I. PURPOSE:
The intent and purpose of this Request for Proposals (RFP) is to solicit sealed proposals to establish a term contract through competitive negotiation with a qualified source that can provide the Commonwealth Wastewater Infrastructure Needs Assessment (CWNA) and Clean Watersheds Needs Survey (CWNS) Data Collection, Analysis and Reporting Services (“CWNA/CWNS Data Services"), as specified herein, for the Department of Environmental Quality, an agency of the Commonwealth (“Commonwealth”) of Virginia, hereinafter referred to as the “DEQ.”
II. OPTIONAL USE CONTRACT (Ancillary Services):
The resulting contract will be an optional use, requirements-based contract for ancillary services. The DEQ is in no way required to make purchases from the Contractor and may, in its sole discretion, purchase the identical and/or similar goods/services from other sources. Any estimates/quantities contained herein do not represent a purchase commitment by the DEQ.
III. BACKGROUND:
Data Collection and Reporting of Clean Water Project Needs for State and Federal Needs Assessments
1. Commonwealth Wastewater Infrastructure Needs Assessment (CWNA)
The CWNA is the Commonwealth’s estimate of wastewater infrastructure funding needed to implement the Virginia Wastewater Infrastructure Policy (§ 62.1-223.1) and not eligible for grant funding under the Virginia Water Quality Improvement Act (§ 10.1-2117 et seq.). The assessment divides estimated needs into two (2) categories:
Community wastewater infrastructure needs, which are centralized systems typically financed through local sewer user fees supplemented by federal and state funds. These needs are collected by DEQ.
Onsite wastewater infrastructure needs, which include decentralized and septic systems typically funded by private homeowners with limited public support. These needs are collected in coordination with the Virginia Department of Health (VDH).
The CWNA is authored by DEQ in partnership with VDH and in consultation with stakeholders identified in § 62.1-223.3. The inaugural CWNA was published in 2023 and outlines statewide wastewater infrastructure needs over a 20-year period (2024–2044). The assessment is required every four (4) years and relies on comprehensive and reliable data to maintain eligibility for federal funding and support targeted resource allocation.
2. EPA’s Clean Watersheds Needs Survey (CWNS)
The CWNS is the Environmental Protection Agency (EPA)’s congressionally mandated national survey of capital costs needed to meet Clean Water Act goals. The survey documents needs for publicly owned wastewater treatment and collection facilities, stormwater and Combined Sewer Overflow (CSO) control facilities, nonpoint source pollution projects, and decentralized wastewater management.
‘Needs’ are defined as currently unfunded projects (or portions of projects) and their associated capital costs that address water quality or related public health problems existing as of January 1, 2027, or anticipated within the following 20 years. Eligible projects may use Clean Water State Revolving Fund criteria for the purpose of determining eligibility, but they are not required to meet all Clean Water SRF program requirements. Projects must not have begun construction or received external funding before January 1, 2027.
Projects planned after December 31, 2046, are excluded. Small Publicly Owned Treatment Works (POTW)s (≤1 MGD) will not be reported individually.
The most recent CWNS was conducted in 2022. Data entry for the 2027 survey will open January 4, 2027, and close October 29, 2027.
3. DEQ Responsibilities:
a. DEQ leads the collection and reporting of clean water project needs for both state and federal needs surveys.
(1) In support of the CWNA, DEQ determines—every four (4) years—an estimate of the wastewater infrastructure funding required to:
(a) implement the Commonwealth’s Wastewater Infrastructure Policy (§ 62.1-223.1); and
(b) address needs not eligible for grant funding under the Virginia Water Quality Improvement Act (§ 10.1-2117 et seq.).
(2) DEQ submits this estimate to the Governor and General Assembly by July 1, 2023, and by July 1 every four years thereafter.
b. DEQ participates in EPA’s CWNS to support nationwide funding allocations, federal program planning, and Clean Water State Revolving Fund capitalization.
4. Project Scope – DEQ is seeking contractor support to:
a. Collect, review, validate, and analyze technical data and needs data across all applicable needs categories, including wastewater infrastructure, stormwater infrastructure, nonpoint source controls, and decentralized wastewater treatment facilities.
b. Collect, review, validate, annotate, and submit designated documents, and complete all components of the 2027 U.S. Environmental Protection Agency’s Clean Watersheds Needs Survey for the Commonwealth of Virginia.
c. Draft and finalize the 2027 Commonwealth Wastewater Infrastructure Needs Assessment Report.
5. Level of Difficulty
The anticipated level of difficulty for this effort is moderate to high due to the technical and logistical complexity of coordinating statewide needs assessments. The process requires interpreting detailed federal guidance, evaluating engineering and financial documentation, validating diverse data sources, and ensuring compliance with strict eligibility and documentation standards.
Contractor engagement spans municipalities, utilities, authorities, planning district commissions, and local governments with varying technical capacity and practices. The timeline is driven by federal and state requirements, necessitating simultaneous outreach, data review, and reporting while maintaining accuracy and completeness.

Any modification of or additions to the solicitation by the Offeror shall not modify the official version of the solicitation issued by DEQ unless accepted in https://dgs.virginia.gov/procurement/eva---virginias-eprocurement-portal/eva-customer-care-forms/supplier-hypercare-support-for-the-eva-transition/ http://www.eva.virginia.gov/ https://mvendor.cgieva.com/Vendor/public/AllOpportunities.jsp https://eva.virginia.gov/index.html https://eva.virginia.gov/i-sell-to-virginia.html https://eva.virginia.gov/supplier-training-materials.html https://www.youtube.com/watch?reload=9&v=KSxcAkOekW0 https://www.youtube.com/watch?reload=9&v=KSxcAkOekW0 writing by DEQ. Such modifications or additions to the solicitation by the Offeror may be cause for rejection of the proposal; however, DEQ reserves the right to decide, on a case-by-case basis, in its sole discretion, whether to reject such a proposal. If the modifications or additions are not identified until after the award of the contract, the controlling version of the solicitation document shall still be the official state form issued by DEQ.
3. Communications regarding this RFP shall be formal from the date of issue for this RFP, until either a Contractor has been selected or DEQ rejects all proposals. Formal communications shall be directed to the DEQ Office of Procurement Services (OPS). Informal communications, including but not limited to, request(s) for information, comments or speculations, regarding this RFP to any DEQ employee other than an OPS representative may result in the offending Offeror’s proposal being rejected.
4. Proposal Preparation:
a. Proposals shall be signed by an authorized representative of the Offeror. All information requested should be submitted. Failure to submit all information requested may result in the Purchasing Agency requiring prompt submission of missing information and/or giving a lowered evaluation of the proposal. Proposals which are substantially incomplete or lack key information may be rejected by the Purchasing Agency. Mandatory requirements are those required by law or regulation or are such that they cannot be waived and are not subject to negotiation.
All information requested by this RFP on the ownership, utilization and planned involvement of small businesses, women-owned businesses and minority-owned businesses must be submitted. If an Offeror fails to submit all information requested, the issuing agency may require prompt submission of missing information after the receipt of Contractors’ proposals.
b. Proposals should be prepared simply and economically, providing a straightforward, concise description of capabilities to satisfy the requirements of this RFP. Emphasis should be placed on completeness and clarity of content.
c. Proposals should be organized in a single document (with the exception of “ATTACHMENT F”, the “PRICE SCHEDULE”), with information presented in the same order in which the requirements are presented in the RFP, to include the same “TAB” headings. All pages of the proposal should be numbered. Each paragraph in the proposal should reference the paragraph number of the corresponding section of this RFP. It is also helpful to cite the paragraph number, subletter, and repeat the text of the requirement as it appears in this RFP. If a response covers more than one page, the paragraph number and subletter should be repeated at the top of the next page. The proposal should contain a table of content which cross-references the RFP requirements. Information which the Offeror desires to present that does not fall within any of the requirements of this RFP should be inserted at an appropriate place or attached at the end of the proposal and designated as additional material. Proposals that are not organized in this manner risk elimination from consideration if the evaluators are unable to find where the RFP requirements are specifically addressed.
d. As used in this RFP, the terms "must", "shall", "should" and “may” identify the criticality of requirements. "Must" and "shall" identify requirements whose absence will have a major negative impact on the suitability of the proposed solution. Items labeled as "should" or “may” are highly desirable, although their absence will not have a large impact and would be useful but are not necessary. Depending on the overall response to this RFP, some individual "must" and "shall" items may not be fully satisfied, but it is the intent to satisfy most, if not all, "must" and "shall" requirements. The inability of an Offeror to satisfy a "must" or "shall" requirement does not automatically remove that Offeror from consideration; however, it may seriously affect the overall rating of the Offeror’s proposal.
e. The proposal should be submitted as a single document where practical (the Excel price schedule may be a separate document). All documentation submitted with the proposal should be contained in that single volume.
f. Ownership of all data, materials, and documentation originated and prepared for the State pursuant to this RFP shall belong exclusively to the State and be subject to public inspection in accordance with the Virginia Freedom of Information Act. Trade secrets or proprietary information submitted by an Offeror shall not be subject to public disclosure under the Virginia Freedom of Information Act; however, the Offeror must invoke the protections of § 2.2-4342F of the Code of Virginia, in writing, either before or at the time the data or other material is submitted and must identify the data or other materials to be protected and state the reasons why protection is necessary. If applicable, the proposal must be labeled to denote proprietary or trade secret information is contained in the document and written notice of proprietary or trade secret information must be submitted on “ATTACHMENT C / PROPRIETARY / TRADE SECRET INFORMATION IDENTIFICATION”. In addition, the specific (i.e.
specific words, figures or paragraphs submitted must be identified by some distinct method such as highlighting or underlining and must indicate only the specific words, figures, or paragraphs that constitute trade secret or proprietary information. The classification of an entire proposal document, line-item prices, and/or total proposal prices as proprietary or trade secrets is not acceptable. If, after being given a reasonable time, as solely determined by the Purchasing Agency, the Offeror refuses to withdraw an entire classification designation, the proposal will be rejected".
E-mail correspondence containing a ‘boilerplate’ notice stating that the correspondence and/or attached materials is proprietary and/or trade secret information will not be recognized by the Purchasing Agency; Offerors must specifically invoke the protections of § 2.2-4342F of the Code of Virginia and identify the specific proprietary or trade secret information associated with the E-mail and/or attached materials, as instructed above.
5. Oral Presentation / Demonstrations: Offerors who submit a proposal in response to this RFP may be required to give an oral presentation of their proposal to the Agency. This provides an opportunity for the Offeror to clarify or elaborate on the proposal. This is a fact-finding and explanation session only and does not include negotiation. The issuing agency will schedule the time and location of these presentations. Oral presentations are an option of the Purchasing Agency and may or may not be conducted.
DEQ expects Offerors who are invited to give an oral presentation will utilize the person or persons who will be working on the project to make the presentation so that the quality and experience of the Offeror’s staff can be evaluated. In the event DEQ requires an oral presentation, DEQ will schedule the oral presentation(s) for specific dates; these dates are critical and alternative dates may not be available.
Offerors should be prepared to conduct a demonstration of their current and/or proposed tracking process during the oral presentation.
B. SPECIFIC PROPOSAL INSTRUCTIONS: Proposals should be as thorough and detailed as possible so that DEQ may properly evaluate your capabilities to provide the required goods/services. Offerors are required to submit the following items as a complete proposal:
