About this file

This is a Purchasing Affidavit form required by the State of West Virginia's Purchasing Division for vendor qualification in the Grave Creek Adena Mound Mowing Services contract opportunity. Under West Virginia Code 5A-3-10a, vendors and their related parties must affirm under penalty of law that they do not owe debts exceeding one thousand dollars in the aggregate to the state or its political subdivisions, nor are they in employer default status. The affidavit requires the vendor's authorized signatory to certify compliance with these financial and employment obligations, with the form to be notarized before submission.

The affidavit defines key terms including "debt" (any assessment, premium, penalty, fine, tax, or delinquent amount owed to the state), "employer default" (outstanding workers' compensation liabilities or policy defaults), and "related party" (entities with blood, marriage, ownership, or contractual relationships to the vendor that would receive five percent or more of contract benefits). An exception applies if the vendor has contested any applicable tax, workers' compensation premium, or fee and the matter remains unresolved, or if the vendor has entered into and maintains compliance with a payment plan or agreement. The form must be completed with the vendor's name, authorized signature, date, state, county, and notary certification before submission with the RFQ response.
