About this file

This document is a State Procurement Office (SPO) Form 101 - Competition Impracticable Procurement Authorization for the Arizona Department of Agriculture (AZDA). The form involves the Salt River Wild Horse Management Group Inc. as the supplier, and was submitted by Douglas Marsh, Lab Director/CPO, with the purpose of establishing a temporary contract for the management of the Salt River Horse Herd (SRHH).

The contract is intended to continue providing care and management for the Salt River Horse Herd until a new contract can be awarded through an ongoing RFP solicitation process. The current contract (CTR044476) has reached its maximum renewal limit, and the previous RFP was canceled on May 23, 2025. The procurement is deemed competition impracticable due to the critical need to maintain horse care, with no state resources available to care for the horses without a contract. The temporary contract will remain in effect with all provisions of the expiring contract, with the only change being the new end date. The State Procurement Administrator authorized the request on July 22, 2025, with an approved expiration date of December 31, 2025.

Text11: The current contract (CTR044476 - Salt River Horse Management) has reached the end of its life and cannot be extended further. The Arizona Department of Agriculture conducted an RFP solicitation for creation of a new contract replacing this one. However, upon recommendations of the CPO and State Assistant AGs, the solicitation was canceled. The creation of the RFP began on Jan. 29, 2025. The RFP was published on Apr 18, 2025 and canceled on May 23, 2025.

Care and management of the Salt River Horse Herd must continue. Currently, the SRHH is surviving on hay and water provided by the non-profit contract holder. Without the continued provision of hay and water, the health of the SRHH would immediately be in danger. Further, this expiring contract provides for veterinary and other care necessary for the SRHH due to emergency circumstances. The State does not have the resources to care for the horses without the contract.

The proposal is to establish a new, temporary contract with the existing vendor listed above to continue providing for the SRHH until successful completion of the an RFP solicitation process establishes a new contract. This CI will end with the beginning of its replacement.

All provisions of the expiring contract, CTR044476, will remain in effect with the only change being the new contract end date.

Text12: On May 11, 2016, Governor Ducey signed H.B. 2340 (Laws 2016, 2nd Regular Session, Chapter 136), which amends Arizona Revised Statute (A.R.S) to add A.R.S. § 3-1491, that protects the Salt River horse herd. The Arizona Department of Agriculture was given authority to carry out the above regulations. Under Section F. (This state may enter into an agreement with a private entity to address any issue relating to the Salt river horse herd), AZDA performed a competitive RFP solicitation process, resulting in a contract with on May 24, 2018. That contract has been renewed the maximum times allowable. It is also important to note, this is a $0 contract and the State has not expended any funds to the vendor for execution of this contract.

AZDA is ready to publish a new version of the RFP solicitation and hopes to be able to award a new contract within 120 days.
