Q1. How long does it take to manage service for Vilseck?

A1. It take approximately 1 day, sometimes 1 1/2 days to complete the Waste Management Service for Vilseck.

Q2. Are the number of accumulation points in attachment 7 correct?

A2. The generator reviewed attachment 7 before it was sent to DLA Disposition Services.

Q3. Who will help open the lids of the underground storage tanks during oil removal?

A3. One of DPW utilities personnel accompanies the removal to open all the lids for the underground tanks scheduled for that day.

Q4. Are there any special requirements for the vehicles used for the WMS (4x4)?

A4. There are no special requirement for what type of vehicles to use. Just be aware of the weather conditions in the Grafenwohr/Vilseck area.

Surveillance of the underground storage tanks and pumping is not part of the WMS.

Q6. Where does the removal take place?

A6. All removals (drums, ASP, pallet mesh cage) take place at HWSA #124 in Vilseck, except the removals of 10 cbm containers that are scattered throughout Vilseck and Grafenwohr, or 38 cbm container of wood occur at the landfill Bldg. #701 in Grafenwohr and in Vilseck at the ASP #1 and other locations. Removal depend upon how fast they fill.

Q7. Where will the HW go after it is picked-up from Vilseck and Grafenwohr during WMS?

A7. Some material collected during the WMS in Grafenwohr can be dropped off at the landfill. However, the landfill has limited storage capability for HW. The majority of the HW collected from WMS performed will be taken to Vilseck to HWSA #124. Collected empty drums, metal (oil- 200 liter) during WMS should be dropped at the landfill at their local shredder.

Q8. How many days does it take to accomplish the WMS for Grafenwohr?

A8. It takes approximately 2 1/2 days - 3 days to complete the Waste Management services for Grafenwohr.

Questions and answers from Katterbach and Illesheim site visit 16 Feb 2017.

SP452017R0002-0002

Q4. Approximately, how many removals (pick-up) occur in a year for Ansbach/illesheim?

A4. Four to five removals not including refrigerator, oil and e-scrap.

Q5. Are there pumpimg of liquids required during WMS in Katterbach or Illesheim? Motor parks and Airfield??

A5. Yes, pumping does occur sometimes during WMS at Ansbach/Katterbach and Illesheim. Ther is no electricity at the points. It is required to either switch the containment (200-liter drums, ASF via lift gate truck) or bring a generator for electricity to do the pumping of liquid with an explosion proof pump. Surveillance of the underground storage tanks and pumping is not part of the WMS.

Q6. A question about reference: 4(c)(2)(ii)(A). Ordered Monthly, 12-14 HWAP/HWSA. Locations within Rose Barracks (Vilseck) will require weekly service. Sites will also require pumping of liquids from HWAP to a Bulk Underground storage tank for centralized removal.

A6. Waste fuel pumped during WMS within Rose Barrack (Vilseck) will be taken to a bulk underground storage tank for centralization in Grafenwohr.

Q7. Where will the HW go after it is picked-up from Ansbach and illesheim during WMS?

A7. The HW will go to the HWSA point #5518 in Katterbach and or to point #8031 in Shipton (see attachment 7).

Q8. 4(C)(1)(xxiii). The contractor shall appoint an OST for USAG Bavaria and USAG Ansbach and these persons must have basic training waste identification and management to ensure proper collection, compliant storage, and disposal of HW. The OST must establish an office for USAG Bavaria and USAG Ansbach. ??

A8. I could not answer. I will get back with the answer. (see A8a below).

A8a. Regarding the office space, in Hohenfels the OST can use a cubical located at Sort Facility Bldg. #125, in Ansbach an office cubical located at Bldg. #5518 (Katterbach) and #8031 in Illesheim and for Vilseck and office located at the HWSA Bldg. #124. There are no phone lines or restrooms at either locations.

Additional questions/ clarification.

Q1. Please clarify if there are 29 locations taken 5 at a time or which is correct 5 or 29 locations to be serviced and/or what is the correct way to answer this.

A1. Attachment 7 lists 29 locations, but not more than five (5) HWAP are part of the WMS for the week. The OST receive a list with the HWAP's locations and a key for the containers.

Q2. Please clarify which services have to be calculated under CLINs N6670 - N6670O? Please clarify CLINs N6670 - N6670O with titled "LAGA Sampling" in the price schedule. Section 4(a)(1) of the PWS indicate that an analytical report has to be submitted under CLINs N6670 - N6670O for LAGA sampling.

A2. That is correct.

Q3. Please clarify the difference between "sampling" and "sampling and analysis" A3. Sampling and sampling analysis both cases requires an analysis. LAGA Sampling is done to determine the extent of toxic substance in the soil, which include an analysis.

If prior investigations determine that the soil is suspected of containing toxic substance a LAGA sampling will be order which includes an analysis to determine the amount of contamination.

This is done to determine what Landfill will take

The following is deleted from:

Section 4(c)(1)(xxiii) of the PWS " The OST must establish an office for USAG Bavaria and one for USAG Ansbach."

Attachment 7D Hohenfels is updated to reflect Receiving Services at the Sort Facility, Building #125.

Part 12 Clauses

ADDENDUM TO 52.212-04 CONTRACT TERMS AND CONDITIONS - COMMERCIAL ITEMS

(b) Assignment: See DFARS 252.232-7008, ASSIGNMENT OF CLAIMS (OVERSEAS).

(c) Changes:

(1) Changes in terms and conditions of this basic contract may be made only by written agreement of the parties. Formal written agreement of the parties relative to the following terms and conditions is hereby made through contract acceptance or bilateral contract modification, as applicable.

(2) This addendum also serves as the formal written agreement of the parties authorizing revisions to CLIN weights/quantities for task orders issued against the contract. All task order weights are estimated amounts. The contractor can expect that the task order weights will be required to be adjusted upward or downward as removals take place and the actual pounds being removed are measured. Therefore, the Government has the unilateral right to increase the task order weight in those instances where the Government has underestimated the amount of weight that is required to be removed so the contractor can continue performance. The Government has the unilateral right to decrease the task order weight in those instances where the Government has overestimated the amount of weight that is required to be removed. In instances of decreasing weight, these decreases are not subject to FAR 52.212-4(l), Termination for the Government’s convenience. In addition, it is agreed that it is acceptable for the Government to issue task order modifications (e.g., quantity changes, noun descriptions, HIN changes, adding/deleting lines, extending task order end dates, etc.) unilaterally. The contractor will be paid for the actual items and quantities removed per the awarded contract price schedule. If, upon receipt of a unilateral task order modification, the contractor does not agree with the change or changes, the contractor reserves the right to seek resolution with the Contracting Officer. These modifications are only against task orders. No changes are made to the terms and conditions of the contract.

(g) Invoice: See PWS Section entitled DOCUMENTATION REQUIREMENTS, ACCEPTANCE, INVOICING, AND TRACKING.

(k) Taxes: Contract prices are exclusive of taxes or duties. See FAR 52.229-06, TAXES – FOREIGN FIXED-PRICE CONTRACTS; DFARS 252.229-7000, INVOICES EXCLUSIVE OF TAXES OR DUTIES; DFARS 252.229-7001, TAX RELIEF.

(t) This paragraph is revised to read as follows:

(t) System for Award Management (SAM).

(1) Unless exempted by an addendum to this contract, the Contractor is responsible during performance and through final payment of any contract for the accuracy and completeness of the data within the SAM database, and for any liability resulting from the Government’s reliance on inaccurate or incomplete data. To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(2)

(i) If a Contractor has legally changed its business name, “doing business as” name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day’s written notification of its intention to:

(A) Change the name in the SAM database;

(B) Comply with the requirements of Subpart 42.12 of the FAR;

(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor must provide with the notification sufficient documentation to support the legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (t)(2)(i) of this clause, or fails to perform the agreement at paragraph (t)(2)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the “Suspension of Payment” paragraph of the electronic funds transfer (EFT) clause of this contract.

(3) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims).

Assignees shall be separately registered in the SAM database. Information provided to the Contractor’s SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the “Suspension of payment” paragraph of the EFT clause of this contract.

(4) Offerors and Contractors may obtain information on registration and annual confirmation requirements via SAM accessed through https://www.acquisition.gov.
