Additional Terms:

Between $250,000 and $500,000.
3) Mobilization does not include on-site construction activities including the movement of personnel, materials, or equipment within the project site.
4) Payment for bond premiums in accordance with (IAW) Federal Acquisition Regulation ((FAR)
48 CFR Chapter 1) Clause 52.232-5 Payments under Fixed-Price Construction Contracts, shall not be in addition to the contract price. Include bond payments under Mobilization.
5) Payment will be made IAW Section G.2. only for those Items listed on the Schedule of Items above.
SECTION C - DESCRIPTION/SPECIFICATION/STATEMENT OF WORK
C.1 Description of Work / Scope of the Contract
A. This project consists of what is shown on the plans and as stated in the specifications, and as summarized below:
1. Mobilization
2. Clearing and Grubbing
3. Constructing new Picnic Pad and Shelter with site furnishings
4. Constructing a guardrail extension at the viewing platform
5. Elevated boardwalk construction with handrail
6. Precast and install concrete steps
7. Installation of signs, including interpretive signs (interpretive signs are government furnished)
8. Gravel Trail construction
9. Building the sitting bench and installing
The Contractor shall assume all risk, loss, damage, or expense arising out of prosecution of the work, except as otherwise provided in the contract.
B. Utility Disconnects
1. Disconnecting utilities, including water, wastewater, communication cable and electric, and stubbing lines off for future reconnection.
C. Demolition work includes the following:
1. Demolition of the existing comfort station and sidewalks.
2. Proper removal and disposal of contents, including proper recycling of thermostats, ballasts and light bulbs.

3. Disposal of all building demolition debris and contents. Existing building does not contain hazardous materials.
4. Salvage materials indicated for re-use, as shown on the drawings.
D. Clearing and Grubbing
1. Clearing and grubbing vegetation adjacent to existing building, and shrubs between road and existing building, removal of three large trees (greater than 12” in diameter), and several other small trees (less than six inches in diameter). Stump grinding at removed trees, limbing any additional trees up to a height of 15 feet in the ‘installation area’, bucking and placing in an approved location on site.
E. Site preparation work includes:
1. Erosion Control as needed.
2. Grading the building pad and compacting the sub-base and base rock in accordance with toilet manufacturer requirements and in drawings.
3. Preparation for the crane landing (in coordination with toilet manufacturer requirements).
4. Utility connections to existing service lines and preparing all new utility stubs as specified by toilet manufacturer, after building demolition is complete.
5. Working with local utility authorities to ensure work is performed in accordance with their requirements.
6. Ensuring stub ups are installed in accordance with toilet manufacturer requirements and contract requirements.
F. After site prep work is done, new precast concrete buildings will be installed, and designated utilities will require reconnection to the new toilet facility. Upon completion of building installation, new construction work includes the following:
1. Construction of new concrete pads and walkways as specified.
2. Salvaged Pump Station Control Panels and circuitry inside new walk-in enclosure.
3. Placement of seed and weed-free straw for erosion control.
C.2 Project Location and Access
The project is located on the Olympic National Forest, Grays Harbor County, Washington. From Quinault, WA travel southwest on South Shore Road for 0.9 miles. Turn left into the Quinault Rainforest Trailhead. (Access for trailers and trucks will be from South Shore Road. The bathroom is 100’ from the South Shore Road). C.3 Reference Codes, Standards, and Specifications
A. All work shall be accomplished in a safe, workmanlike manner and in accordance with standard industry practices. Plumbing work shall comply with the latest edition of the International Plumbing Code. Electrical work shall comply with the latest edition of the National Electrical Code. Concrete work shall comply with American Concrete Institute.
These specification and drawings cover requirements for contractor to demolish and remove an existing building, furnish and install new toilet building and enclosure building, plumb sewer and water stub ups, install electrical stub ups, place sidewalks, and perform sediment and erosion control.
B. The Contractor shall remove from the job site any employee for reasons of misconduct or security.
C. Actions and recommendations submitted by the Contractor shall comply with applicable laws and regulations for the site. All work submitted by the Contractor may be subject to the review and approval of EPA and/or the appropriate State regulatory agency. Therefore, it is the responsibility of the Contractor to contact the appropriate regulatory agency(s) to determine the requirements for each project. The Contractor will be responsible for writing and submitting reports to regulatory agencies as directed by the COR. It is the Contractor's responsibility to find out from the regulatory agency(s) which guidance materials are current and applicable.
D. The Contractor shall obtain and/or prepare permits, licenses, or other documents necessary to accomplish the prescribed work (see Clause 52.236-7). Costs shall be considered incidental to work items shown in the Schedule.

C.5 Information about the Site
A. The Contractor shall take all precautions to maintain the work site at all times, in a condition that will prevent damage or injury to person or property, both Government, or otherwise. The Contractor shall protect all personnel, whether government or civilian, from all safety hazards on job sites during progress of work on this contract. All worksites shall be kept free of litter or other debris, and upon completion of work each day, all residual materials shall be cleaned.

B. Grays Harbor PUD (GHPUD) shall pull the existing meter and deenergize service feeder line prior to construction. After installation of flush toilet, GHPUD shall install new electrical meter and reenergize service feeder line.
1. Contractor is solely responsible for coordination with GHPUD throughout the project, including submission of applicable permits and electrical load calculations.
2. Contractor is solely responsible for payment of all permits and fees to the local utility companies.
There will be a Pre-Bid Tour for the project. Pre-Bid Tour will be on site Tuesday July 19th 11am PDT Prospective quoters are encouraged to tour the site prior to quoting.
With their quote, the Contractor acknowledges that they have taken the necessary steps to ascertain the nature and location of work and have investigated and satisfied themselves as to the general and local conditions that can affect the work or its cost. Any failure of the contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from the responsibility of estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expenses to the Government.

C.7 BioBased Products
The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition Regulation to provide biobased products.
The Contractor shall utilize products and material made from biobased materials (e.g., insulating foam, composite panels, and concrete and asphalt release fluids) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer.
The following is an example list of products that may be used in this contract for minor construction for which biobased products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

Biobased products that are designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content and source of biobased material
In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the Contractor is encouraged to use other commercially available biobased products.
The awarded Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. The Contractor shall list volume to be used and total cost for each individual product. This information will be used for reporting purposes.
The Contractor shall comply with the provision at FAR 52.223-1, Biobased Product Certification.

A. The indications of physical conditions on the drawings and in the specifications are the result of site investigations by observations and measurements.
Utilities
This work will be performed at the trailhead. The restroom, water, and electricity will be available from the comfort station up until demo. After that stage, the nearest restroom on site is about a mile away.
H.2 OTHER REQUIREMENTS
Conformity with Drawings and Specifications
Unless working tolerances are specified, all work performed and materials furnished shall be in reasonably close conformity with lines, grades, cross sections, dimensions, and material requirements shown on the drawings, indicated in the specifications, or designated on the ground. “Reasonably close conformity” is compliance with reasonable and customary manufacturing and construction tolerance.
A. Definition. "Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.
B. The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.
C. Government inspections and tests are for the sole benefit of the Government and do not--
1. Relieve the Contractor of responsibility for providing adequate quality control measures.

2. Relieve the Contractor of responsibility for damage to or loss of the material before acceptance.
3. Constitute or imply acceptance; or
4. Affect the continuing rights of the Government after acceptance of the completed work under paragraph (I) below.
D. The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.
E. The Contractor shall promptly furnish, without additional charge, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary.
The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.
F. The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.
G. If the Contractor does not promptly replace or correct rejected work, the Government may
(1) by contract or otherwise, replace or correct the work and charge the cost to the Contractor or
(2) terminate for default the Contractor's right to proceed.
H. If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction.
However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.
I. Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

Warning Signs and Restrictions
Contractor shall be totally responsible for safety signing, barricades and other signing to maintain a safe site to the public and Government employees. The site may be open to the public during construction. Forest Service will issue a closure order to the public, as needed. The Contractor will be responsible for singing and limiting public access.
Job Specific Safety Plan
A. Worker Safety - The Contractor shall perform all operations in a prudent, conscientious, safe and professional manner. Provide a plan, that demonstrates the following:
1. The contractor shall comply with OSHA and take necessary precautions to protect the life and health of all persons employed on the project. The contractor shall be familiar with the latest accepted accident prevention methods and shall provide necessary safety devices and safeguards accordingly.
2. At a minimum, the Contractor’s personnel and equipment shall comply with applicable Federal, state, and local laws, safety and health regulations and procedures, as well as Forest Service regulations, rules and procedures.
3. Fire Protection and Prevention: Contractor shall provide as many stored pressure fire extinguishers as are necessary to ensure that no more than 75 feet exists between a fire extinguisher at any point within containments areas; and in no case shall there be less than two fire extinguishers on site.
B. Spill Prevention and Response
1. The Contractor is solely responsible for all spills or leaks and subsequent clean up that may be required during the performance of this contract, which occur or are contributed to by the actions of its agents, employees, or subcontractors. The Contractor agrees to clean up such spills or leaks to the satisfaction of the Forest Service and in a manner that complies with applicable Federal, state, and local laws and regulations. The clean-up shall be at no cost to the Forest Service. The contractor shall provide spill response materials including, but not limited to, containers, shovels, and personal protective equipment. Spill response materials shall be always available to onsite personnel, in which hazardous materials and hazardous wastes are being handled or transported.
Spill response materials shall be compatible with the type of material being handled or transported.
2. The contractor shall report all such spills or leaks, regardless of their quantity, to the Forest Service immediately upon discovery. A written follow-up report shall be submitted to the Forest Service no later than 24 hours after the initial telephonic report. The written report shall be in narrative form and as a minimum include the following:
a. Description of the item spilled (identity, quantity, manifest no., etc.).
b. Whether amount spilled is EPA/state reportable, and if so whether it was reported, and to whom.
c. Exact time and location of spill including a description of the area involved.
d. Containment procedures initiated.
e. Summary of any communications contractor has with press, Federal, State and local regulatory agencies and officials, or Forest Service officials.

f. Upon completion of the clean-up activities for contractor caused spills and releases, the contractor shall submit a final clean-up certification report to the Forest Service. The report shall include a description of clean-up procedures employed at the site, the final disposition and disposal location of spill residue.
Include also copies of all spill related cleanup and closure documentation and correspondence from the regulatory agencies.
C. Security and Pedestrian Safety
1. No work that endangers, interferes, or conflicts with traffic or access to work sites shall be performed until a plan for satisfactory warning and handling of traffic and public has been submitted by the contractor and approved by the COR. Plan must be in accordance with requirements of the MUTCD. Contractor shall not be paid directly for this item, rather it will be considered incidental to other items of work listed in the Schedule of Items.
2. Contractor shall submit a Plan for approval. The plan shall consist of, at a minimum, construction zone perimeter, locations of signs, barriers, and construction fencing, egress routes, parking areas that will be occupied during demolition, and stockpile areas. Provide plan for adequate protection against accidental trespassing, and plan for site security after work hours.
a. The Contractor shall restrict access to the immediate area where removals are taking place using barrier tape and/or construction barriers. Caution signs shall be posted as needed. Provide temporary barricades and other protection required to prevent injury to people and damage to adjacent buildings and facilities to remain.
b. Security for the Contractor's equipment and supplies shall be the sole responsibility of the Contractor.
c. Camping will be not permitted within the construction area.
Safety Items
(a) Data and information furnished or referred to below is for the Contractor’s information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor. This list shall not be deemed to be all inclusive. The Contractor shall bear the sole responsibility for taking all appropriate actions necessary to prevent accidents and injuries to individuals at the work site.
(b) The following checked activities have been identified by the Government as potential safety hazards.
[] Confined Entry Space.
[] Temporary excavation/deep trenching/slope stability.
[] Tree Felling.
[] Fall hazard from work heights exceeding six feet.
[] Blasting.
[] Traffic control on high-volume and/or high-speed and/or limited visibility roads.
[x] Heavy equipment operation.
[] Tree climbing and/or tower climbing.

[] Fire hazards.
[] Hazard materials handling.
[] Electrical hazard.
[] Hydraulic and/or pneumatic and/or other high pressure hazards.
[x] Mechanical hazards such as pulleys, springs, etc.
[X] Power tool operation including eye protection.
[X] Overhead hazards.
[X] COVID - 19
Storage of Materials and Equipment
Materials shall be stored to assure the preservation of their quality and fitness for work.
Approved areas on the Forest Service administrative site may be used for storage purposes, except demolished materials may not be stored on Forest Service land. All storage sites approved by the Government shall be restored to a satisfactory condition at the Contractor's expense.
Product Substitution, Shop Drawings and Material Certification
A. Product Substitution. Any modification of other items, designs, materials, products or equipment (including Government-Furnished Property), made necessary because of a substitution, will be the responsibility of the Contractor without adjustment in contract price or time. The Contracting Officer’s approval of any substitute will not affect the Contractor’s responsibility for such modification. All substitutions shall be requested by the Contractor after award of the contract has been made. No approvals will be made prior to award.
Hazardous Materials
Contractor shall notify the Government of any hazardous materials and or waste (as defined in 29 CFR 1910.1200) to be used on the job and will have Material Safety Data Sheets (MSDSs) for those materials available on the job. All such materials shall be labeled in accordance with Federal and State regulations.
Emergency Control
(a) Immediately extinguish without expense to the Government all fires on or in the vicinity of the project which are caused by the Contractor's employees, whether set directly or indirectly as a result of construction operations, with or without direction by the Forest Service. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government resulting from fires set or caused by Contractor's employees or resulting from construction operations.

(b) Contractor's Responsibility for Controlling Other Emergencies - When requested by the Contracting Officer, allow the Forest Service to temporarily use employees and equipment for emergency control work.
Payment will be made at not less than the current area rate established by the Forest Service.
(c) Fire fighting equipment will be required during the fire season from May 10 to August 31, and during any other period of fire danger designated by the Contracting Officer.
Furnish rust-free fire tools to equip all workers employed in Contractor's operations at each separate work site. Maintain tools in serviceable condition and keep tools in one or more weather-tight fire tools boxes. Paint fire tools boxes red, mark "tools for Fire Only" with letters at least 3” high, and keep sealed. Post a list of the contents inside each fire tool box so as to be visible when opened.
Equip each internal combustion engine with a spark arrester qualified and rated USDA-Forest Service, Standard 5100-1, unless it is:
(a) Equipped with a turbine-driven exhaust supercharger such as the turbocharger. There shall be no exhaust bypass.
(b) A multi-position engine, such as on a chain saw, which is equipped with screen arrester, as described in the Forest Service Spark Arrester guide.
A spark arrester, which does not meet the requirements in this guide may be approved upon submission of acceptable proof that the arrester is at least 80 percent efficient in retention, attrition, or destruction of carbon particles. Such arrester may be required to meet higher standards as improvements in design and efficiency are discovered.
(c) A passenger-carrying vehicle or light truck intended primarily for use on roads, and equipped with a factory designed muffler and exhaust system.
(d) A heavy duty truck, such as a dump or log truck, or other vehicle used for commercial hauling, used only on roads and equipped with a factory designed muffler and with a vertical stack exhaust system extending above the cab.

Properly install and constantly maintain in serviceable condition all exhaust equipment described in this Subsection, including spark arresters and mufflers.
Equip each unit of mobile or stationary power equipment, including trucks, with one shovel, and at least one fire extinguisher meeting one of the following specifications:
1. 2-1/2 pound size or larger dry chemical type.
2. 4 pound size or larger carbon dioxide type.
Test or check each extinguisher for proper functioning prior to the beginning of fire precautionary period.
Provide each gasoline power saw with one chemical-pressurized fire extinguisher of not less than 8 ounce capacity by weight. Maintain the extinguisher in good working order at all times.
Do not burn camp refuse, brush, slash, or debris such as that resulting from clearing around camps or on rights-of-way, without the written approval of the Contracting Officer. Submit written requests for burning to the Contracting Officer at least 48 hours in advance of intended burning. The Contracting Officer will approve routine camp refuse disposal incineration in the camp development proposal.
Disposal of Material
Debris encountered in the construction (metals, etc.) and other waste materials generated in the construction (cartons, scrap, etc.) shall be removed and disposed of in a State or City approved site off of National Forest Service Land, unless other disposal means are authorized in the plans or specifications.
KEY PERSONNEL
(a) The Contractor shall assign to this contract the following key personnel:
(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.
INSURANCE COVERAGE
Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:
(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.
(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence. (2) The Contractor shall have property damage liability insurance shall be required in the amount of ____*___ per occurrence.
(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.
(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
