2.6. Compliance with Build America/Buy America Act
Bidder shall comply with the requirements of the Build America, Buy America (BABA) Act (41 U.S.C.
8301) and all applicable rules and notices, as may be amended, as applicable.
All Bidders are responsible for:
A. Complying with the Build America, Buy America Act (“BABA”), Pub. L. No. 117-58, div. G, tit. IX, subtit. A, 135 Stat. 429, 1298 (2021) and the requirements of 23 U.S.C. § 313 (“Buy America”) as may be amended.
B. Federal funds may not be obligated for an FHWA-funded infrastructure project unless it meets the requirements of § 70914 of BABA, which requires adherence to the following Buy America preference:
• All iron and steel used in the project are produced in the United States. This means all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States;
• For projects obligated on or after October 1, 2025, final assembly of all manufactured products must occur in the United States. For projects obligated on or after October 1, 2026, in addition to the final assembly requirement, the cost of components of products that are mined, produced, or manufactured in the United States must be greater than 55 percent of the total cost of all components of the manufactured product. All manufactured products used in the project are produced in the United States. This means the manufactured product was manufactured in the United States, and the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States is greater than 55 percent of the total cost of all components of the manufactured product unless another standard for determining the minimum amount of domestic content of the manufactured product has been established under applicable law or regulation; and
• All construction materials are produced in the United States. This means that all manufacturing processes for the construction material occurred in the United States. This subpart
B(3) shall only apply upon expiration of the temporary public interest waiver of Buy America
Requirements for Construction Materials issued by the U.S. Department of Transportation.
C. This Buy America preference is required for an FHWA- funded infrastructure project unless an appropriate waiver for a particular product has been granted by FHWA or the product is otherwise subject to a general waiver. General waivers are listed in 23 U.S.C. § 313(b). These requirements extend to Subcontractors and Suppliers at all tiers and shall be included in all subcontracts.
D. The Build America, Buy America Certificate must be completed by the Bidder and submitted with the Bid.
E. If the Bidder fails to satisfy the requirements of BABA and Buy America, the Bidder will not be awarded the Contract.
F. For purposes of compliance with this Section, terms shall be read as defined in and/or consistent with BABA and Buy America, including applicable regulations. Additionally, “construction materials” includes an article, material, or supply—other than an item of primarily iron or steel; a manufactured product; cement and cementitious materials; aggregates such as stone, sand, or gravel; or aggregate binding agents or additives—that is or consists primarily of: non-ferrous metals; plastic and polymer- based products (including polyvinylchloride, composite building materials, and polymers used in fiber optic cables); glass (including optic glass); lumber; or drywall.
3.2. 3. Selection Criteria
The City of Pittsburgh DOMI will establish a final ranking of the responding bidders for the purpose of negotiating an agreement based on the DOMI's evaluation of the responses to the procurement document. At DOMI’s sole discretion an optional interview with up to 3 top ranked bidders may be requested. If DOMI requests an interview, the interview will be in-person and will include a 15-minute hands-on demonstration of the proposed system, a 15-minute presentation from the bidder of how the system meets the City’s requirements, and a 30-minute question and answer period.
The following factors, listed in Table 1, will be considered by the City of Pittsburgh DOMI during the evaluation of the responses.

3.3. 4. Qualifications
The ability for the proposed Multimodal Detection System to satisfy the City of Pittsburgh DOMI’s qualification criteria is a key component of bidder selection. The Qualification Criteria is segmented into four categories:
• Section 4.1 System Requirements - Detailed Responses
• Section 4.2 System Requirements - Simple Responses
• Section 4.3 Open Question and Answer
• Section 4.4 References and Past Implementation
4.1 System Requirements - Detailed Responses
For each System Requirement identify either Yes, No, or N/A (Not Applicable) if the proposed system satisfies the requirement (Appendix B1). Provide a detailed response to the follow up question under the
Detailed Response column for each listed Requirement. Score will be based on the number of acceptable answers and satisfaction of requirement over the applicable number of System Requirements in Appendix
B1. For example, 15 acceptable answers and satisfied requirements versus 19 possible system requirements equals a score of 0.79 (15/19) for this criterion. The criteria score will be multiplied by the weight identified in Table 1.
4.2 System Requirements - Simple Responses
For each System Requirement identify either Yes, No, or N/A (Not Applicable) if the proposed system satisfies the requirement (Appendix B2). Score based on the number of satisfied requirements over the number of applicable System Requirements in Appendix B2. For example, 40 satisfied requirements over
57 possible system requirements equals a score of 0.70 (40/57) for this category. The category score will be multiplied by the weight identified in Table 1.
4.3 Open Question and Answer
The City of Pittsburgh DOMI is seeking answers to the additional open questions (Appendix B3). In the response, note if requested services in the open questions are part of the base package or are an additional cost.
The Open Answer should clearly state if the feature requires an additional cost and if an additional cost, please include in the applicable price/cost tables (Appendix C) and note them as “Optional” in the bidder pricing forms. Optional Costs will not be included in the price evaluation. DOMI reserves the right, at its sole discretion, to use or not use optional items and associated costs during the procurement of equipment. The bidder shall provide a system that fully meets the System Requirements, regardless of whether optional items are selected.
Each question is worth 20 points (maximum of 140 points). City of Pittsburgh DOMI will score each question and total the score. The total score will be divided by the maximum of 140. For example, a score of 92 will receive a 0.66 (92/140) for this category. The category score will be multiplied by the weight identified in Table 1.
4.4 References and Past Implementation
The City of Pittsburgh DOMI is requesting up to five references and locations where the bidder’s system is (was) operating under similar applications (Appendix A). Complete Appendix B4 with all applicable references. Each confirmed positive recommendation is worth 2 points (max of 10 points for 5 max possible references). The bidder score will be divided by the max total of 10. For example, a score of 6 will receive a 0.60 (6/10) for this category. The category score will be multiplied by the weight identified in
Table 1.
3.4. 5. Price
The current and future cost of the proposed Multimodal Detection System is a key component to bidder selection. The Price Criteria is segmented into three categories:
• Phase 1 Components and Price - 2027
• Phase 1 Components and Price - 2032
• Yearly (Subscription) Pricing
Refer to Section 3 SELECTION CRITERIA for breakdown on the Price Criteria’s overall weight in the procurement selection.
The initial purchase order will be for the procurement of the Phase 1 intersections (estimated construction let date of Mid 2027) along Second Avenue, Forbes Avenue, and Fifth Avenue under the
SmartPGH Project. Under this proposal, the bidder shall provide a fixed total Phase 1 cost for the purchase of the system for these 25 intersections.
The City of Pittsburgh DOMI intends to continue to utilize the subject procurement to purchase and install the selected Multimodal Detection System for additional phases of construction for the SmartPGH project as well as other locations within the City of Pittsburgh. With the possibility of future purchases, the City of Pittsburgh DOMI is weighing in the cost for future purchases and yearly subscription prices (if applicable) beyond the first five years within the price criteria. The first five years of subscriptions shall be built into initial purchase price and Appendix C1 and C2. The Optional Costs for components or functionality including Appendix B3 will not be included in the price evaluation.
City of Pittsburgh DOMI will utilize an adjusted intersection average, or trimmed-mean approach, to compare bid pricing. This methodology removes the two highest-cost intersections and the two lowest-cost intersections from each bidder’s proposed deployment and averages the costs of the remaining intersections to establish an adjusted intersection average. The approach accounts for the likelihood that bidders may recommend deployment at different numbers of intersections, as some proposals may identify “No” in response to the question, “Do you recommend deploying your system at this intersection?” and therefore not include costs for all 25 intersections. By excluding the highest- and lowest-cost intersections, the adjusted average also helps minimize the influence of unusually complex or atypical locations that may result in higher costs or that some bidders may be unable to accommodate, creating a more equitable basis for comparing proposals.
The Yearly (Subscription) Price is the cost DOMI will have to pay after the five-years of service included with the initial purchase. For the Phase 1 Components and Price – 2027, the evaluation factors in the sum of subscription cost for the 25 intersections for years 2032-2037. For Phase 1 Components and Price –
2032, the evaluation factors in the sum of subscription cost for the 25 intersections for years 2037-2042.
The Price Evaluation will utilize the weights identified in Table 1 and the point system is determined by the following Weighted Sum Formula:
Weighted Sum = 0.25 x (2027 Cost) + 0.15 x (2032 Cost) + 0.6 x (25 Intersection Subscription Sum Cost for Years 2032 to 2042)
Once each bid’s Weighted Sum is calculated, the lowest Weighted Sum will receive a score of 1.00 for the entire Price Criteria section; subsequent bidders will receive a percentage of a point based on the percent difference relative to the lowest Weighted Sum bid. For example, if the lowest Weighted Sum is $500,000 and a subsequent bid is $650,000, the lowest Weighted Sum bidder would receive 1.00 for the entire Price
Criteria and the subsequent bidder would receive a 0.77 score for the entire Price Criteria.
5.1 Phase 1 – Multimodal Detection System Component and Price (2027 and 2032)
The bidder shall complete Appendix C1, Phase 1 Components and Price – 2027, as this is a criterion for selection. Complete Appendix C1 for the fixed cost for Phase 1 purchase. If the bidder is selected this will be the cost to the city for the purchase, delivery, and support of the Multimodal Detection System for the
Phase 1 intersections. Do not include costs for intersections if the bidder deemed that the Multimodal
Detection System is not viable. The bidder shall provide the number of each component and price/unit of install component at each intersection. The bidder shall also include the intersection cost based on the number of components and unit cost. The bidder shall also provide the Installation and Maintenance
Training for Phase 1 and Subscription (yearly fee) paid over a five-year lump sum for the intersections.
Lastly, the bidder shall sum up the total number quantity required for each component and provide the complete total price for all intersections, training, and subscriptions for Phase 1. All items not included in
Appendix C1 shall be deemed incidental to the installation and will be at no cost to the City of Pittsburgh
DOMI. If there are more components than space provided, complete additional tables as needed. List all of the necessary components for a complete Multimodal Detection System and unit of measurement for the Phase 1 intersections. Include a separate cost of training for installation of the equipment for the contractor and any other systemwide costs for the Phase 1 intersections. Provide all applicable items necessary to satisfy the system requirements and complete the installation of the Multimodal Detection
System including 60 months of any subscriptions or software fees.
To aid the City of Pittsburgh DOMI in developing an estimate for future costs for the purchase of subsequent deployments of the multimodal detection system, complete Appendix C2 based on the 2032 prices listed in Appendix C4. If there are more components than space provided, complete additional tables as needed. Appendix C2 is only for comparison only and to allow City of Pittsburgh DOMI understands a possible future cost of the system based on a specific example. This is a criterion for selection but does not set Phase 1 cost like Appendix C1.
The selected bidder shall provide design insight for all installations. Appendix D are the 90% design plans for the 25 Phase 1 intersections. The bidder may use any of the existing or proposed signal equipment poles shown on the plans to help achieve a successful installation. The bidder shall not add additional signal supports or utilize supports/locations not owned by the City of Pittsburgh.
Refer to the provided google maps file (Appendix E) to review any overhead constraints such as utilities, buildings, trees, or overpasses for any of the 25 Phase 1 intersections (Identified by SmartPGH Intersection
Number). The bidder shall not require adjustment of overhead utilities or require special action of the utility for installation. Selective tree-trimming of branches that overhang into the public right-of-way can be assumed.
The bidder is able to reduce the number of initial intersections for rollout of Phase 1 Multimodal Detection
System if they deem that the intersection would not be a good candidate for the proposed Multimodal
Detection System. The bidder should identify in Appendix C1 and C2 whether they wish to exclude their system from any of the Phase 1 intersections. Refer to Table 2 for a completed sample intersection tabulation for Appendix C1 and C2.

All prices quoted shall be in accordance with PennDOT Publication 408 Version 2026 Current Edition and payment identified in Section 5.4 Payment Milestones. Installation will be completed by others; however, the selected bidder shall provide support and training during installation of the detection system to the general contractor installer and City of Pittsburgh city forces. Training shall include covering information in regard to the deployment, maintenance, integration, and adjustment of the system over the life of the detection system for the Phase 1 intersections.
It is expected that all installations shall meet the system requirements in Attachment B while maintaining detection accuracy for the intersection listed in Section 6. SYSTEM TESTING AND ACCURACY EVALUATION.
Submissions with less than 18 recommended intersections of deployment may be disqualified due to the lack meeting City of Pittsburgh DOMI’s Multimodal Detection System implementation goals.
5.2 Yearly (Subscription) Pricing
As part of the initial purchase order, City of Pittsburgh DOMI will purchase 5 years of yearly subscription fees as a lump sum (total of the 5 years of fees) to be included in Appendices C1 and C2. At the end of the fifth year, the City of Pittsburgh DOMI will have the option to purchase additional years at the rates in
Appendix C3, every year until December 31, 2042.
For evaluation purposes, the subscription costs up to December 31, 2042, will be included in the price evaluation. Subscription costs for years 2027 through 2031 will not be included in the subscription portion of the price evaluation because those costs are included in the initial Phase 1 procurement in 2027
(Appendix C1). Respondents should enter the single-intersection subscription cost in Appendix C1. For evaluation purposes, Pittsburgh will multiply the submitted cost by the applicable number of intersections to determine the total evaluated subscription cost.
This cost does not include the incidental 60-month warranty highlighted in PennDOT Publication 408 2026
Section 950.3(j) or the additional warranty coverage highlighted in Section 5.5 Warranty Modification. A
60-month warranty of all components shall be built into in the purchase price.
If there are more than one yearly fee, complete additional tables as needed.
Utilize the table specifically for “Optional Subscription Only” in Appendix C3 to list the prices for all optional components identified in Section 4.3 Open Question and Answer. These will not be included in the price evaluation.
5.3 Pricing Schedule
The bidder shall complete Appendix C4 by identifying all necessary services and equipment for a fully functional multimodal detection system required by this procurement document. A 60-month warranty of all components shall be built into in the purchase price for a fully functional system meeting the requirements in Appendix B1 or B2. The bidder shall list all items with cost and incidentals (no cost) in
Appendix C4. Any services or equipment not identified under Appendix C4 shall be considered incidental and will be at no cost to the City of Pittsburgh DOMI. If there are more components than space provided, complete additional tables as needed. Provide all applicable items necessary to satisfy the system requirements for a complete installation, setup, and integration of the Multimodal Detection System.
Provide all equipment necessary for full installation, i.e. sensor, cable, mounting bracket, etc. Price should include services to support either installation by City Forces or Contractors, procured under a separate contract, for a successful implementation and integration of the Multimodal Detection System. List all of the necessary components for the complete setup of the Multimodal Detection System and unit of measurement. All cable or cord components shall be listed as a unit cost per foot. Utilize the table specifically for “Optional Components Only” in Appendix C4 to list the prices for all optional components identified in Section 4.3 Open Question and Answer.
Price Schedule, Appendix C4, does not directly contribute to the evaluation and selection of bidder, but provides locked in rates and lists anticipated equipment for current and future deployments of the
Multimodal Detection System. Appendix C4 indirectly contributes to the selection of bidder since those items/cost are linked to the specific items needs for Appendix C1 and C2.
The bidder shall also provide fixed cost(s) in Appendix C4 for all components for years 2027 through 2032 for future purchases. These cost(s) are binding yearly prices for services and equipment purchased during the identified calendar year. The selected bidder shall provide the prices listed in Appendix C4 for future purchasing within the City of Pittsburgh through the year 2032. The City of Pittsburgh DOMI does not guarantee any subsequent purchases after the Phase 1 purchase.
The bidder shall provide the identified components up to December 31st, 2032. If an item is discontinued, the selected bidder shall honor the upgraded component at the cost of the superseded component. The selected bidder may opt out of the procurement agreement at any time after the completion of Phase 1 Accuracy
Evaluation upon 90 days written notice.
The installation and maintenance of the proposed Multimodal Detection System will be completed by others (City of Pittsburgh city forces and general contractors). It is critical that the selected bidder is available to provide on-site support to provide instruction and training for both installation and maintenance. Initial Pittsburgh and general contractor training is included under the Phase 1 purchase, identify this cost in Appendix C4. The need for future training is unknown, please include a line item and cost for 3-day training for years 2027-2032 in Appendix C4.
The 3-day Training shall be provided on site and shall include all necessary information for the contractor and City staff related to the installation, configuration, and integration of the detection system. Training shall be recorded (led by the bidder) as applicable so this material can be provided for new staff. The cost shall also include any required digital or hard-copy training manuals and presentation materials and equipment / data storage of recordings.
Any costs associated with subscription (yearly fees) shall be entered into Appendix C3. These values will be used to calculate the 60 months pre-paid and should be included in the initial purchase price for future purchases.
Design insight troubleshooting shall be incidental to the cost of the equipment. Cost for software updates, patches, and upgrades for the detection system for up to 5 years is incidental to the equipment cost. The purchase price for the City of Pittsburgh DOMI will be the price listed in Appendix C4 for the calendar year within which the equipment is purchased. There will be no minimum or maximum requirements for purchases after Phase 1 for the City of Pittsburgh DOMI, there may be individual purchases for a single intersection, replacement parts for a current deployment due to damage, or entire corridors of signals.
5.4 Payment Milestones

The warranty shall begin upon the acceptance of the 30-day test. The approval of the system verification and accuracy evaluation assumes the Multimodal Detection System shall continue to satisfy the verification and accuracy evaluation for future purchases of additional Multimodal Detection Systems.
This additional warranty requirement shall be 60 months in length for each system purchased by City of
Pittsburgh DOMI through December 31st, 2032.
3.5. 6. System Testing and Accuracy Evaluation
The accuracy evaluation will occur upon deployment and will verify the success of the Multimodal
Detection System for the Phase 1 purchase order/deployment. The University of Pittsburgh will perform the detection accuracy evaluation for the City of Pittsburgh DOMI.
6.1 Detection Accuracy Expectations
Detection and dropping of multimodal objects shall be instantaneous. A successful detection system should have a high detection system accuracy and low false detections. Per the System Requirements, the
City of Pittsburgh DOMI is allowing the technology to utilize two different sets of conditions. Modes of traffic may be detected utilizing detection zones or detected with object identification/tracking once in the system’s field of view or influence area within the field of view.
Detection Zones
The system shall detect at least the required percentage (Table 3) of objects entering the detection zone and hold detection at least the required percentage (Table 3) of objects while inside the detection zone, regardless of movement, and the system shall drop (un-detect) at least the required percentage (Table 3) of objects as they exit the zone. The percentage calculated is based on the number of multimodal objects that enter/stay/exit the detection zone prior to when the proceeding phase initiate its clearance intervals.
In addition, the unserved percentage of objects by the traffic signal shall be below the required percentage
(Table 3).
Object Identification/Tracking
The system shall detect up to the required percentage within the influence area within the field of view
(Table 3) of objects approaching the desired signal phase, the system shall hold detection at least the required percentage (Table 3) of objects while queued for the desired signal phase, regardless of movement, and the system shall drop (un-detect) at least the required percentage (Table 3) of objects no longer queued for the desired signal phase. The percentage calculated is based on the number of multimodal objects that enter/queue/exit the intersection zone the detection zone prior to when the proceeding phase initiate its clearance intervals. In addition, the unserved percentage of objects by the traffic signal shall be below the required percentage (Table 3).
6.2 System Testing and Detection Accuracy Evaluation
The accuracy of the evaluation will only consider the users that enter the designed detection zones and not users that bypass the designed detection zones unless the detection system operates based directly upon object identification rather than using detection zones. However, the City of Pittsburgh DOMI has the right to adjust the design of the detection zone to capture the intended road users. It is expected that the detection zone(s) may vary in size and location within the bounds of view identified by the system requirements. The selected bidder is permitted to provide insight to the size, location, and number of detection zones or direct use of objects rather than detection zones; however, it is expected that the detection system will need to capture all modes of traffic as long as they are within the required field of vision, highlighted in the system requirements.
Test Locations
The City of Pittsburgh DOMI has identified the five intersections to be tested along Second Avenue within the phased deployment. The intersections were selected based on intersection geometric profile as well as pedestrian activity. The intersections were selected to provide a variety of test scenarios. If an intersection is not equipped with a Multimodal Detection System, then the City of Pittsburgh DOMI has the right to select a replacement test intersection at a later date. The test locations are the following intersections:
• Second Avenue and Manor St Garage
• Second Avenue and 10th Street Bridge/Armstrong Tunnel
• Second Avenue and Hazelwood Ave
• Forbes Avenue and Halket St
• Forbes Avenue and Oakland Ave
Test Duration
• Each intersection will be evaluated based on 12 hours of daytime and 4 hours of nighttime during typical conditions which may include low light or cloudy conditions.
• Typical conditions consist of no or light precipitation, fog, or high wind conditions (excess of 20 mph gusts).
• The accuracy threshold is the total summation of the 16 hours of evaluation.
• The evaluation shall conclude within 90 days after initiation.
Test Thresholds
The detection system must satisfy each scenario’s percentage laid out included in Table 3 for the entire intersection (all detection zones).
City of Pittsburgh DOMI will utilize MaxTime IC logic to remove the locking nature of pedestrian calls from the Multimodal Detection System. The bidder shall assume the controller has the ability to process pedestrian calls as non-locking (push buttons will utilize latching to constantly place a pedestrian request via the push buttons/accessible pedestrian signal). An object arriving at or after when the proceeding phase initiate its clearance intervals will have the entire cycle to be considered a served object.
The University of Pittsburgh will use the radar, Lidar, or video imagery of the Multimodal Detection System as well as the system’s Automated Traffic Signal Performance Metrics (ATSPMs) to complete the evaluation

* For purposes of evaluation, Bicycle / Bike (+) is defined as a person traveling on a bicycle, e-bicycle, or scooter. This classification includes both motorized and non-motorized devices that generally exhibit bicycle-like travel characteristics. For purposes of evaluation, Pedestrian is defined as a person traveling through the intersection on foot or using a stroller or wheelchair, whether motorized or manual. A person walking or otherwise not riding a bicycle, scooter, or similar micromobility device shall be classified as a pedestrian. Refer to Appendix B for additional requirements regarding mode and micromobility classification and identification.
A successful Multimodal Detection System Evaluation is when all five intersections meet the thresholds identified in (Table 3). It will be the responsibility of the selected bidder to notify the City of Pittsburgh
DOMI that the evaluation may begin but must be requested with 120 days of completion of the 30-day test. During the 90-day test, preliminary results will be made available to the selected bidder with 30 days after initiation. The vendor will have 15 days to cure, or improve operations, based on the preliminary findings. The University of Pittsburgh will complete the final evaluation within the remaining 45 days. City of Pittsburgh DOMI will provide results to the selected bidder and provide a written notice of acceptance or failure. Upon approval, City of Pittsburgh DOMI will provide written acceptance letter of the procured
Multimodal Detection System.
