About this file

This is Addendum A to RFP-DPW09-26, issued by Orange County, New York's Department of General Services on August 7, 2026, addressing clarifications and responses to bidder questions regarding engineering services for slope stabilization at County Road 32 (Mill Street) in Cornwall and County Road 74 (Forge Hill Road) in New Windsor. The Consultant shall perform slope analysis, geotechnical investigations with four borings per location, topographic surveys, installation of twelve vibrating-wire piezometers per location, conceptual stabilization recommendations, right-of-way acquisition coordination for three permanent and three temporary easements per site, SEQRA compliance documentation, stormwater pollution prevention planning, preliminary design development at 60% completion, advancement to 90% and 100% completion, bidding support, and construction design support services. The County anticipates selecting a consultant by early fall 2026, with analysis and design occurring during 2026-2027 and construction bidding targeted for late fall 2027 with spring 2028 construction commencement, subject to right-of-way acquisition timelines. Two separate contracts will be awarded, one for each project location. The original RFP questions deadline was July 30, 2026, with proposals due August 13, 2026 at 4:00 p.m.

Pricing shall be submitted on a lump-sum basis for identified work items with separate hourly rate schedules by position for calendar years 2026 through 2031. The County will provide temporary access agreements for boring operations via single-lane road closures with traffic control by the boring contractor; the Consultant is responsible for determining boring locations, depths, rock coring requirements, and access coordination while avoiding existing biaxial tilt meters at the CR 32 site. Standard drilling methods are assumed for proposal purposes, with alternative methods reviewed only if required during execution. The County will assist with private property negotiations and easement preparation but will not compensate contested or litigious property coordination as part of this contract; such unforeseen conditions require change orders billed at hourly rates. SEQRA classification is anticipated as an Unlisted action rather than Type II. Cultural resource review submission to NYSHPO is required due to CR 74's proximity to Knox Headquarters State Historic Site, though future resubmission work will be excluded from this proposal. No previous environmental or contaminated materials studies have been completed for either site. Potential FEMA grant funding through New York State Division of Homeland Security and Emergency Services may be available, subject to federal compliance requirements; the County has not yet been awarded grant funds but continues pursuing this funding source.

RE: RFP-DPW09-26, Engineering Services for CR 32 and CR74 Addendum A

Dear Offerors:

This amendment is to address questions for the above-mentioned RFP.

1) If known, when is this project expected to go to bid for contractors and what is the expected start date for construction?

Ideally a consultant will be selected and under contract by early Fall 2026. Analysis and design will take place in 2026-2027 with hopes to get out to bid by late Fall 2027 for Spring 2028 construction. This schedule will be dependent on ROW acquisitions.

2) What boring depths should be assumed for the four (4) borings at each project site for proposal purposes? This typically depends on the sub-surface soil conditions and height of the slope being stabilized. Can the County provide a general profile of the stabilization area?

The County does not have a general profile of the area. The proposer shall determine the required depth of borings based on proposal and available data.

3) Is rock coring required as part of the geotechnical investigation? If so, what length of rock coring should be assumed for proposal purposes?

This shall be determined by the proposer based on the proposal and available data.

4) Are there any site constraints to access proposed boring locations that should be assumed for proposal purposes, such as truck rig, track rig, or other types of rigs?

The Consultant will choose the boring locations. If boring from the top of the slopes the County roadway can be utilized via a single lane closure with flaggers provided by the boring company to alternate traffic. No road closures will be permitted.

5) Tectonic's preliminary geotechnical assessments indicate that difficult drilling conditions may require alternative drilling methods (e.g., sonic drilling). Should Offerors include sonic drilling under Specification Item D.4? If so, please identify the assumptions to be used for proposal purposes.

Standard drilling methods shall be assumed for purposes of this proposal. Should alternative drilling methods be required, the County would review alternative recommendations at that time.

6) Tectonic's preliminary geotechnical assessments recommend groundwater determination using vibrating-wire piezometers. Should Offerors include the installation of vibrating-wire piezometers under Specification Item D.4? If so, please identify the required quantity and any associated monitoring assumptions for proposal purposes.

Vibrating wire piezometers shall be included in the proposal. The required quantity shall be identified by the proposer however 12 piezometers have been included in the revised bid form for proposal purposes.

7) Apart from the Preliminary Tectonic Reports that were shared, are there any emergency repairs, maintenance records, or prior construction documents available for either site?

The only other documents we have are “CR 32 Historical Documents” with correspondence from 2010-2012 and the original record plans for when the roads were constructed (1939, 1960, 1966). They are attached.

8) For the CR32 site, are Tectonic’s monitoring devices expected to remain at the site for the duration of the subsurface exploration? If they are on-going, is there a location plan that shows what equipment is installed and the locations of instrumentation (to be avoided during the subsurface exploration)?

We do anticipate that the monitoring devices will remain in place. Biaxial tilt meters and their approximate locations in photos are attached.

9) Are results or reports of active slope monitoring available to be shared?

We only get updates of when a tilt meter moves a couple of degrees. In the past when this has occurred, our Consultant does a visual observation of the slope and the movement was typically due to something falling from above hitting the tiltmeter itself.

10) For the CR74 site, are there any monitoring devices in place similarly to the other site?

There are no monitoring devices on the CR 74 slope.

11) The documents state that access permissions, easements, and private property coordination are the consultant's responsibility. Will Orange County assist with property owner communications and negotiations?

Yes, Orange County will assist as much as possible but we prepared the RFP in a way that the selected Consultant will guide us through this process in what they need based on their design. The selected Consultant should anticipate to meet with the property owners to help explain the design and construction and purpose for the acquisitions but an Orange County representative can certainly help with this process.

12) If temporary access agreements or easement negotiations become contested or require legal proceedings, how will those services be compensated?

If private property negotiations become contested or require legal proceedings, a change order to this contract will be required as this is an unforeseen condition and will be billed hourly based on the annual rate sheets provided.

13) Will County legal counsel prepare easement documents and perform negotiations, or is that expected from the consultant team?

The County legal team will assist in preparing easement documents. Orange County DPW will assist with negotiations but with the guidance and expertise of the Consultant. Orange County DPW will not be “hands off” on this project. We will be fully involved as needed but have no expertise in slope stabilization and are seeking a consultant to provide analysis and design recommendations. The consultant shall be responsible for preparing the easement boundaries for the proposed easements and appraisals.

14) What legal recourse does Orange County have if the selected consultant is unable to negotiate with a potentially unwilling private property owner for access to perform surveying and geotechnical testing at the sites?

It depends on the circumstances at that time. However, we will do everything in our legal abilities to help the Consultant achieve what they are trying to study.

15) For CR74, has the County initiated discussions with Knox Headquarters State Historic Site or New York State Parks regarding site access?

The County has not initiated any discussions on the CR 74 site. On the CR 32 site we have a temporary agreement for the tiltmeters from the property owner.

16) Is cultural resource review anticipated due to the proximity of Knox Headquarters State

Historic Site?

Cultural resource review is anticipated due to the proximity to Knox Headquarters.

However, since the level of required involvement for cultural resource review is unknown, the proposer shall include submission of plans to NYSHPO for a consultation in this proposal. Future work required for resubmissions shall be reviewed by OCDPW at that time and excluded from this proposal.

17) Are further post-exploration or post-construction monitoring requirements anticipated?

No, we are hopeful that this project can conclude the current monitoring and result in no future monitoring.

18) Have any previous environmental studies (wetlands and/or T&E species) or environmental site investigations (contaminated materials) been performed for the sites and, if so, can they be provided for review?

No such studies have been completed on either of these sites.

19) The RFP states that the project may potentially receive a FEMA grant through NYS DHSES.

Can Orange County confirm which grant the project is looking to potentially pursue and if any additional information can be provided?

Enclosed is the Public Notice from November 2023 that NYS DHSES required we publish. Since publishing this, we have not been awarded a grant at this time. We regularly follow up and ask for status updates. We were also provided Exhibit E which was in the RFP package and indicates the attachment for the procurement document requirements if we were to be awarded the grant.

20) Can Orange County confirm if, as the Lead Agency, it intends to classify the proposed project as a SEQRA Type II action under 617.5(c)(2) replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site?

It is anticipated that each project will be classified as an Unlisted action.

Regards, Renee Arnold-O’Regan, M.A.

PUBLIC NOTICE

Federal Emergency Management Agency

In accordance with 44 CFR §9.8 for Executive Order 11988 and 11990 Moodna Creek Streambank Reconstruction and Hardening

Cornwall, Orange County, New York

Notification is hereby given to the public of the intent of the Department of Homeland Security- Federal Emergency Management Agency (DHS-FEMA) to provide federal funding to Orange County as subrecipient for the stabilization of a streambank along Moodna Creek in Cornwall, Orange County, New York through the Hazard Mitigation Grant Program (HMGP). The purpose of HMGP is for communities to develop hazard mitigation plans and rebuild in a way that reduces, or mitigates, future disaster losses. This notification is given in accordance with Executive Order 11988 (Floodplain Management), EO 11990 (Protection of Wetlands), 44 CFR Part 9, regulations for implementing EO 11988 and EO 11990, and the National Historic Preservation Act (NHPA).

The project is to be located along Moodna Creek, between the Creek and County Route 32/Mill Street (41.433906, -74.052528). The proposed scope of work consists of the installation of a 400 linear foot soldier pile and lagging wall on the lower portion of the embankment, plantings and erosion control matting on the mid portion, and drainage features on the top. A cofferdam will be temporarily installed to assist with the installation of the lower portion. Currently, the erosion of the embankment has caused the collapse of a private drive and threatens the structural integrity of a private and public road, posing a threat to property and safety in the area.

This action would take place within the 100-year floodplain. Alternatives considered include: 1) no action or 2) the proposed alternative to stabilize the embankment. FEMA has determined that the stabilization of the embankment with the soldier pile and lagging wall, plantings and drainage improvements as described above will create the most suitable outcome. Potential floodplain and wetland impacts are anticipated to be temporary during construction and minimized through best management practices and conservation measures incorporated from resource agency recommendations and required regulatory permits.

Comments about this project, potential alternatives, and floodplain impacts may be submitted in writing within 15 days of the date of this publication to: FEMA Region 2, Attn: Environmental Planning and Historic Preservation, 26 Federal Plaza, New York, NY, 10278 or via email to FEMAR2COMMENT@fema.dhs.gov. If substantive comments are received, FEMA will evaluate and address the comments as part of the environmental documentation for this project.
