Contracting Activity: OL:H/PZIMB

Project/Program Name: Thermo Fisher ICS 5000

Purchase Request/Identification Number:

Estimated Contract Cost (including Options):

Section B: Description of the Supplies/Services Required

The 309 Maintenance Support Group (309 MXSG) has a requirement for a Unity Essential Support Plan to perform full maintenance, calibration, repairs, preventative maintenance, and software updates on the Thermo Fisher ICS 5000 Ion Chromatograph System (ICS) Dionex Dual-Analysis Capillary/Analytical RFIC-EG Hybrid System, which includes the following:

Chromatograph Compartment S/N 11114525

Auxiliary Pump S/N Z0047723

Section C: Justification for Soliciting from a Single Source or Brand Name

Only Thermo Electron North American, LLC, has the knowledge, expertise, capability, parts, and data to perform the needed maintenance, calibration and repairs with the existing design in a successful and cost effective manner. They are the Original Equipment Manufacturer (OEM) for this instrumentation and hold all the patents and proprietary data rights to the software used to run the instrument and equipment. Repair and updates to the system must be completed by a technician from Thermo Electron North American, LLC. As the OEM, they regulate any recalls, hotfix repairs, and necessary updates to software, equipment and parts supply.

Email response on 5 Feb 2020 and telephone contact again on 18 May 2020, with Aubrey Mirree, Support Plan Sales Representative, for Thermo Electron North American, LLC, confirmed the company will not sell the proprietary data for the Thermo Fisher ICS 5000 to the Government or to other contractors.

Section D: Efforts to Obtain Competition

Previous support was provided through a combined contract in which Thermo Electron North America, LLC, was sub-contracted to provide the Unity Essential Support Plan. The Prime has become a bottleneck and the Group would like to go directly to the OEM, Thermo Electron North America, LLC, for this requirement as the sole source and owner of all patents and proprietary manufacturing data.

Market research was conducted via the Internet and phone outreach by the Program Manager. An effort to find additional sources through Internet searches was unsuccessful. The Program Manager received sole source letter from Thermo Electron North America, LLC, on 5 Feb 2020 via email letter. Then on 18 May 2020, the Program Manager telephoned Aubrey Miree, Support Plan Sales Representative, Thermo Electron North America, LLC, who again

Single Source Justification (Simplified Acquisition)

FOR OFFICIAL USE ONLY

March 2018 FOR OFFICIAL USE ONLY Page 2 of 2 confirmed the proprietary nature of the equipment prohibits any other vendors from performing maintenance, calibration, software changes, or parts replacement on the Thermo Fisher ICS 5000. Thermo Electron North American, LLC, is the only source capable of fulfilling the Government's requirement at this time. The vendor refuses to sell their data rights to the Government.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

At this time, only one source exists for Thermo Fisher ICS service and parts. Future market research shall continue to be conducted in order to locate additional sources of parts supply/repair, as they appear. However, barring any change in the policy of the vendor to allow outside service and repair or until another system is purchased, the equipment will continue to be utilized under this sole source requirement.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
