About this file
This is a Questions and Answers document for IFB 26-036, a hazardous waste removal solicitation issued by the New York State Office of Mental Health (OMH) for services at the Nathan S. Kline Institute for Psychiatric Research located in Orangeburg, New York. The contract is a three-year commitment running from August 1, 2026, through July 31, 2029, with no renewal options, though the term may be adjusted to three years from the execution date if the contract cannot be finalized by the September 1, 2026, service start date. The scope includes collection, transportation, treatment, and disposal of hazardous and chemical waste streams, including lab pack chemicals, various universal wastes (lamps, batteries, CFLs, ballasts), and potentially reactive materials and lithium batteries. The facility currently operates as a Small Quantity Generator (SQG) with the potential to transition to Large Quantity Generator (LQG) status during the contract term. Typical pickups involve 2-3 personnel and 2-3 lab pack chemists onsite for approximately 8 hours per visit, with shipments occurring every 180 days for SQG status or 90 days for LQG status using 24-foot box trucks. Container types and quantities vary based on laboratory activities, typically including 5-10 one-gallon containers, 3-5 three-gallon containers, 10-15 five-gallon containers, 2 fifty-five-gallon drums, and 2 thirty-gallon containers per shipment.
All pricing must be submitted on a per-pound basis uniformly (revised from the original mixed per-gallon and per-pound format) and must include all transportation, treatment, disposal, fuel surcharges, environmental fees, and manifesting costs with no additional invoiced expenses permitted. Annual price increases are permitted up to 3% or less, submitted 90 days prior to contract anniversary using prevailing wage information as a baseline. The incumbent contractor is Republic Services/ACV, which held the prior contract (T202643) from May 1, 2025, through April 30, 2026, for $39,434.85. The solicitation includes MWBE goals of 36% (later clarified as 30% in related documents) and SDVOB goals of 6%, with good-faith effort waivers available for bidders unable to meet these targets through Attachment L-1. Proposals demonstrating good-faith efforts but not fully achieving participation goals remain responsive and eligible for award. Additional waste streams not listed may be priced through good-faith negotiations following contract award, subject to New York Office of State Comptroller approval. Emergency response capability is required with a 2-hour response time to calls, though historical emergency pickups have not occurred over the past four years. Lab pack chemists must accompany each shipment, and the contractor is responsible for majority waste characterization based on waste inventory provided by OMH prior to removal.

Can OMH provide the estimated number of hazardous waste pickups completed during the last three years?
Is the estimated waste quantity listed in the IFB based on annual generation or the total expected over the three-year contract?
Annual generation
Are there any additional hazardous waste streams not listed that are anticipated during the contract term?
Maybe few depending on lab cleanout
Are emergency pickups historically frequent? If so, approximately how many emergency pickups occur annually?
No
Should pricing include all transportation, treatment, disposal, fuel surcharges, environmental fees, and manifesting costs, or can these be billed separately?
Prices are to include all applicable fees. No additional expenses on invoices for freight/labor/gas will be payable.
How will additional waste streams not listed in the Cost Worksheet be priced? We would request a quote for the additional waste streams.
Will OMH laboratory personnel perform waste characterization prior to pickup, or is the contractor expected to profile unidentified wastes?
An inventory of the waste (chemicals) will be provided prior to the removal. Majority of the waste characterization is performed by the contractor.
Who is the current incumbent contractor? Republic Services/ACV
Are annual pricing adjustments permitted during the three-year contract? yes, annual price increase can be submitted 90 days prior to contract anniversary using the prevailing wage information provided capped at 3% or less
Regarding the bid quote sheet, the pricing unit of measure is requested as per gallon for some line items and per pound for others. In the 2019 bid (Solicitation # OMH01- C200938-3650454), all items were submitted as per pound which we would prefer.
yes, IFB will be modified to pounds not gallons uniformly
If it is not possible to change to per pound, would the per gallon charge be based on the size of the outer container?
n/a. we are changing
Our intention is to self-perform this work, and we will not be able to meet the 36% MWBE and SDVOB goals. Please provide the waiver form so we can show good faith.
Attachment L-1 will be uploaded to Contract Reporter documents for your good faith efforts in applying for a waiver
Regarding service, please provide the number of hours the incumbent vendor spends onsite during an average service.
8 hours per visit
I believe there is a typo on Page 1 of the Boilerplate document which lists the term as August 1, 2026 - July 31, 2039. Please confirm the contract is for 3 years (2026-2029) with no renewal options.
The correct term is 3 years. 8/1/26-7/31/29 with no renewal options.
Would the OMH be able to provide additional information on how each waste line is packaged for shipment, container size and count per shipment?
Container amount varies based on laboratory waste generation.
Typically, (5-10), 1-gallon containers; (3-5) 3-gallons; (10-15) 5-gallon containers;(2) 55-gallon containers; and (2) 30-gallon containers.
Is the OMH open to accepting pricing as a per container basis instead of per gallon or pound? If not, can minimum charges be added for each line?
IFB will be modified uniformly to pounds. Its reasonable that you could have a minimum charge. Please do not modify the Bid Quote sheet.
You would have to explain that in your bid submission separately.
Are any reactive material lab packs expected in the “Pack lab chemicals (various)” line?
Yes, there could be reactive chemicals.
Are there any mercury related items/compounds beyond the “broken mercury thermometer” expected? If so, can they be itemized separately?
It is unlikely there will be other mercury containing equipment.
Will there be any lithium batteries offered for disposal? Yes
May we know the reason behind moving up the due dates? Are you expecting to start services soon.
The planned contract start date is 9/1/26. We realize that may be tight and if we cant execute a contract by 9/1/26-the contract term will be 3 years from execution date
Is emergency response time of 2 hours being to respond to the call or personnel to be on site? Typically this would be to respond to the call to get the information so they are prepared to respond properly to the site. Please confirm this is the sites interpretation also.
Can the MWBE and SDVOB participation goals be waived under this solicitation? Attachment L-1 will be uploaded to Contract Reporter documents for your good faith efforts in applying for a waiver
May proposers satisfy MWBE and SDVOB goals through the use of vendors or must participation be limited to specific types of firms?
There is no limit to your efforts to achieve the goal. You will have to show your good faith efforts to reach the goal of apply and receive a waiver from
If a bidder demonstrates a good-faith effort but does not fully achieve the stated MWBE and/or SDVOB participation goals, will the proposal still be considered responsive and eligible for award?
Yes
What documentation is required to support good-faith efforts if goals are not achieved?
Attachment L-1 will be uploaded to Contract Reporter documents for your good faith efforts in applying for a waiver
Labor is not a line item, can you please confirm how often lab pack chemists are needed onsite? Do you complete shipments when a lab pack chemist is not needed? If a lab pack chemist is needed how many are sent and how long are they onsite completing the pickup?
Lab pack chemists will be needed with each shipment. Typically 2-3 chemists and up to eight hours on-site.
How many shipments were completed in 2026? one to date
Can you consider pricing by the unit rate (by the container size) and not the total volumes?
yes, IFB will be modified to pounds not gallons uniformly
What size truck is used to service pickups? 24-foot box truck
How many people are onsite to service account? Typically 2-3
IFB 26-036 questions and answers
The solicitation references both SQG and LQG status. Has the facility recently transitioned from SQG to LQG, or is a transition anticipated during the contract term?
The site is currently a SQG, but based on the type of waste generated has the potential to be an LQG in the future.
Can copies of all current waste stream profiles be provided? Manifests can be provided.
Can you please supply all 2025 manifest copies? Yes
Can you please provided Lab pack slips examples? Yes
What is the expected shipment frequency for each waste stream? 180 for SQG or 90 days for LQG
Can you please provide the container sizes associated with each waste stream. If there are more than one please note it?
Container size will vary depending on the laboratory activities; please reference item 15 for typical sizes.
For each waste stream, how many containers are generated annually by container size (e.g., 2 x 55-gallon drums, 22 x 5-gallon containers, etc.)?
Container size will vary depending on the laboratory activities; please reference item 15 for typical sizes.
Does the size require a truck with a lift gate Yes
Can you fit a tractor trailer onsite? Yes, but a box truck would be better
What sort of ER needs have you needed historically?
We have not used these historically
What is the facility's annual generation volume for all identified universal waste products. We are asking for the container type, size and frequency.
Universal waste lamps (4-foot) up to 8 cylinders; Batteries typically 1-2 containers (30-gallon); CFLs 1 30 gallon drum; ballasts 1 30 gallon drum. Typical annual volume.
Are there seasonal fluctuations in generation volumes? Less season and more based on what experiments are being conducted in the laboratories, and closeouts of laboratories.
The contract term is 13 years per the RFP, can you clarify if there are any expectation through that 13 period.
The correct term is 3 years. 8/1/26-7/31/29. Not sure what's the second part of this question is asking.
44 The prevailing wage schedule lists 5 different rates. Which specific labor categories and rates are applicable unsure of question, entering 2026901189 to DOL site brings up a rate.
This is used for yearly price increases as a baseline.
45 Approximately how many emergency pickups occurred annually during the previous contract doc: IFB 26-036, top page 7) ?
There were no emergency pickups in the last 4 years
The IFB notes that there is potential for waste streams to be added or removed from the proposed list 2. (doc: IFB 26-036, top page 6). How would OMH want us to handle the pricing for any new waste stream additions once a contract is in place?
this would be done in good faith. Winning bidder of this contract would have opportunity to quote this new service and OMH may have to get approval from OSC to add items to contract.
The IFB docs reference a Business Associate Agreement for PHI. We consider the access to any PHI data on waste to be discussed as incidental, and therefore understand that a BAA is not required under these circumstances. Are we correct in assuming that this does not apply to the scope of work? ( doc :T203112 , page 29)
BAA would not be part of the contract as no patient data be handled with this service
The contract is lacking environmental provisions and definitions. Could we propose the following contract modifications to include environmental language? A.
DEFINITIONS The following terms used in this Agreement shall have the meanings set forth below:
i. "Profile Sheet" means a standard Waste Profile Sheet executed by OMH.
ii. "Services" means analytical, collection, management, treatment, remediation, transportation, disposal and recycling services and such other services which CONTRACTOR may perform from time to time with respect to OMH’s waste materials.
iii. “Waste Materials” shall mean any chemical, substance or material designated or regulated as a “hazardous material,” “hazardous waste,” “toxic substance” or any similar designation (including petroleum products) by any national, federal, OMH, provincial, or local government (including any agency, authority, department, instrumentality or other subdivision of the foregoing) having or asserting environmental regulatory jurisdiction with respect to the substance or material generated as defined in 40 CFR 260.10.
