About this file

This document is a memorandum from the Office of the Attorney General of Arizona, specifically from Cindy Palmer, the Chief Procurement Officer, dated September 18, 2023. The memo concerns a procurement file (AG24-0019) for the Arizona Attorney General's Office (AGO) and involves Counter Tools, a software provider for the Tobacco Enforcement Monitoring Software System (TES).

The memorandum details the AGO's intent to negotiate a contract with Counter Tools for maintaining and updating their existing Tobacco Enforcement Monitoring Software System, which was originally awarded through an RFP on May 5, 2014, and first implemented in August 2014. The AGO has determined that continuing with the current software is more cost-effective than replacing it, citing that the software works well and maintaining it will save the state time, effort, and money. The procurement is being conducted under A.R.S. § 41-2537, which allows for negotiation of a contract without competitive quoting when it is deemed not practicable and advantageous to the state.

OFFICE OF ATTORNEY GENERAL KRIS MAYES

OPERATIONS DIVISION/PROCUREMENT SECTION

MEMORANDUM

TO: Procurement File: AG24-0019

FROM: Cindy Palmer, Chief Procurement Officer

DATE: September 18, 2023

RE: Competition Not Practicable in Accordance with A.R.S. § 41-2537

The Office of the Attorney General (AGO) issued an RFP for a Tobacco Enforcement Monitoring Software System (TES) on May 5, 2014. The award was made to Counter Tools August 18, 2014. The AGO is satisfied with the software and continues to use it.

It would be advantageous to the State, the Office of the Attorney General to negotiate a contract with Counter Tools to maintain and update the software. The software continues to work well and it is much cheaper to maintain the software than to replace it. This should save the State time, effort and money and also result in a more favorable outcome for the State.

This procurement is determined not practicable to quote per A.R.S. § 41-2537. A contract advantageous to the AGO and the State of Arizona shall be negotiated with Counter Tools.

This is in accordance with A.R.S. § 41-2537.

Cindy Palmer Chief Procurement Officer
