Question and Answers

1. Is there a chance both geographic contracts could be awarded to the same company? Answer-

Yes

2. Can a start-up business be considered in this RFP if it can demonstrate that it is owned and operated by title-industry veterans and uses highly experienced employees and subcontractors? Answer-Yes, all offerors must follow instructions in Section K. 4 Central Contractor Registration (CCR) of the Solicitation

3. Is there any restriction on the use of subcontractors and other non-employees to complete the work? Answer-This is a Small Business Set-Aside. Restrictions to Small Business subcontracting apply.

4. If there are such restrictions on subcontracting, are those restrictions waived or reduced if necessary to maintain service levels? See question 3

5. Page 62 of the solicitation states that Offerors' shall provide two copies of their preliminary Quality Control Plan. Is this one in the actual proposal and one separate? Or should both be in the proposal, and if so, would both be considered part of the 50 page limitation? Answer-Offerors shall submit one preliminary quality control plan as part of the proposal, which will count in the 50 page limit.

6. There is some confusion regarding key Personnel Names within Volume I of the proposal. Your solicitation clearly states that no company name or personnel names are to be included in Volume I but within the solicitation you ask for a list of Key Personnel, their job duties and descriptions and their time spent on the contract. Are we correct in assuming you DO NOT want actual names but rather a job title and description as addressed on page 12, C.4 - B and page 13, # 3 and Answer- Yes, No personnel names shall be included in Volume I.

7. Can you please identify who holds the current HUD contract for both the Northeast and the Northwest regions? Please advise if either company is ineligible to rebid for the contract.

Answer- Hocker & Associates and Contract Processing & Title. Both are eligible.

8. Can references provide completed past performance records in advance of HUD's receipt of our proposal? Answer-No, If so, is anything required to ensure that the reference is matched up with the proposal? Is there any way for a bidder to ensure that HUD has received completed reference questionnaires back from the references? Answer- Offerors can email the contact person in the solicitation for conformation.

9. Section C.5.1 - Task 1 Escrow Account (paragraph 1) states "The Closing Agent may not subordinate HUD Trust account responsibilities or allow account access to its affiliates." Does this restriction apply to subcontractors that could be engaged to handle this aspect of the work?

Yes

10. In regards to page 7, D.- "The Closing Agent shall maintain a Blanket Fidelity Bond/Employee Dishonesty Insurance Policy with minimum coverage as follows: $250,000.00 per incident, $2 million per year."

We are removing the requirement of a fidelity bond.

11. Item D4 required physical copies of all records to be returned to HUD. Our firm does not maintain physical records, but rather scans all documents. Will HUD accept the documents on disk or any other electronic media? If so, please identify the requirements for the electronic copies such that a bidder can deemed fully responsive to Item D4. Alternatively, if hard copies must be provided is it acceptable to print hard copies from the our scanned records? If so, are there any specific requirements as to the copies? Are there any documents for which copies are not acceptable?

The contractor must print hard copies of all scanned documents. There must be a signed HUD-1 settlement statement in the package with original signatures (a photocopy is unacceptable).

12. C.1.3(c) states a requirement for an E&O policy. Please confirm that an attorney's professional liability policy with a rider covering title services will satisfy this requirement (provided it is in an amount equal or greater than identified in the RFP). Yes

13. The requested Fidelity policy drastically exceeds industry standards in the aggregate coverage amount. Please confirm that the dollar amount is correct. To the extent that it is correct and given the cost in obtaining a policy which drastically exceeds industry standards, will HUD accept in lieu of an actual fidelity policy at the time the proposal is submitted, a letter from a bonding/insurance agency stating that the insurer would be willing to provide an fidelity policy in the requested amount within 10 days of contract award?

We are removing the requirement of a fidelity bond.
