About this file

The document is a Scope of Work (Exhibit A) for Environmental Services, specifically an Agency Managed City-Wide Master Environmental and Asbestos General Abatement Contractor Services contract for the City and County of Denver's Division of Environmental Quality (DEQ). The General Abatement Contractor (GAC) will be responsible for providing comprehensive environmental services including asbestos removal and regulated building material abatement, indoor air quality and mold remediation, emergency response support, and environmental litigation support. The services encompass a wide range of tasks such as handling asbestos-containing materials, lead-based paint hazard controls, soil remediation, emergency incident response, and technical expert analysis for various city properties and potential disaster scenarios.

The contract requires the GAC to comply with multiple federal and state regulations, including EPA, OSHA, and Colorado Department of Public Health and Environment standards. The contractor must hold annual permits, submit necessary notifications, and coordinate closely with DEQ's Environmental Management & Operations and Environmental Land Use and Planning sections. While specific pricing terms are not detailed in this scope of work, the contract appears designed to provide flexible, on-call environmental services that can be activated as needed for city projects, with the GAC expected to provide both in-house resources and the ability to outsource specialized sub-tasks when required. The scope suggests a comprehensive approach to managing environmental risks and remediation needs across various city facilities and potential emergency situations.

1. Asbestos Removal and Response Actions

2. Regulated Asbestos Contaminated Soil (RACS)

3. Lead-Based Paint, Lead Hazard Controls, and Other RBM Support

General services include asbestos abatement and all associated response actions under EPA’s National Emissions Standards for Hazardous Air Pollutants (NESHAP), Colorado Department of Public Health and Environment’s Air Quality Control Commission Regulation 8, Part B (AQCC Reg. 8, Part B), Solid and Hazardous Waste Commission 6 CCR 1007-2 Part 1, Section 5.5 (CSWR §5.5), and OSHA 1910.1001 and

1926.1101 standards. The GAC shall be familiar with and comply with relevant City Standard Operating Procedures, Materials Management Plans, and Executive Orders.

The GAC must hold an annual Denver Fire Department (DFD) asbestos abatement permit and post at each project location along with the applicable CDPHE abatement permit.

The GAC is expected to partner with DEQ and other CCD departments and agencies to provide expert and technical guidance for abatement and remediation actions based on construction design, drawing documents, and other project supporting documents provided. Additional project support includes attending meetings, site walks, scope of work development support, coordination with project teams, and developing reports, figures, and other documents to assist the management of city projects.

1.1 Asbestos Removal and Response Actions. At a minimum, the GAC shall perform all asbestos related work in in the built environment in compliance with AQCC Reg. 8 Part B and OSHA

1910.1001 and 1926.1101 standards. Services include asbestos removal, encapsulation, enclosure, spill response, and Operations and Maintenance tasks. DEQ may request additional controls beyond the regulatory requirements when asbestos-containing materials (ACM) and trace materials are impacted. The GAC is responsible for submitting all applicable notifications, permit applications, and permit modifications to CDPHE’s Air Pollution Control Division. Waivers and variance requests are to be developed in partnership with and reviewed by DEQ prior to CDPHE submittal.

The removal or demolition of materials or buildings that do not contain asbestos or other regulated building materials (i.e. clean demo) is only allowed if it directly supports the abatement or remediation of materials specified in this SOW.

1.2 Regulated Asbestos Contaminated Soil (RACS). At a minimum, the GAC shall perform all RACS related work in accordance with CSWR §5.5, the City’s Regulated Asbestos Contaminated Soil Standard Operating Procedure, and OSHA 1910.1001 and 1926.1101 standards. At times, the GAC may be responsible for submitting all applicable notifications, plans, and forms to CDPHE’s Hazardous Materials and Waste Management Division. Variances from CSWR §5.5 and the City’s approved RACS SOP are to be developed in partnership with and reviewed by DEQ prior to CDPHE submittal.

All RACS related work is to be performed in coordination with the project CABI and DEQ.

1.3 Lead-Based Paint, Lead Hazard Controls, and Other RBM Support. When applicable, the GAC shall comply with AQCC’s Regulation 19 The Control of Lead Hazards (AQCC Reg. 19) in addition, but not limited to relevant rules and standards such as OSHA 1910.1025 and 1926.62, Toxic Substances Control Act §402 and §403, Resource Conservation and Recovery Act (RCRA) 40 CFR parts 260 through 273, and all other applicable state and federal regulations. DEQ may request lead-based paint or lead dust hazard services for various City properties.

It is the responsibility of the GAC to inform DEQ if they are unable to support lead abatement for the specified housing and child-occupied facilities detailed in AQCC Reg. 19.

In coordination with DEQ’s Environmental Management & Operations (EM&O) and Environmental Land Use and Planning (ELUP) sections, the GAC may provide services to handle, stage, and package potentially hazardous waste associated with lead-based paint and other coatings where RCRA 8 metals are of concern. These projects must be coordinated with and approved by DEQ’s EM&O and ELUP sections and meet all applicable state and federal regulations.

The GAC shall also provide remediation and/or services related to universal wastes, polychlorinated biphenyls (PCBs), mercury, and other RBMs. These projects must also be coordinated with and approved by DEQ’s EM&O and ELUP sections and meet all applicable state and federal regulations.

City emergencies would manifest as the dispersal of agents to air, land, or water, or to the grounds or interiors of buildings, homes and businesses presenting an immediate risk to public health and habitability.

To address City emergencies, the City would require and direct the GAC to support assigned project scope and sub-scopes by both, or either, commitment of the GACs own in-house resources and expertise, or by outsourcing specific sub-scopes and tasks to commercial entities who specialize in such work. In any event, the City would engage with the GAC to establish the best means of delivery involving a combination of in-house and outsourced performance. Project scopes and sub-scopes might consist of asbestos spill response, soil remediation, assessment of weak or contaminated structures, design of containment structures for dust, debris, soil, water, wastes, and application of countermeasures to neutralize chemical, biological, and radiological agents.

Part 4. Environmental Litigation Support/Expert Technical Analysis
