About this file
This is Addendum No. 2 to RFQ FY27-OTL-001 issued by the Maryland State Department of Education (MSDE) for the development of high-quality secondary mathematics instructional materials focused on Integrated Algebra 1. The addendum notifies vendors of significant updates to the original RFQ, including revised timeline, intellectual property, and licensing provisions. The new bid submission deadline is August 17, 2026, at 2:00 PM EST. Vendors who previously submitted bids must resubmit updated proposals to Round 5, as prior submissions will not be accepted. The RFQ revisions address timeline adjustments, particularly regarding the expectation that two units be completed in August, and clarify the awarded vendor's ability to sell its own proprietary materials after developing the course materials for MSDE.
The addendum addresses vendor concerns regarding intellectual property and licensing restrictions through a series of questions and answers. MSDE has agreed to allow restrictions limiting commercial use by third parties while maintaining MSDE and Local Education Agencies' (LEAs) full rights as outlined in Section III.F of the original RFQ. MSDE confirmed that licensing notices or terms-of-use statements restricting materials to educational, non-commercial use can be added to publicly posted files. The addendum clarifies that MSDE does not require or mandate LEA adoption of the curriculum; districts retain discretion to adopt, adapt, or decline materials based on local instructional priorities and existing programs. All vendors must acknowledge receipt of the addendum with their proposals, and all communications must be directed through the Procurement Officer.

Vendor Questions and Answers
Q1: Would MSDE be open to a restriction that limits commercial use by other companies, not educators, and not the state, while keeping the rights outlined in Section III.F as written for MSDE and LEAs?
A1: Yes.
Q2: Is there a way to add a licensing notice or terms-of-use statement on publicly posted files that says something like 'for educational, non-commercial use, not licensed for resale, ingestion, or commercial redistribution by third parties'?
A2: Yes.
Q3: Has MSDE used any kind of non-commercial-use notice or license marker on other HQIM materials before?
A3: This is MSDE's first HQIM procurement, so no prior precedent exists for a non-commercial-use notice or license marker.
Q4. Since MSDE's own use is unaffected, would this even need to go through a formal RFQ amendment, or could it just be addressed as a term in the resulting contract?
A4. This could be addressed as a term of the resulting contract.
Q5: Are the deliverable dates flexible, especially the expectation around two units being completed in August?
A5: Please review the amended RFQ that is included in Addendum 2 as an attachment.
Q6: What is MSDE’s expectation around the awarded vendor’s ability to sell its own platform, textbooks, or other proprietary materials after developing this course?
A6: Please review the amended RFQ that is included in Addendum 2 as an attachment.
Q7:How will MSDE communicate with districts once a winner is selected, given districts may currently use different instructional philosophies/programs?
A7: MSDE does not require or mandate that Local Education Agencies (LEAs) use this curriculum. Districts will retain the discretion to adopt, adapt, or decline the materials based on their own local instructional priorities and existing programs.
