About this file

The document is a Request for Proposal (RFP) No. 50011 issued by the City and County of Denver's Department of General Services for On-Call Environmental Abatement Services. The RFP seeks proposals from qualified contractors to provide environmental abatement services including remediation and management of building materials and contaminated soils containing asbestos, lead-based paint, and mold, with potential limited building demolition. The solicitation was issued on July 15, 2025, with a pre-proposal conference scheduled for July 22, 2025, and proposals due on August 21, 2025 at 12:00 P.M. local time. The contract term will be five (5) years from the date of City execution, with contractors expected to respond to project work through work orders issued by the City's Asbestos Project Manager, who will determine project award through mini-bid processes or direct selection in emergency situations.

Pricing for the contract will be based on two tables - one for non-prevailing wage and another for prevailing wage labor classifications - with a markup of up to 15% allowed on direct costs including subcontractor work, materials, and equipment. The City does not guarantee any specific quantity of services and will determine work based on actual needs and available funds. Contractors must provide a performance bond or irrevocable letter of credit for $400,000, hold a current State of Colorado General Abatement Contractor Certificate, and comply with federal, state, and local environmental regulations. The City encourages vendors to demonstrate commitment to environmental sustainability and may consider factors such as manufacturing processes, product content, transportation, packaging, and third-party environmental certifications during evaluation.

See Exhibit A.

This determination shall be at the City’s Asbestos Project Manager’s (“PM”) discretion. In either case, the Contractor will be directed by the PM to submit either a lump sum cost proposal or time and materials not to exceed cost proposal. For all project work, the selected Contractor shall provide detailed pricing information prior to executing a Work Order.

B.2.b Project Statement of Work The PM will request Contractor to submit a written statement of work within the time period and manner requested by the PM. Contractor shall provide a proposed statement of work, including a project timeline, all costs, and if applicable, estimated quantities and costs of materials, and any other information requested, to the PM. In each proposed statement of work Contractor shall represent the following:

i) Its proposed statement of work was arrived at independently and submitted without collusion with any other contractor performing similar work for the City and;

ii) The contents of the proposed statement of work have not been communicated by Consultant, nor, to its best knowledge and belief, by any of its employees or agents, to any person not an employee or agent of Contractor or its surety on any bond furnished under the Agreement, and will not be communicated to any such person before issuance of the associated notice to proceed.

B.2.c Notice to Proceed Services will be authorized by issuance of a notice to proceed (“NTP”). Contractor shall not commence any services until it receives the NTP authorizing the performance of the services. The City will not encumber funds for any services until it issues an NTP. Notwithstanding any other term or condition of the Agreement, nothing in the Agreement places any obligation on the City to proceed with any phase beyond the latest phase authorized by a written NTP (or amendment thereto) or guarantees Consultant any minimum amount of work.

B.3 COMPENSATION AND PAYMENT:

As full and complete compensation for the services rendered and costs incurred under the Agreement, Contractor will be paid the lesser of either a maximum fee to be set forth in the applicable NTP and City-approved change orders, if any, or an amount based on Contractor’s periodic invoices. Amounts billed for services rendered must be based on the rates provided in the Agreement Cost Schedule.

B.3.a Markup for Overhead and Profit The Contractor shall be entitled to a markup of up to 15% on direct costs for the following:

i) Subcontractor’s work, including labor

ii) Materials and Supplies incorporated in or consumed by the work

iii) Equipment owned and/or rented (other than small tools) and incorporated in or consumed by the work

Markup shall be nonnegotiable for a period of five (5) years. Contractor’s percentage markup on subcontractor work shall be considered to support the full cost of administrative personnel and related tasks including review and coordination, estimating, expediting, office equipment and supplies, conformance to OSHA requirements, safety programs, and all other general contractor company expenses. These percentage markups shall be applied one time only for each Work Order or Work Order Change and shall not stack in any way.

Bonds, Insurance, Permits and Taxes shall be reimbursed at the actual cost associated with all required bond riders, insurance, permits, licenses, and sales use or other taxes related to the work.

A total price to perform or complete the work, the sum of all covered and uncovered work amount, must be in each Work Order. If it is later determined that the pricing was not correct due to inaccurate or incomplete pricing data by the Contractor or any subcontractor or supplier, the price shall be reduced accordingly, and the Work Order cost modified by a Work Order Change.

B.4 INVOICING:

Contractor shall provide the City with a monthly invoice in a format and with a level of detail acceptable to the City including all supporting documentation required by the City. The City’s Prompt Payment Ordinance, §§ 20-107 to 20-118, D.R.M.C., applies to invoicing and payment under the Agreement.

Partial invoices must include the required support documentation as of that invoice final work date and must state that it is a partial invoice.

The City is not obligated to execute an Agreement or any amendments for any further services, including any services performed by Contractor beyond that specifically described in the scope of work. Any services performed beyond those in the scope of work are performed at Contractor’s risk and without authorization under the Agreement.

B.5 TERM:

The effective period of the contract resulting from this proposal shall be five (5) years from date of City execution.

B.6 ESTIMATED QUANTITIES:

The City does not guarantee any quantity of services listed herein. The quantity of services shall be determined by the City’s actual needs and availability of appropriated funds. The DEPP reinforces the City’s position that the City’s business partners are aware of the City’s Environmental Policy and are responsible for supplying goods and services in a manner consistent with this policy. The DEPP also requires business partners ensure the competency of their staff with respect to the environmental impacts of their duties.

The Environmental Policy of the City & County of Denver, may be found at:
