About this file
This document is a Request for Proposal (RFP) issued by the Arizona Department of Agriculture (AZDA) for the management of Salt River horses. The procurement involves the State of Arizona, specifically the Arizona Department of Agriculture, in collaboration with the U.S. Forest Service. The RFP was developed following House Bill 2340, signed in 2016, which provided legal protections for the Salt River horse herd and mandated a collaborative management approach.
The contract seeks to secure one or more entities to provide short-term management of approximately 400 horses residing on 19,000 acres. Key responsibilities include conducting comprehensive herd health assessments, implementing an equine birth control program, monitoring and treating injured horses, removing deceased horses, developing emergency management plans, and providing supplemental feed and water. The contract is anticipated to be a zero-cost agreement, with all expenses borne by the successful contractor(s). The initial contract term is up to one year, with potential renewals not to exceed five years total. Evaluation criteria include submission completeness, respondent qualifications, emergency and horse management plans, and fiscal competence.

Background
On May 11, 2016, Governor Ducey signed H.B. 2340 (Laws 2016, 2nd Regular Session, Chapter 136), which amends Arizona Revised Statute (A.R.S) to add an article that protects the Salt River horse herd (SRHH). This newly added article (a) protects the horses from being harassed, shot, injured, killed, or slaughtered; (b) requires written authorization from the Arizona Department of Agriculture (AZDA) or the Maricopa County Sheriff’s Office (MCSO) before interacting with a horse from the herd; (c) clarifies that horses from the SRHH are not considered stray livestock under Arizona law; and (d) directs the AZDA to enter into an agreement with the U.S. Forest Service to implement this article or to address any issues relating to the SRHH. Section 2 of H.B. 2340 requires the AZDA and U.S. Forest Service to enter into an intergovernmental agreement pursuant to A.R.S. §11-952 for the law to become effective.
After H.B. 2340 was signed into law, the AZDA began holding meetings with the U.S. Forest Service to draft the intergovernmental agreement. In total, the AZDA held 45 meetings. This led to the agreement being signed by both parties on December 28, 2017, which is the effective date of H.B. 2340.
The agreement includes the following provisions:

· The collaborative process is intended to incorporate scientific and ecological principals into the management plan.
· Prior to the completion of the collaborative group’s management plan, the AZDA will secure one or more third parties to address issues related to the Salt River through their procurement laws. The responsibilities of the third party(ies) will include an equine birth control program, veterinary treatment for sick or injured horses, proper removal of dead horses, and reporting requirements.
· Upon completion of the collaborative group’s management plan, the AZDA will secure one or more third parties to implement the management plan through their procurement laws.
