Template Name: NRE_Commercial Services_Combined SS_RFP or RFQ

Updated through FAC 2024-05 dated May 22, 2024.

Template Use: To solicit and award a firm fixed price (FFP) stand-alone contract or IDIQ contract for commercial services that utilize FAR subpart 12.6 Streamlined Procedures for Evaluation and

Solicitation for Commercial Items procedures in conjunction with FAR part 13 Simplified Acquisition

Procedures OR with FAR part 15 Contracting by Negotiation procedures. This combines the synopsis with the solicitation, so if a synopsis is required (i.e.: > $25K unless an exception applies) and you don't wish to synopsize, this template may be used to eliminate the synopsis requirement for a commercial solicitation. (See FAR subparts 5.2 and FAR subpart 12.6). Applicable FAR clauses and provisions shall be selected by the user based on current FAR prescriptions. Clauses and provisions without comments should remain in all contracts/ solicitations. Delete clauses and provisions that don’t apply to your action. This document may not be all-inclusive for every situation. The Contracting Officer is responsible to ensure all clauses and provisions applicable to each project are included.

To assist with choosing sustainable acquisition clauses, see Sustainable Acquisition Clause Checklists

Oct 23.docx (sharepoint.com). To assist with choosing the applicable Buy American clauses and provisions see the FAI Buy American Decision Tool. Buy American Decision Tool - Federal Clause and

Provision Selection | Review 360 (articulate.com).

Solicitation Contents: Generate a solicitation in IAS. All solicitation documents should be uploaded into

IAS and all necessary reviews obtained prior to release. The SF-1449 isn’t used as part of your solicitation in a combined synopsis/solicitation advertisement, but IAS makes you choose a form so choose that one. The attached sections can be posted directly to the GPE along with any attachments needed (i.e.: wage determination).

The following mini templates shall be utilized in conjunction with this commercial services template, if applicable to your requirement.

➢ Labor Hour or T&M (See FAR 12.207 for restrictions)

➢ Demolition/Dismantling/Removal (DDR) Service Contracts (See FAR subpart 37.3 for determining when a DDR contract can be solicited as a service vs construction).

➢ The clauses in the mini templates will add to or replace clauses in your commercial template.

Award: Utilize the SF-1449 for awards over SAT. The SF-1449 is non-mandatory but encouraged for awards under SAT. Generate the award from the solicitation in IAS, upload all pertinent award documents and obtain required reviews prior to releasing. For the body of the contract: add the vendor’s price schedule and remove the provisions (they are labeled as Provisions so it’s easier to identify what can be removed) and the reps and certs.

(vi) Description of Requirement (including a list of any attachments)

SCOPE OF CONTRACT

This project requires the services to clear accumulated snow, downed trees and other debris from designated portions of USDA Forest Service roads as outlined in List of Attachments, Attachment 1 –

Project Maps. The contractor shall furnish all labor, equipment, supervision, transportation, supplies and incidentals to perform all specified work.

LOCATION AND DESCRIPTION

a. Road clearing to be done on the Detroit Ranger District, Willamette National Forest. Areas to be cleared under this contract is identified on the project maps. Snow removal work shall include the removal of snow and downed trees from all or part of the traveled roadway, including sufficient turnouts for safe travel and leaving culvert inlets in natural condition without snow, downed trees or other debris plowed into them so that the drainage system will function normally. Other road clearing will be conducted as approved by the Contracting

Officer (CO).

b. Detroit Ranger District roads identified on the Schedule of Items are accessed by taking:

• Little North Fork Area:

o North Santiam Highway (Oregon Route 22) to Gates Hill Road SE to North Fork Road SE to Elkhorn Drive SE. Road then turns into FSR-201. Estimated road clearing miles at 7.5; road is single lane.

• Coopers Ridge Area:

o North Santiam Highway (Oregon Route 22) to Blowout Road (FSR-10) to FSR-1003.

Estimated road clearing miles at 6.5, both roads are single lane.

• Boulder Ridge Area:

o North Santiam Highway (Oregon Route 22) to Breitenbush Road SE (FSR- 46) to FSR-2231 Road. Estimated road clearing miles at 19.3; all roads are single lane.

c. The itemized table breaks down the three “Project Areas” into their respective FSR-road segments designated for snow and down tree road clearing. The project will require two moves not counting the initial move in and the final move out. The road clearing routes for each

“Project Area” should not require any additional moves once equipment is unloaded at the staging area proposed on the provide map. The COR will determine the order in which “Project

Areas” are cleared. If the contractor determines that another move is required, contact the

COR/CO before proceeding. All roads are dirt and single lane.

*FSR-810 road is a part of a winter recreation use area and has the possibility of being groomed and hard packed.

d. All work shall be done in a manner to protect roads and prevent excessive damage to roads, streams, and other forest values.

e. The estimated period of performance is 18 calendar days, and the USDA Forest Service expects the work to be performed, starting anywhere from mid-March to early April 2025 depending on weather and ground conditions.

f. IMPORTANT: This contract requires close coordination with the COR due to a tree planting contract that is contingent upon these roads being clear for time-sensitive tree planting activities to commence. Many of the road miles are within the 2020 Lionshead/Beachie Creek burn area.

Numerous downed trees in the road shall be bucked, if necessary, and moved to the fill slope

(downhill) off the road surface. Trees may need to be bucked into multiple sections to promote removal from the road. All trees shall be bucked, so that no section is within two feet of the road surface.

CONTRACTOR RESPONSIBILITIES

a. Contractor shall provide operational equipment to a COR-designated location, in the area, of the project within 48 hours of verbal notice or receipt of written notice. Contractor shall notify the

COR of its intended arrival time by 2:30 PM the day before the equipment is to be delivered.

b. Contractor shall make intended equipment available for a pre- and post-use inspection. Both inspections shall be made before payment can be made.

c. Condition inspections shall be required for each move-in/move-out, provided equipment has been used for work other than this contract. Contractor will be required to notify the COR if equipment is to be used for work other than under what is defined in this contract and arrange for a condition inspection.

d. Contractor is responsible for assessing the closest available unloading spot to begin the road clearing work.

e. Contractor shall provide a written Safety Plan for the project at the Post Award Orientation

Conference (PAOC).

f. The contractor shall furnish all fuel, oil, grease, and personnel necessary for the maintenance of the equipment.

g. All repair and replacements are the responsibility of the Contractor and will be made at his expense. The Contractor will be responsible for making repairs and replacements within 2 calendar days after receiving notification that the repairs are necessary. If the Contractor cannot make the necessary repairs within 2 calendar days, he may, with the COR or CO approval, provide substitute equipment meeting contract specifications.

h. The Contractor will be responsible for clean-up of all hazardous spills from servicing or repairing the equipment.

ROAD CLEARING SPECIFICATIONS

a. Refer to attached Project Specification – Snow Removal.

b. The estimated measurement of walking distance will be from 5 to 10 miles from the unloading location to the first tree or snow removed, whichever comes first.

c. All debris, except snow and ice, that is removed from the road surface and ditches shall be deposited away from stream channels at agreed upon locations.

d. Downed trees shall be removed from the road surface. All logs are to be placed at the side of the road, out of the plowed roadway, and left for disposal by the Forest Service.

e. Standing tree’s rooted in the fill slope should not be pushed over in a manner that causes damage to the fill slope. If these trees need to be removed, they must be cut no more than at a

12-inch stump height.

f. If rock slides or mudslides are encountered, Contractor will stop work and notify the CO/COR.

The CO will negotiate removal of this material and modify contract if funding is available. If a minor amount of rock is encountered, Contractor shall push material off the roadway on the cut-bank side and continue working.

g. Snow shall be removed from the roads as to leave a minimum depth of 4 inches and a maximum of 6 inches on the road surface for road protection and natural snow melt. In areas with a layer of ice on the road, all loose snow will be plowed off the road down to the surface of the ice layer.

h. Snow removal shall be made wide enough to allow passage of a pickup truck with a minimum of 10-foot plowed width. Turnouts shall have a minimum width of 15 feet and built where space is available at a minimum of every 0.5 miles. Turn out locations may be identified by the

COR before or during road clearing operations.

i. Road banks shall not be undercut, nor shall gravel, dirt, or other surfacing material be bladed off the road.

j. Turnarounds designated on map, shall be constructed for a truck to be turned around. Turnarounds shall have a minimum of width of 30 feet. Additional turnaround locations may be identified by the COR before or during road clearing operations.

k. Snow shall be removed from the full width of intersection and sharp turns.

l. Contractor shall conduct operations to plow from the ditch line side of the road across to the outside edge.

m. Ditches and culverts shall be kept functional during operations and upon completion of operations. Drainage openings shall be constructed in the fill side snow berm at approximately

500-foot intervals on flat areas and more frequently as necessary on steeper grades to prevent erosion of the road surface and fill slope.

n. “Snow Berm” is defined as a dike of snow resulting from the Contractor’s snow removal operations which extends above the surface of the traveled way.

o. The COR may designate specific locations for turnouts, drainage openings, or turnarounds.

p. In areas of intermittent snow, or where snow is not present, care shall be taken to minimize disturbance to the road surface. Equipment shall make no sharp turns on bare road surfaces.

q. When crossing bridges or paved portions of the road, precautions shall be taken to protect the bridge deck by using tires or other material approved by COR.

r. The contractor shall adhere to all weight restrictions on County, State, and Federal roadways.

s. Contractor shall erect and maintain sign at the start of each road segment to be cleared.

t. The contractor is prohibited from operating steel tracked equipment on all paved roadways, unless precautions are taken to protect the paved surface. All precautions shall be approved in writing by the COR.

EQUIPMENT SPECIFICATIONS

a. The equipment shall be equipped with a six-way blade capable of tilt and angle to both sides.

b. A power saw shall be immediately available to the equipment for bucking of wind thrown trees

c. Plow shall be equipped with shoes or runners to keep the blade a minimum of 4 inches above the road surface unless agreed otherwise.
