors For Award.
Technical and past performance, when combined, will not be weighted. The Lowest Price Technically Acceptable (LPTA) source selection process will be utilized.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

EVALUATION FACTORS FOR AWARD
In accordance with FAR 15.101-2, the Lowest Priced Technically Acceptable (LPTA) source selection process will be utilized for this requirement. Award will be made on the basis of the lowest evaluated price of proposals in the competitive range meeting or exceeding the acceptability standards for non-cost factors. Tradeoffs are not permitted, and performance incentives/disincentives will not be utilized. Proposals will be evaluated for acceptability but not ranked using the non-cost/price factors. The evaluation criteria are as follows: Price, Technical Capability, and Past Performance.
Awards will be made to the responsible offerors who meets all technical factors, has acceptable past performance and results in the lowest price to the government.
A. Technical Factor
To be technically acceptable each offer must demonstrate it meets the minimum specification requirements of each device as well as any information technology (IT) and security requirements set forth in the attached PWS. This will be evaluated as “Acceptable” or “Unacceptable” basis. In order to receive an “Acceptable” rating the offer must clearly demonstrate the ability to provide and perform all services and technical requirements described in the PWS. An offer that is evaluated as “Unacceptable” for any requirement will not be considered for award.
B. Past Performance
A past performance review will be conducted to determine whether the Government has confidence that the offeror can successfully perform the requirements set forth in the PWS. In conducting its past performance assessment, the Government may use both data provided by the offeror and data obtained from other federal Government sources. Information has to be within the past 3 years of similar supplies and services.
Past performance shall be used as an evaluation factor within the LPTA process, unless waived by the Procurement Contracting Officer, in accordance with FAR 15.101-2(b). Past performance shall be evaluated in accordance with FAR 15.305 and DFARS 215.305. However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings below.
Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable: Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
C. Price
Vendors’ proposed prices for each CLIN and Total Price will be evaluated for price reasonableness and fairness using the techniques discussed at FAR 15.404-1 including, but not limited to, comparison to current and historical prices paid for similar products and comparisons to proposal pricing received.
Each offerors’ total price will be determined by the 60-month total for all CLINs. The lowest total evaluated price equals the best value for this requirement; there are no known monetized requirements or best value tradeoffs. The overall 60-month total of the vendors’ proposal will be used to determine the competitive range. No more than 6 IDIQs will be awarded per FA. The 6 lowest price technically acceptable proposals per FA will be awarded IDIQs.

Full Text Clauses
FAR 52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS
AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
(a) Definitions. As used in this clause— Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).
Covered foreign country means The People’s Republic of China.
Covered telecommunications equipment or services means–
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment;
or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means–
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another’s network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.
Reasonable inquiry means an inquiry designed to uncover any information in the entity’s possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.
Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement. (1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause—
(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause:
any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

FAR 52.211-5 MATERIAL REQUIREMENTS (AUG 2000)
(a) Definitions.
As used in this clause- New means composed of previously unused components, whether manufactured from virgin material, recovered material in the form of raw material, or materials and by-products generated from, and reused within, an original manufacturing process; provided that the supplies meet contract requirements, including but not limited to, performance, reliability, and life expectancy.
Reconditioned means restored to the original normal operating condition by readjustments and material replacement.
Recovered material means waste materials and by-products recovered or diverted from solid waste, but the term does not include those materials and by-products generated from, and commonly reused within, an original manufacturing process.
Remanufactured means factory rebuilt to original specifications.
Virgin material means-
(1) Previously unused raw material, including previously unused copper, aluminum, lead, zinc, iron, other metal or metal ore; or
(2) Any undeveloped resource that is, or with new technology will become, a source of raw materials.
(b) Unless this contract otherwise requires virgin material or supplies composed of or manufactured from virgin material, the Contractor shall provide supplies that are new, reconditioned, or remanufactured, as defined in this clause.
(c) A proposal to provide unused former Government surplus property shall include a complete description of the material, the quantity, the name of the Government agency from which acquired, and the date of acquisition.
(d) A proposal to provide used, reconditioned, or remanufactured supplies shall include a detailed description of such supplies and shall be submitted to the Contracting Officer for approval.
(e) Used, reconditioned, or remanufactured supplies, or unused former Government surplus property, may be used in contract performance if the Contractor has proposed the use of such supplies, and the Contracting Officer has authorized their use.

(d) Comptroller General Examination of Record. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. FAR 52.217-6 OPTION FOR INCREASED QUANTITY (MAR 1989)
The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor within 30 Days. Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties otherwise agree.

FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 60 Days.
