About this file
This is a Request for Proposals (RFP) issued by the Orange County, New York Department of General Services for engineering services related to slope stabilization projects along two county roadways. The County seeks a qualified consulting firm to provide comprehensive engineering design services for slope stabilization at County Road 32 (Mill Street) in the Town of Cornwall and County Road 74 (Forge Hill Road) in the Town of New Windsor. The scope of work includes slope analysis, geotechnical investigation with assumed four borings per location, stability analysis, two preliminary design alternatives with cost estimates, right-of-way acquisition coordination for three permanent and three temporary easements per location, SEQRA compliance documentation, stormwater pollution prevention planning, and full design development progressing from 60% through 100% completion with associated technical specifications and construction cost estimates. The Consultant must also provide bidding support and construction design support services. Proposals are due by 4:00 p.m. on Thursday, August 13, 2026, with questions due by July 30, 2026. No pre-proposal conference or site visit is indicated as mandatory, though the RFP notes that attendance is strongly recommended where applicable. The contract will consist of two separate awards to one consultant—one contract for each project location. The initial contract term is three years, with an option for one additional two-year renewal period at the County's discretion, and potential for a further extended term of up to two months (or three months with consultant concurrence).
Pricing must be submitted on the provided proposal form using lump sum or hourly rates that include all costs, fees, expenses, travel, reproductions, and permit application fees. Offerors must provide hourly rate schedules by position for calendar years 2026 through 2031, along with detailed spreadsheets showing positional employees, estimated hours, and cost breakdowns for each task. The County will evaluate proposals based on consultant capability and qualifications, understanding of RFP requirements, relevant experience with similar projects, and cost proposal, each weighted equally on a 0–20-point scale using a cost-scoring formula favoring the lowest proposed cost. There are no bonds required for this contract. No incumbents are identified. The offeror must be a New York State licensed professional engineer or business entity with a Certificate of Authorization, possess a minimum of five years' experience in geotechnical engineering and slope stabilization services, and maintain active slope monitoring devices already deployed at the CR 32 location for approximately three years. The County may potentially receive FEMA grant funding through the New York State Division of Homeland Security and Emergency Services for portions of the work. Insurance requirements and pay-to-play compliance certifications are mandatory, and contracts are contingent upon execution of the County's standard Consultant Services Agreement.

If a product specification requires modification due to obsolescence, the County must approve a change of product in writing in order for it to be valid. In the event a product substitution is approved, no change in price will be permitted except when the price will be lower than the originally awarded price. Any reduced pricing shall be applicable to all other participants’ quantities ordered on or after the date such reduced pricing became effective for the initial participant receiving such pricing.

The site of the failing slope is partially located on the property of the Knox Headquarters State Historic Site. Orange County does not currently have permission to enter private property or any easements. Coordination of private property owners will be the responsibility of the Consultant. The slope failure has progressed northward to a point where Orange County has become concerned about the stability and safety of Forge Hill Road (CR 74).
b. Orange County retained Tectonic Engineering to perform a Preliminary Geotechnical Assessment. The May 9, 2025 report is enclosed for background information.
C. PURPOSE

4. Project Estimates and Pricing.
a. Consultant’s services will be billed in accordance with the rates indicated on the Proposal Form submitted in response to this RFP unless, at the discretion of the County, the County and Consultant negotiate a lump sum price for each individual project based upon the rates in the Proposal Form submitted by Consultant.
b. If a lump sum price is negotiated, the lump sum amount paid to Consultant for that specific project will not exceed the amount that the County would have paid if the services provided by Consultant for that Project were provided utilizing the rates contained in the Proposal Form.
c. All costs, fees and expenses of Consultant will be deemed included in any such negotiated lump sum, including but not limited to, overhead and profit, all travel, reproductions and related permit or other application fees.
d. The detailed cost estimate submitted by Consultant for a Project will identify any additional laboratory tests that may be necessary and will include the costs for such additional tests. The detailed cost estimate will contain price quotes per test to be conducted. For preparation of the project proposal pricing an average test price may be utilized. For project-specific purposes, additional/supplemental tests may be requested and/or required and may be included with the project-specific proposal cost development.
5. NO TAXES. The prices submitted shall be exclusive of federal and state sales taxes (or other taxes inapplicable to government entities) and must not include any tax for which the offeror may claim exemption because of doing business with the County.
6. NO DELIVERY/FREIGHT/HANDLING AND/OR SURCHARGES. Unless otherwise indicated in this RFP, prices shall be net, including transportation and delivery charges fully prepaid by the successful offeror to the destination indicated in the Contract. Prices are to be listed as FOB Delivered: ORANGE COUNTY, NY. No delivery, freight and/or handling, fuel, inflationary, or other surcharges will be accepted by the County.
7. NO CHANGE TO PRODUCT. At no time shall any change to price and product specification be permitted for the entire contract term, except where an item has been replaced by another item due to obsolescence. In this instance, the County must approve a change of product in a written change order for it to be valid. In the event a product substitution is approved, no change in price will be permitted except when the price is equal to or lower than the Contract price.
8. NO GUARANTEED VOLUME OR QUANTITIES. The proposed Scope and Specifications of this RFP are not a guarantee, were developed based on past or anticipated needs, and are as accurate as the County can ascertain at the time of issuance of this RFP. When an anticipated volume or other quantities or goods or services are listed, the County has listed these either based upon a history of usage over a previous period or anticipated need. The County in no way guarantees that the actual quantities listed will be ordered. When volume or quantities are listed, the offeror should understand that the actual volume or quantities may be more or less, depending on the actual needs of the County. The offeror shall hold the County harmless against any damage(s) because of estimated volume or quantities. In the event quantities exceed the estimate, the County shall receive the price as listed in the Contract or, if a better price is available at that time, that price shall be passed on to the County.
