About this file

This is a Schedule C insurance requirements document for the State of Michigan's Non-Emergency Medical Transportation (NEMT) Broker for Medicaid Fee for Service (FFS) Beneficiaries contract (RFP 260000002254). The contractor must maintain comprehensive insurance coverage throughout the contract term at its sole expense, with minimum limits satisfied through primary liability, umbrella or excess liability, and self-insurance combinations. Insurance certificates must be submitted to DTMB-RiskManagement@michigan.gov within 10 business days of contract execution, with renewal certificates provided annually or as coverage dates require. All policies must be written by insurers with an A.M. Best rating of A- VII or higher unless otherwise approved, and the State of Michigan and its departments, divisions, agencies, and personnel must be named as additional insureds on a primary and non-contributory basis. The contractor is responsible for ensuring subcontractors maintain applicable insurance coverage, and written notice of any cancellations or non-renewals must be provided within 5 business days.

Required insurance coverage includes Commercial General Liability with minimum limits of $1,000,000 per occurrence and $2,000,000 general aggregate, Automobile Liability with $1,000,000 per accident minimum, Workers Compensation Insurance according to applicable state laws, and Employers Liability Insurance with minimum limits of $500,000 per accident and aggregate disease. Claims-made policies require maintenance of coverage for at least 3 years after contract expiration or termination and extended reporting coverage for 3 years if cancelled or not renewed. The contractor waives all rights against the State for damages covered by required insurance, and failure to maintain required coverage does not limit this waiver. Non-compliance notifications will be sent electronically through third-party service provider Origami Risk, and these insurance requirements do not waive, restrict, or limit either party's liabilities or indemnification obligations under the contract.
