The maximum points that will be awarded are shown in the table below.
TECHNICAL PROPOSAL EVALUATION
with the following potential maximum scores for each Technical Proposal category
Bidder Qualifications 20 Bidder Company and Staff Qualifications
Reference Responses Experience in Providing Similar Service
15 Summary descriptions, syllabi, and materials for classes Example professional development service projects Training or Facilitation Presentation
25 Verbal Communication/Audience Engagement Organization of Training/Facilitation Exercise
PRICE PROPOSAL with the following potential maximum score: 40
TOTAL POTENTIAL TECHNICAL AND PRICE POINTS 100
22.1.2. The evaluation team will select a Bidder based upon the criteria and standards contained in this RFP and from applying the weighting in this section. Technical scoring will be based off consensus scoring.
22.1.3. Price proposal scoring will be based on comparative evaluation where the lowest cost proposal per student per class or program or per hour for professional development services over the full five (5) years of the potential contract from the “OFFER” section of this RFP will receive the maximum available points, and other price proposals for like items will be scored as a ratio to the lowest price.
Where more than one class, program of study, or professional development service is proposed, an average cost score will be calculated for the Bidder as a whole. The price proposal with the highest average cost score will then receive the full 40 points allocated for the price proposal score. Price proposal scores will be calculated using the following equation (scores will be rounded to the nearest whole number):
Lowest cost per student for Class 1 / bidder cost per student for Class 1 X 100 = Cost Score for Class 1
Example: Bidder A Cost per student for Class 1 is $2,500 while Bidder B Cost per student is $2,750 Bidder A Cost Score for Class 1 = $2,500 / $2,500 X 100 = 100 Class 1 Cost Score Bidder B Cost Score for Class 1 = $2,500 / $2,750 X 100 = 91 Class 1 Cost Score
Bidder A Cost per student for Class 2 is $28,000 while Bidder B Cost per student is $2,600 Bidder A Cost Score for Class 2 = $2,600/ $2,800 X 100 = 93 Class 2 Cost Score Bidder B Cost Score for Class 2 = $2,600/ $2,600X 100 = 100 Class 2 Cost Score Bidder A Price Proposal Score = Average Cost Score for All Classes Proposed/100 * 40 Max Points[100 + 93]/2 = 96.5 then 96.5/100 *40 = 38.6 = 39 Bidder B Price Proposal Score = [91 + 100]/2 = 95.5 then 95.5/100 * 40 = 38.2 = 38
22.1.4. No Best and Final Offers: The State of New Hampshire will not seek a best and final offer (BAFO) from any Vendor in this procurement process. All Vendors are expected to provide their best value pricing with the submission of their proposal.
23. INTERVIEWS AND PRODUCT DEMONSTRATIONS:
23.1. Vendors may be invited to interview and/or demonstrate their product at the State’s discretion. Selection of
Vendors to participate in an interview/demonstration will be made based on scoring on other sections of the evaluation; Vendor’s with lower scores may not be invited to interview/demonstrate.
23.2. Vendors are prohibited from altering the basic substance of their Proposals during the oral interviews and product demonstrations. The State may ask the Vendor to provide written clarifications of elements in their Technical Proposal regardless of whether it intends to conduct interviews.
23.3. Information gained from interviews and product demonstrations will be used to refine technical scores assigned from the initial review of the Proposal. All costs incurred from interviews and presentations shall be borne by the Vendor.
24. ACCEPTING AND EVALUATING PROPOSALS:
24.1. The State reserves the right to:

25.1. Awards shall be made to the responsible Bidder(s) meeting the criteria established in this RFP and providing the highest Evaluation Process score for the proposed class(es) and/or services. It is the intent of the State to award multiple contracts to ensure coverage for the full range of classes and professional development services to be provided by NH BET. Awards may be made in whole or in part from Bidder’s offerings. The State reserves the right to reject any or all proposals or any part thereof. If an award is made, it shall be in the form of a State of New Hampshire Contract.
25.2. If the State determines to make an award, the State will issue an “intent to negotiate” notice to a Bidder based on these evaluations. Generally, the full contents of any proposal (including all materials submitted in connection with it, such as attachments, exhibits, addenda, and vendor presentations) become public information upon completion of final contract or purchase order negotiations with the selected vendor. Certain information concerning proposals, including but not limited to scoring, is generally available to the public even before this time, in accordance with the provisions of NH RSA 21-G:37.
30.2. Confidential, commercial or financial information may be exempt from public disclosure under RSA 91-A:5, IV. Any and all information contained in or connected to a bid or proposal that a Bidder considers confidential shall be clearly designated in the following manner:
30.3. If the Bidder considers any portion of a submission confidential, they shall provide a separate copy of the full and complete document, fully redacting those portions by blacking them out and shall note on the applicable page or pages of the document that the redacted portion or portions are stamped or otherwise marked with the notation “confidential.” Use of any other term or method, such as stating that a document or portion thereof is “proprietary”, “not for public use”, or “for client’s use only”, is not acceptable. In addition to providing an additional fully redacted copy of the bid submission to the person listed as the point of contact on Page one (1) of this document, the identified information considered to be confidential must be accompanied by a separate letter stating the rationale for each item designated as confidential. In other words, the letter must specifically state why and under what legal authority each redaction has been made. Submissions which do not conform to these instructions by failing to include a redacted copy (if required), by failing to include a letter specifying the rationale for each redaction, by failing to designate redactions in the manner required by these instructions, or by including redactions which are contrary to these instructions or operative law may be rejected by the State as not conforming to the requirements of the bid or proposal. Marking or designating an entire proposal, attachment or section as confidential shall neither be accepted nor honored by the State. Marking an entire bid, proposal, attachment or full sections thereof confidential without taking into consideration the public’s right to know shall neither be accepted nor honored by the State.
30.4. Notwithstanding any provision of this request for submission to the contrary, proposed pricing shall be subject to public disclosure REGARDLESS of whether or not marked as confidential.
30.5. If a request is made to the State by any person or entity to view or receive copies of any portion of a proposal, the State will assess what information it believes is subject to release; notify the Bidder that the request has been made; indicate what, if any, portions of the proposal or related material shall be released; and notify the Bidder of the date it plans to release the materials. To halt the release of information by the State, a Bidder must initiate and provide to the State, prior to the date specified in the notice, a court action in the Superior Court of the State of New Hampshire, at its sole expense, seeking to enjoin the release of the requested information.
30.6. By submitting a proposal, Bidders acknowledge and agree that:
30.6.1. The State may disclose any and all portions of the proposal or related materials which are not marked as confidential and/or which have not been specifically explained in the letter to the person identified as the point of contact for this RFP;
30.6.2. The State is not obligated to comply with a Bidder’s designations regarding confidentiality and must conduct an independent analysis to assess the confidentiality of the information submitted in your proposal; and
30.6.3. The State may, unless otherwise prohibited by court order, release the information on the date specified in the notice described above without any liability to a Bidder.
31. ELECTRONIC POSTING OF RESULTING CONTRACT:
31.1. RSA 91-A obligates disclosure of contracts resulting from responses to RFPs. As such, the Secretary of State provides to the public any document submitted to G&C for approval, and posts those documents, including the contract, on its website. Further, RSA 9-F:1 requires that contracts stemming from RFPs be posted online. By submitting a proposal, Vendors acknowledge and agree that, in accordance with the above-mentioned statutes and policies (and regardless of whether any specific request is made to view any document relating to this RFP), any contract resulting from this RFP that is submitted to G&C for approval will be made accessible to the public online via the State’s website.
32. NON-COMMITMENT:
32.1. Notwithstanding any other provision of this RFP, this RFP does not commit the State to award a Contract. The

Any bidder that violates RSA 21- G:38 shall be subject to prosecution for an offense under RSA 640:2. Any bidder who has been convicted of an offense based on conduct in violation of this section, which has not been annulled, or who is subject to a pending criminal charge for such an offense, shall be disqualified from bidding on the RFP, or similar request for submission and every such bidder shall be disqualified from bidding on any RFP or similar request for submission issued by the State. A bidder that was disqualified under this section because of a pending criminal charge which is subsequently dismissed, results in an acquittal, or is annulled, may notify the Department of Administrative Services (DAS), which shall note that information on the list maintained on the State’s internal intranet system, except in the case of annulment, the information, shall be deleted from the list.
