Amendment 0002
1. The purpose of Amendment 0002 is to answer vendor questions and to extend the deadline for proposals to August 3, 2016, 1:00 PM EST.
Question 1:
Since this project is set-aside for Small Business, there are two (2) elements of the stipulated partial payments clause cited that are uncharacteristic for Small Business. The 30% retainage rate is far beyond the typical Small Business thresholds of 15% or 10%. This high rate of retainage discourages Small Business participation and, at minimum, forces outside contract financing. Additionally, the Government has restricted these partial payments to three (3). Typically, given the complex nature of this project, milestones can be agreed to that would allow the contractor to invoice the Government several times as progress was achieved on both demolition and installation of new equipment. As it is currently structured, the Government withholds any payment until ALL of the demolition work has been completed and then a maximum of 70% of the contract amount when ALL of the new equipment has been delivered. We request that the retainage rate be lowered to a more realistic 10% or 15% for Small Business concerns. Further, since the depot is trying to continue operations during this project, it is likely a phased demolition and installation schedule will be required. In that case, demolition and installation could easily be gauged on a section by section basis of Building 16 allowing for as many as seven (7) partial payments for demolition and similarly seven (7) partial payments for new equipment delivery with a cumulative maximum invoice amount of 85% or 90% of the contract amount versus the current 70%.
Answer 1:
The partial payment schedule on page 2 of the Request For Proposal (RFP) is revised as follows:
*Payment 1 - For completion of demolition *Payment 2 - For actual cost of materials delivered and accepted by the Contracting Officer Representative (COR) to be validated with supplier invoices.
*Payment 3 - For 50% completion of the total project *Payment 4 - For completion with operational testing *Final payment – Shall be made upon final acceptance of all deliverables by the Government and completion of final operation testing.
The total value of partial payments 1 – 4 shall not exceed 90 percent of the total dollar amount of CLINs 0001-0003.
All other terms and conditions regarding partial payments remain unchanged.
Question 2:
4.4.10 Final Acceptance – since the Government intends to operate Building 16 during the performance of this project, we request Partial Acceptance be added to the requirement whereby the local users can attest when one (1) or more of the various sections has been satisfactorily replaced and the Government is using the new conveyor to transport its products immediately after Performance Testing.
In several areas, it will be necessary for the Government to provide product to run over the new conveyor to ensure functionality. Many areas of the system has minimal controls, traffic devices or variants and are merely transportation lines. Performance Testing will be dependent upon GFE tote traffic to ensure compliance. Once that section of the building has been returned to normal operations, it seems to us fully appropriate for the Government to allow for Partial Acceptance.
Answer 2:
Question 3:
Para 2.1.1 Page 8 – In the case of this system, we are essentially replacing existing conveyor. There will be no new wall penetrations and the conveyor is to be routed through existing conveyor tunnels that include deluge sprinklers or fusible links. Reference is made to UFC 3-600-01 generally. UFC code compliance on an existing system can be issued locally by the Government. That is to say, for example, existing conveyor tunnels can be re-used ‘As-Is’. On the other hand, current UFC Code 3-600-01 is demanded as the minimum requirement, significant modifications to the existing tunnels will be required. This will add significant time and expense to this project. It may also have a deleterious effect on the existing sprinkler system insofar as requiring additional volume inside current water trunk lines to supply higher calculated hydraulics. Since this exemption can be issued locally, we request a statement from the Government, prior to bid opening, that sanctions or “Grandfathers-in” the new conveyor system to its existing wall penetrations and conveyor tunnels. Otherwise, it should be so stipulated that current UFC Code Compliance is required. This will add time and expense of re-working ALL existing wall penetrations containing conveyor tunnels. Miscellaneous items such as new additional sheet metal, wall bracing, and additional sprinkler heads will more than likely be required.
Answer 3:
The contractor is not responsible for functionality/conformance of existing deluge tunnels between building sections. The conveyor penetration between 16A-2 and 16A-3 is a fire door. The contractor is not responsible for the functionality of this door either, but the new conveyor must not inhibit the functioning of this door.
Question 4:
Para 3.3.2.2.1 – Seismic Considerations – the UFC Code named 3-310-01 is a 62 page document that is extremely broad in its content. So as to avoid any misunderstanding: Is the Government requiring California P.E. stamped approvals for compliance with the above captioned UFC Code? If that is the minimum requirement, it is not reasonable to expect this bin conveyor system can be reviewed and validated by an independent engineering resource prior to the opening of the bids. Please clarify the Government’s expectations.
Answer 4:
The bidder does not need to have PE stamped drawings for the proposal. This costs should be considered/included in their bid, however.
Question 5:
Can DDSJ provide one truck loading dock fixture at the rail dock in bldg. 16-4A for the project duration?
Answer 5:
A truck loading dock will be provided by the government at 16A-4.
Question 6:
Can DDSJ maintenance remove and safely store the RFID antenna mounted to conveyor to be removed?
Answer 6:
The contractor will remove and disconnect the RFID devices and set aside. The COR will coordinate disposition with depot staff support.
Question 7:
Can the Government modify the partial payment to read not to exceed 90 Percent?
Answer 7:
Question 8:
Can DDSJ accept zero pressure between accumulated tubs and allow surfaces to be in contact due to some coasting after the driving force is removed in each accumulating zone?
Answer 8:
Tubs can "touch" at the zero-accumulation sections. Complete separation is only necessary prior to divert points.
2. All other terms and conditions remain unchanged.
