Amendment 03 – BAA SP4701-23-B-0002

2 | P a g e

This amendment contains answers to offeror questions.

Broad Agency Announcement (BAA) SP4701-23-B-0002 is amended as follows:

1) OFFEROR QUESTIONS AND ANSWERS:

1. Question #1: Clause HHSAR 352.231-70 Salary Rate Limitation (DEC 2015) - We are trying to interpret the Salary Rate Clause. Our interpretation of the clause is that the total amount paid to an individual per year must not exceed the Executive Schedule Level II limitation (e.g. an individual paid at $300k can support the SHARE program at 70% LOE, as they would be billing <$212k/year).

Would clarification be given on how this clause is interpreted?

Government Response: For more information, please see the HHS FAQ on the Salary Rate Limitation here: https://www.hhs.gov/grants-contracts/contracts/contract-policies-regulations/salary-rate-limitation/index.html

2. Question #2: The BAA states the following, “Offeror’s who submit a proposal, must submit audited or forward pricing rate agreements from DCAA or HHS if available. If an offeror does not have this information, an offeror must submit its budgetary data for the entire period of contract performance that shows the calculations for its indirect rate structure.” ******* has approved provisional billing rates from DCAA. Would this be sufficient for our proposal in lieu of an

FPRA?

Government Response: Yes.
