RFP 010-2026 – Construction, Program and Fire Management Services
Date: August 3rd, 2026
Amendment #1
Subject: Affirmation of Understanding of and Agreement Form and Questions and
Answers.
1. Are the burdened rates requested on the Cost Proposal Form for the full duration of contract or will they be escalated annually? The first two (2) years will be the burdened rates of awarded respondent’s cost proposal. Escalation for subsequent years will be
3% per annum.
2) Affirmation of Understanding of and Agreement Form (required under New York State
Finance Law § 139-j) See attached.
3) The RFP indicates that the selected firm is anticipated to provide a dedicated on-site team to support and help build the newly formed Project Management Office. Will
NHCC provide furnished and equipped office space within NUMC and/or AHP for the firm’s on-site team? NHCC will provide office space with furniture. Awarded respondent firms are expected to provide their staff with computers with Microsoft Office software and schedule software, printers, and cellular phones.
4) Will you accept a proposal that EXCLUDES the Interim Fire Safety Director scope of work? Yes, however preference may be made to respondent proposals for all services.
5) The RFP references preparation of independent construction cost estimates at the 50%
CD and 100% CD stages for each bid package and reconciliation with estimates prepared by the Architect. Please clarify the anticipated bid package strategy (GMP at Risk, lump sum, design-build, etc.), including the expected number of bid packages, space type and approximate square footage, packaging approach, and whether multiple projects are anticipated under this contract. NHCC is only authorized to perform design-bid-build project delivery methods in lump-sum format. Project Labor Agreements (PLA) may be an option for larger projects. NYS procurement rules apply to all NHCC bidding.
6) The RFP references a Formal PLA (Project Labor Agreement) Feasibility Assessment.
Please provide additional detail regarding NHCC's expectations for this assessment, including required scope, deliverables, evaluation criteria, and any preferred format.
NHCC seeks to use PLA in our delivery of projects. The feasibility assessment is the first step in adopting PLA to our larger projects. Currently WICKS law projects require multiple contracts with coordination between parties.
7) Under Program Administration, the RFP references oversight and protection of NHCC's contractual interests. Please confirm that the selected consultant is not expected to provide legal representation or legal services. Not expected.
8) The RFP states an estimated program value of approximately $70 million in the first year and $50 million annually thereafter. Please confirm whether these values represent currently funded projects, projects in active planning, or planning-level forecasts subject to future funding approvals. Yes, they do.
9) Please clarify if there is an existing or preferred PMIS system to be utilized on this program? NHCC is looking for recommendations for implementation of a PMIS.
10) Please confirm the anticipated compensation structure for the contract (e.g., fixed fee, time-and-materials, not-to-exceed, cost-plus, or other approach) and whether separate fee proposals are expected for Program Management, Construction Management, and
Fire Safety services. Time and materials
11) I would just like to clarify if this is for construction management services or are you looking for a construction manager or who is also going to be establishing a GMP? This is a construction/project management assignment, no risk, and a time and materials fee structure.
