About this file
This document is a letter from the Arizona Department of Public Safety (ADPS) dated October 22, 2018, addressed to John Crafchun of Pratt and Whitney Engine Services in Phoenix, Arizona. The letter concerns Solicitation ADPS19-00008492 and provides notification about modifications to the Participation in Boycott of Israel Certificate requirement.
The letter indicates that due to a District Court injunction in the case Jordahl v. Brnovich, the Anti-Israel Boycott Provision (A.R.S. 35-393.01(A)) is currently unenforceable. As a result, the Participation in Boycott of Israel certificate is no longer a required form, and offers will not be evaluated based on whether this certificate has been completed. The State Procurement Office has instructed that the attachment is not mandatory as long as the court injunction remains in place. Any questions regarding this update can be directed to Melanie Guyette, Procurement Manager, at the contact information provided in the letter.

Re: Solicitation ADPS19-00008492, Notification of Modification of Participation in Boycott of Israel
Certificate
Dear Mr. John Crafchun:
This is Pratt and Whitney’s notification that the Participation in Boycott of Israel certificate is no longer a required form, and offers will not be evaluated based on whether this certificate has been completed.
Per the alert from the State Procurement Office the following language has been added to the Participation in Boycott of Israel Certificate:
Un Unless and until the District Court's injunction in Jordahl v. Brnovich et al., Case No. 3:17-cv-08263 (D. Ariz .) is stayed or lifted, the Anti-Israel Boycott Provision (A.R.S. 35-393.01 (A)) is unenforceable and the State will take no action to enforce it. The attachment (Participation in Boycott of Israel) is not a mandatory part of the offer as long as the injunction remains in place. Offers will not be evaluated based on whether this certification has been completed.
