About this file

This is a Faithful Performance Bond document for the County of Orange, California, establishing the bonding requirements for contractors awarded contracts by the County. The bond serves as a guarantee that the principal contractor will faithfully perform all obligations, covenants, conditions, and agreements specified in the underlying contract. The surety company, duly authorized to conduct business in California, becomes jointly and severally liable with the contractor for performance. The bond protects the County against contractor default and ensures compliance with all contract terms, specifications, and any amendments thereto. The surety waives notice of any changes, extensions, alterations, or additions to contract terms and agrees that such modifications do not affect its bonding obligations.

The penal sum of the bond and the premium rate are to be determined based on the contract price, with the specific dollar amounts to be filled in upon contract execution. The bond requires notarization of the surety representative's signature with the certificate of notarization attached to the document. In the event of contractor non-performance, the County may enforce the bond and recover all associated costs, reasonable expenses, and attorney fees incurred in enforcement, which shall be taxed as costs and included in any judgment rendered. Approval authority rests with the County's CEO/Risk Management office and the Office of the County Counsel. Signatories must comply with California Corporations Code section 313 requirements, whereby either two officers representing specific positions must sign or a single officer may sign with written evidence of authority to bind the corporation provided.
