Amendment issued to answer received questions, provide a site visit schedule, and update the PWS and some attachments.
Q1. How many drums, ASP, ASF, containers or other packaging must be placed in the individual locations?
Please create a list of the types and quantities for each location.
A1. An update to Attachment 7 is posted with this amendment.
Q2. Are the drums purchased by DLA and can be rent charged for ASP, ASF and container?
A2. See PWS 2(a)(6)(i) and 4(c)(1)(ix) - providing containers for collections and transportation of waste is an included task under Waste Management Services. The contractor is responsible for placing all required containers for Waste Management Services at the start of contract performance. This is not a separate purchase by DLA. See PWS 2(a)(6)(i) regarding drums purchased under CLINs N6700 - N6899.
Q3. According to the solicitation, a 7.5-ton truck with lift gate is required for service in Ansbach. What is the decisive criterion, the 7.5 tons or the lift gate?
A3. As stated in 4(c)(2)(iv)(C), the contractor must perform WMS with a contractor-owned vehicle with the capability to transport hazardous waste containers with a maximum weight of 1500 KG without any government support. The 7.5 ton truck with lift gate is only an example, not a specific requirement. It is the contractor's decision what type of vehicle to use.
Q4. For emptying of drums in Hohenfels, an explosion-proof pump with a capacity of at least 243 liters per minute is required. Drum pumps generally have performances depending on viscosity and temperature of 50-100 liters per minute. What is the deciding criterion, explosion-proof or capacity?
A4. Explosion proof. 4(c)(3)(iv)(D)(5) is revised to remove "with a minimum flow rate of 243 liters/minute."
Q5. In Ansbach and Hohenfels a service has to be done on every Wednesday, this requires double staff. Would it be possible to change the service in Hohenfels from Wednesday to Thursday?
A5. The generator would prefer to keep service in Hohenfels on Wednesday since it is well established with their customers.
Q6. According to section 8 of subject solicitation the contractor is required to provide containers for waste streams that are identified in Attachment 7 as contractor provided. However, Attachment 7 does not list any waste streams, nor does it identify containers as contractor provided. Which containers (type and amount of containers) will have to be placed in the locations listed in Attachment 7 after contract award?
A6. Attachment 7 has been updated to include types and quantities of containers.
Q7. Is it possible for a site visit to see the accumulation points in Ansbach, Grafenwoehr, and Garmisch?
A7. A site visit is scheduled for 15 February at Grafenwoehr and Vilseck, and 16 February at Ansbach and Illesheim. Companies interested in participating must contact Ursula.Lee.deu@dla.mil and copy nathanial.gaunt@dla.mil at least one day before the site visit. A scheduled site visit at Garmisch is not available, but a map is available upon request.
Q8. Can the approximate ratio of waste generation between Grafenwoehr, Ansbach and Garmisch be provided?
A8. The approximate ratio of waste generation, including Hohenfels, is 45% Grafenwoehr/Vilseck, 25% Ansbach, 25% Hohenfels, and less than 5% at Garmisch.
The following is added to the PWS:
3(a)(7)(viii) PFC contaminated solids (N2710) shall be incinerated at a combustion temperature with a minimum of 850 degrees Celsius and a residence time of at least 2 seconds is required for thermal disposition.
4(c)(2)(vii) is changed to monthly ordering.
4(c)(3)(iv)(D)(4) references to Attachments 4 and 5 are both replaced with Attachment 13.

Part 12 Clauses
ADDENDUM TO 52.212-04 CONTRACT TERMS AND CONDITIONS - COMMERCIAL ITEMS
(b) Assignment: See DFARS 252.232-7008, ASSIGNMENT OF CLAIMS (OVERSEAS).
(c) Changes:
(1) Changes in terms and conditions of this basic contract may be made only by written agreement of the parties. Formal written agreement of the parties relative to the following terms and conditions is hereby made through contract acceptance or bilateral contract modification, as applicable.
(2) This addendum also serves as the formal written agreement of the parties authorizing revisions to CLIN weights/quantities for task orders issued against the contract. All task order weights are estimated amounts. The contractor can expect that the task order weights will be required to be adjusted upward or downward as removals take place and the actual pounds being removed are measured. Therefore, the Government has the unilateral right to increase the task order weight in those instances where the Government has underestimated the amount of weight that is required to be removed so the contractor can continue performance. The Government has the unilateral right to decrease the task order weight in those instances where the Government has overestimated the amount of weight that is required to be removed. In instances of decreasing weight, these decreases are not subject to FAR 52.212-4(l), Termination for the Government’s convenience. In addition, it is agreed that it is acceptable for the Government to issue task order modifications (e.g., quantity changes, noun descriptions, HIN changes, adding/deleting lines, extending task order end dates, etc.) unilaterally. The contractor will be paid for the actual items and quantities removed per the awarded contract price schedule. If, upon receipt of a unilateral task order modification, the contractor does not agree with the change or changes, the contractor reserves the right to seek resolution with the Contracting Officer. These modifications are only against task orders. No changes are made to the terms and conditions of the contract.
(g) Invoice: See PWS Section entitled DOCUMENTATION REQUIREMENTS, ACCEPTANCE, INVOICING, AND TRACKING.
(k) Taxes: Contract prices are exclusive of taxes or duties. See FAR 52.229-06, TAXES – FOREIGN FIXED-PRICE CONTRACTS; DFARS 252.229-7000, INVOICES EXCLUSIVE OF TAXES OR DUTIES; DFARS 252.229-7001, TAX RELIEF.
(t) This paragraph is revised to read as follows:
(t) System for Award Management (SAM).
(1) Unless exempted by an addendum to this contract, the Contractor is responsible during performance and through final payment of any contract for the accuracy and completeness of the data within the SAM database, and for any liability resulting from the Government’s reliance on inaccurate or incomplete data. To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.
(2)
(i) If a Contractor has legally changed its business name, “doing business as” name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day’s written notification of its intention to:
(A) Change the name in the SAM database;
(B) Comply with the requirements of Subpart 42.12 of the FAR;
(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor must provide with the notification sufficient documentation to support the legally changed name.
(ii) If the Contractor fails to comply with the requirements of paragraph (t)(2)(i) of this clause, or fails to perform the agreement at paragraph (t)(2)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the “Suspension of Payment” paragraph of the electronic funds transfer (EFT) clause of this contract.
(3) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims).
Assignees shall be separately registered in the SAM database. Information provided to the Contractor’s SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the “Suspension of payment” paragraph of the EFT clause of this contract.
(4) Offerors and Contractors may obtain information on registration and annual confirmation requirements via SAM accessed through https://www.acquisition.gov.
