About this file

This document is a policy guideline from the Abandoned Mine Land (AML) Division regarding procurement preferences for contractors employing current and former coal industry employees, specifically aligned with Section 40701 of the Bipartisan Infrastructure Law (P.L. 117-58). The policy applies to AML construction projects valued over $100,000, where potential bidders can utilize Procurement Code 30 ILCS 500/45-110, with the primary goal of awarding contracts to the lowest responsible bidder.

The key procurement preference mechanism allows bidders who can demonstrate employment of at least two former coal mine employees to potentially receive contract preference. If a qualified bidder can meet this employment criterion and submits a bid no more than 2% higher than the lowest bid, they may be given preference in contract award. At the time of bidding, contractors must provide proof that at least two current employees are former coal mine workers and commit to utilizing these employees in the AML Reclamation project. This policy aims to support employment opportunities for workers transitioning from the coal industry while maintaining competitive bidding practices.

Preference to Contractors that Employ Current and/or Former Employees of the Coal Industry In accordance with the requirements of Section 40701 of the Bipartisan Infrastructure Law (also known as the Infrastructure Investment and Jobs Act). P.L. 117-58, priority may also be given to reclamation projects described in subsection (b)(1) that provide employment for current and former employees of the coal industry.

Potential bidders of an Abandoned Mine Land (AML) construction project with a total value of more than $100,000 are eligible to utilize Procurement Code 30 ILCS 500/45-110.

It is the policy of the AML Division to award a contract to the lowest responsible bidder. If another qualified bidder can fulfill the contract through the use of at least 2 former coal mine employees, then this bidder may be given preference over other bidders if the bid is not more than 2% greater than the low bid.

At time of bid, Qualified bidders will need to provide proof that at least 2 current employees of the bidder are former coal mine employees and that all such declared former coal mine employees in the bid shall be used in the fulfillment of the awarded AML Reclamation project or commits to employing at least 2 former coal mine employees.
