About this file

This is a Sole Source Justification Form from the Illinois Department of Innovation and Technology (DoIT) for a contract amendment with CA, Inc. (a Broadcom subsidiary) to transition 19 mainframe software licenses from a fixed model to a subscription-based cloud model. The procurement seeks to modify existing software licenses to remove hardware-specific restrictions, with a supply/service need date of July 1, 2025, and an estimated contract value of $472,823.25. The contract is a one-time amendment to an existing enterprise licensing agreement, with the initial procurement bulletin posting date set for April 22, 2025, and a final response deadline of May 7, 2025.

The contract will be funded through State Appropriation Funds and represents a continuation of a long-standing technology partnership spanning over 20 years. DoIT argues that canceling the current contract and repurchasing licenses would cost over 10 times the proposed "true up" fee, making this amendment a cost-effective solution. The subscription model is expected to provide greater infrastructure flexibility, enable cloud compatibility for mission-critical applications, and reduce hardware costs. The current contract with Broadcom runs through 2026, and this amendment aims to protect health, life, and safety applications while improving IT infrastructure management by allowing more adaptable software licensing that is not tied to specific mainframe hardware.

Section VI - Business Rationale

1. Provide a detailed explanation of the need for the supplies or services:

CA, INC which operate as a wholly owned subsidiary of Broadcom, software has been used for many years to develop mission critical applications by DoIT customer agencies. The State of Illinois requires maintenance and support of this software to ensure production applications developed by customer agencies for their systems run properly and efficiently . Application developers and analysts rely heavily on this resource in their efforts to enhance and maintain their custom mainframe applications.

Each license supplied currently by Broadcom is tied to a specific Mainframe and can not be moved to the cloud, due to this restraint.

This amendment is meant to lift those restrictions and enable our Broadcom licenses to be able to move to the cloud as needed. This will put DoIT on a subscription basis.

2. Provide a list and describe in detail the specifications required to satisfy the need:

1- Panvalet Option for TSO 2- PanAudit Plus MIPS 3- Roscoe Interactive Environment MIPS 4- Easytrieve Report Generator Option for Db2 MIPS 5- VISION:Report I/F to IMS/DB Full-Function 6- Telon Application Generator Plus 7- PanAPT 8- Ideal for z/OS Plus 9- CA 1 Flexible Storage MIPS 10- Easytrieve Report Generator for z/OS Plus 11- Datacom for z/OS Plus 12- Easytrieve Report Generator Option for IMS MIPS 13- VISION:Report 14- Panvalet 15- Easytrieve Report Generator Datacom Option Plus 16- Panvalet Option for ISPF 17- Scheduler Job Management 18- JCLCheck Workload Automation 19- VM:Manager VM Management Suite MIPS

All 19 Mianframe broadcom software are subscription based liscense types, with a 1/OS operating system and they are considered Mainframe consumption licenses.

3. Provide detail explaining the justification selected in Section IV to explain why the requested supplies or services are the only ones available that can satisfy the agency or university requirements?

The licenses listed above are in use today are integrated into many applications supported by DoIT. These licenses, at the current time, are tied to specific mainframes and are being used in production applications developed by customer agencies. This means that if a mainframe has issues or goes down, then there are problems with the licenses as well. The goal for this procurement is to remove those restrictions and have the licenses in a subscription model available in the cloud.

4. What are the unique features of the supplies or services that are not available in any other product or by any other vendor? Provide specific quantifiable factors/qualifications:

The CA, INC which operate as a wholly owned subsidiary of Broadcom, software included in this procurement is used to run mission critical health/life/safety applications on the mainframe computers that are the backbone of the IT Infrastructure. Doit has partnered with Broadcom for over 20 years and many of the products from CA, INC included in the procurement, have provided IT Infrastructure and their customer agencies with the ability to extend many applications to the citizens of Illinois via the internet. All products in this procurement are currently being used in production applications developed by customer agencies.

5. Has the Agency or University considered alternative supplies or services to satisfy their need? Yes No

5a. If no, why weren't alternatives evaluated?

Based on the amendment requested, this procurement is already using Broadcom software licenses and DoIT just needs to change to a subscription model to be able to move these licenses to the cloud. If the original contract was canceled then we would have to repurchase the licenses all over again at a higher cost. By transferring the original licenses to a subscription model, this will decrease our costs by only having to pay for the difference between the original licenses and the cloud licenses. This transfer of licenses to a subscription based model will allow more flexibility if a mainframe crashes or is no longer able to be supported.

6. Are there resellers or distributors?

Yes No N/A

7. What efforts were made to get the best possible price (i.e. did the agency/university negotiate) and how did you determine the price for this purchase is considered fair and reasonable?

DoIT is under contract with Broadcom until 2026 for the mainframe specific licenses. To get to a subscription model and continue to have the functionality of the licenses already purchased, DoIT needs to have them transfered to a cloud environment. Cost benefits comes from if the original contract was canceled then we would have to repurchase the licenses all over again at a higher cost. That cost to purchase and implement the cloud based licenses, along with the time and effort needed to implement, if we were buying new, was estimated to be over 10 times the true up fee according to a subject matter expert for the State of Illinois. By transferring the original licenses to a subscription model, this will decrease our costs by only having to pay for the difference between the two license structures. We will also have a cost benefit by not having to purchase hardware every couple of years and also have updates on a continuous basis. The State would also not have to incur major costs if the mainframe were to crash along with the cost to repair it on an emergency basis, which would constitute many work hours to complete.

Leaving the license the same and moving to an outsourcer would incur a significant upgrade charge on all products owned by Illinois due to the size of their Mainframe. Changing the license type to Mainframe Consumption allows DoIT and the agencies to only pay for the usage actually incurred.

By transferring these licenses to a subscription based model, the State of Illinois protects our most vulnerable programs in the event of mainframe issues. This is because, if a mainframe falters, the license will not be tied to that specific mainframe and will continue to function. In the long run, this will save time and money for the State of Illinois and its taxpayers. This entails cost avoidance for the future.

8. Will this purchase obligate the State to this vendor for future purchases such as maintenance, licensing or continuing need?

Yes No

8a. If yes, please provide details regarding future obligations and/or needs:

The licenses we are looking to upgrade to the cloud environment are an integral part of the ecosystem within DOiT and other agencies. They provide mission critical health/life/safety applications on the mainframe computers that are the backbone of the IT Infrastructure. These products provide IT Infrastructure and their customer agencies with the ability to extend many applications to the citizens of Illinois via the Internet.

9. What will be the financial or other impact to the State if this sole source is not approved and a competitive bid is required?

Failure to amend the contract to be able to move the licenses to a cloud based model can put agency critical business applications at risk. Additionally, the loss of software, upgrades and technical support could result in malfunction of the software.

10. Is there any additional information you would like to add to justify this sole source?

Q8aAnswer: The licenses we are looking to upgrade to the cloud environment are an integral part of the ecosystem within DOiT and other agencies. They provide mission critical health/life/safety applications on the mainframe computers that are the backbone of the IT Infrastructure. These products provide IT Infrastructure and their customer agencies with the ability to extend many applications to the citizens of Illinois via the Internet.
Q9Answer: Failure to amend the contract to be able to move the licenses to a cloud based model can put agency critical business applications at risk. Additionally, the loss of software, upgrades and technical support could result in malfunction of the software.
