About this file

This document is a Competition Impracticable Procurement Authorization form from the Arizona State Procurement Office (SPO), involving the Arizona Department of Health Services (ADHS) and specifically the Arizona State Hospital. The document involves five contractors: Concentric Healthcare Solutions LLC, Applied Behavioral Interventions PLLC, KR Young Staffing Group - AtWork Group, Integrated Healthcare of Arizona LLC, and All About People Inc.

The procurement seeks to extend existing registry staffing contracts for an additional six months through April 30, 2025, with a total estimated cost of $960,000. The contracts are for providing nursing staff (LPN, RN, Behavioral Health Technicians) in a psychiatric setting when employee nursing is unavailable. The current contracts are in their fifth and final year, set to expire on October 31, 2024. A new Request for Proposal (RFP BPM006391) is in the final draft phase, and this extension will ensure continuous staffing services. The estimated usage per contractor varies, with Concentric Healthcare Solutions LLC at $480,000, Applied Behavioral Interventions PLLC at $240,000, and All About People at $240,000, while two contractors are noted as not in use at this time. The pricing is not expected to change and is considered fair and reasonable, with no price increases since 2022.

Six (6) Months through April 30, 2025 $960,000.00

- Authorization Request for a new CI

SECTION III - Justification

12. Rationale

13. Provide details of the procurement need, reason for the competition impracticable, and how the proposed procurement is advantageous to the State

The Arizona State Hospital requires registry staffing to fulfill the needs of the hospital when employee nursing is not available.

As such a contract has been in place since 2019 with award made to multiple vendors.

The contract(s) are in the fifth (5th) and final year expiring on October 31, 2024 and require an extension for an additional six (6) months while the current RFP (BPM006391) for these services is being solicited, evaluated and awarded.

At the time the request was made for a new solicitation in June 2024, several other complex projects were being initiated and the necessary time to fulfill this requirement could not be completed. Allowing this additional time ensures that services remain in place and will allow the RFP to be conducted and awarded before the end of the six (6) month extension.

It is most advantageous to the State in Arizona to continue the use of these Contracts until the newly awarded Contracts are established. This will avoid any lapse in service for the needed staffing requirement of the State Hospital.

- Compliance with A.R.S. §§ 41-2533, 41-2534, 41-2538, or 41-2578 is impracticable

14. Describe the procurement process, strategy to promote competition, and determination that the price is fair and reasonable

15. I have conducted research and determined that no mandatory state contract is available for the service(s)/material(s)

16. If needed, I have attached additional documents/clarifications/explanations to the request

17. Signature 18. Date of Request

In accordance with the Procurement Rules, the Arizona Uniform Terms and Conditions must be made a part of all Contracts. If you will be required to sign a software licensing agreement or sign any other agreement containing terms and conditions, these will need additional review to ensure that the terms and conditions do not invalidate the Arizona Uniform Terms and Conditions. Approval of this request does not allow for agencies to exceed their dollar acquisition amount of delegated authority.

The new RFP (BPM006391) is in the final draft phase and is scheduled to be released through APP in the next few weeks. Any resultant contract will not be able to be awarded and put in place prior to the expiration, October 31, 2024. Therefore the ADHS is requesting to go beyond the five (5) year maximum contract term by six (6) months to ensure that services remain in place during the solicitation process. Once the newly awarded Contracts are effective, these contracts will expire and all services will be conducted under the newly awarded Contracts.

The pricing is not expected to change with the six (6) month extension and is considered fair and reasonable. No price change/increase has been made since 2022.

Below is an estimated amount of usage per Contractor for the next six (6) months:

CTR047091 - Concentric Healthcare Solutions LLC - $480,000.00 CTR047092 - Applied Behavioral Interventions PLLC - $240,000.00 CTR047094 - KR Young Staffing Group - AtWork Group - Not in Use at this time CTR047095 - Integrated Healthcare of Arizona LLC - $Not in Use at this time CTR047096 - All About People - $240,000.00
