Amendment 0005

This amendment is issued to incorporate the provision Addendums listed below into the Performance Work Statement under solicitation, SP0600-12-R-0500, see below;

1. Solicitation provision Addendum to 52.212-2 is modified as follows:

Subfactor (f): Training - Technical, managerial, and operational details to ensure contractor personnel have requisite skills and associated training to accomplish all government requirements. The proposal must provide procedures to be implemented to ensure all contractor personnel are qualified and certified to accomplish all required tasks. The proposal must identify required courses and frequencies for maintaining personnel competence and method of documentation and certification. The proposal must also address the requirements for providing training to AF personnel. The proposal must demonstrate an understanding of the required experience and training of key personnel.

APPENDIX E

PERSONNEL

Key Personnel

Corporate Fuels Officer: To ensure continuity between the terminal and the Contractor’s home office, the Contractor shall employ during the life of this contract an executive who can make decisions concerning this contract;

who has a complete understanding of the terms and conditions of this contract; and who preferably has experience in the operation and maintenance of bulk petroleum storage terminals.

Terminal Superintendent (TS): To ensure on-site management of PWS requirements, the Contractor shall employ a TS at each AF base under this contract for the life of this contract.

(1) The TS shall have significant, specialized commercial or military experience in fuel terminal operations and maintenance performing and supervising tasks equivalent to an AF Fuels Management seven-skill level (2F071) or nine-skill level (2F091) personnel. This experience shall include receiving, storing, issuing, and shipping petroleum products via tank truck, pipeline, rail, or tanker/barge as appropriate to the Air

Force installation’s mode of receipt capability and maintenance and repair of bulk petroleum storage terminals, systems, and equipment.

(2) The TS shall have significant, relevant, and preferably recent supervisory experience. Although general supervisory experience may be included, specialized supervisory experience in fuel terminal operations with emphasis in terminal maintenance, operations and environmental compliance must be predominant.

(3) This cannot be a collateral duty job. If the TS is absent for short periods (minor illness, vacation), an alternate must be designated and available to perform the TS duties. For extended absence (hospitalization, temporary duty), the Contractor shall notify the Contracting Officer and provide a qualified temporary or permanent replacement at no additional cost.

(4) After award, a resume meeting the above requirements must be submitted within 30-days for review and acceptance by DLA Energy. A replacement candidate’s resumes must also be submitted for review prior to assuming the duties as TS.

Assistant Terminal Superintendent (ATS): To assist the TS with on-site management of PWS requirements, the Contractor may employ an ATS.

(1) The ATS shall have commercial or military experience in fuel terminal operations and maintenance performing and supervising tasks equivalent to an AF Fuels Management seven-skill level (2F071) personnel. This experience shall include receiving, storing, issuing, and shipping petroleum products via modes as appropriate to the Air Force installation’s capability and maintenance and repair of bulk petroleum storage terminals, systems, and equipment.

(2) This may be a collateral duty job.

After award, a resume meeting the above requirements must be submitted within 30-days for review and acceptance by DLA Energy. If an ATS is subsequently designated or a replacement candidate for an initially employed ATS is nominated, resumes must be submitted for review prior to assuming the duties as ATS.

Additional Personnel

Fuel Distribution Systems Mechanic (FDSM) (as defined in the Service Contract Act, Directory of Operations category 23340):

(1) Shall have commercial or military experience in maintaining fuel bulk storage and distribution systems and equipment performing tasks equivalent to an AF Water and Fuel System Maintenance five-skill level (3E452) personnel.

(2) A minimum of one FDSM will be employed at each AF base where the Contractor is responsible for PM under this contract according to Appendix D.

(3) After award, a resume meeting the above requirements must be submitted within 30-days for review and acceptance by DLA Energy. Replacement candidate’s resumes must also be submitted for review prior to assuming the duties as FDSM.

Fuel Distribution System Operator (FDSO) (as defined in the Service Contract Act, Directory of Operations category 21010):

(1) Shall have a commercial or military experience in operating fuel bulk storage and distribution systems and equipment performing tasks equivalent to an AF Fuels Management five-skill level (2F051) personnel.

(2) Lead Operators shall have experience equivalent to an AF Fuels Management seven-skill level (2F071) personnel.

General

Personnel qualifications and staffing are important sub-factors in evaluating the Contractor’s proposal and subsequent capability to successfully provide the services specified in the PWS.

The Contractor shall ensure personnel assigned to all tasks have the requisite knowledge and skills to meet minimum performance standards and comply with all applicable Federal, State and local laws and regulations.

The Contractor shall ensure personnel assigned are able to speak, read and comprehend English (be literate) to the extent of reading and understanding printed regulations, detailed written orders and operating procedures, training instructions and materials and be able to compose reports which convey complete information. For overseas locations, the Contractor shall ensure sufficient personnel are able to speak, read, and comprehend the host nation language if required to effectively conduct operations or maintenance.

Unique aspects of fuels operations and maintenance, such as the two person policy for safety, confined space entry requirements, visitor control, escort duties, capability to conduct simultaneous operations, and variability in task times and duration, necessitate maintaining a certain level of staffing to ensure success. Failure to staff accordingly may not result in an immediately noticeable lapse in performance requirements, but will likely lead to intermittent lapses, threatened lapses or potential long range impacts. Also, the risk of failure of critical military missions can be mitigated by ensuring proposed, evaluated, and approved key personnel, FDSMs, and FDSOs are assigned and available during the specified hours of operation. Therefore, the Contractor agrees to provide the proposed amount of full-time equivalent (FTE) staffing and specifically assign personnel who meet or exceed the requirements of this Performance Work Statement. No reduction or addition of FTEs shall be made without approval from the Contracting Officer. After awared, no substitution of key personnel or FDSMs shall be made without approval from the Contracting Officer.

The Contractor agrees that after the Government’s acceptance of nominated key personnel, no key personnel or FDSM substitutions will be permitted unless such substitutions are necessitated by an individual’s sudden illness, death or termination of employment. In any of these events, the Contractor shall promptly notify the Contracting Officer and provide the information required below.

If personnel for whatever reason become unavailable for work under this contract for a continuous period exceeding 30 work days or are expected to devote substantially less effort toward the work than indicated in the proposal, the Contractor shall propose a substitution of such personnel in accordance with the below requirements.

All proposed substitutions shall be submitted, in writing, to the Contracting Officer at least 15 days prior to the proposed substitution. Each request shall provide detailed explanation of the circumstances necessitating the proposed substitution, a complete resume for the proposed substitute and any other information required by the Contracting Officer to approve or disapprove the proposed substitution. All proposed substitutes (no matter when they are proposed during the performance period) shall have qualifications that are equal to or higher than the qualifications of the person being replaced.

In the event a requirement to increase the specified level of effort for a designated labor category, but not change to the overall level of effort of the contract occurs, the Contractor shall submit to the Contracting Officer a written request for approval to add personnel to the designated labor category. The information required is the same as that required above.

The additional personnel shall have qualifications greater than or equal to at least one (1) of the individuals proposed for the designated labor category.

The Contracting Officer shall evaluate requests for substitutions and addition of personnel and promptly notify the Contractor, in writing, whether the request is approved or disapproved.

If the Contracting Officer determines that suitable and timely replacement of personnel who have been reassigned, terminated or are unable to perform under the contract is not reasonably forthcoming or that the resultant reduction or productive effort would impair the successful completion of the contract, the contract may be terminated by the Contracting Officer for default or for the convenience of the Government, as appropriate. Alternatively, at the Contracting Officer’s discretion, if the Contracting Officer finds the Contractor to be at fault for the condition, he may equitably adjust (downward) the contract price or fixed fee to compensate the Government for any delay, loss or damage as a result of the Contractor’s action.
