CONTRACTOR QUESTIONS:

Question 1: It appears the solicitation is limited to small business concerns as provided in solicitation. It appears by the FAR.52.219-9, Small business subcontracting plan, sub section (a) and Page 151 of 167 of Volume II Business and Price Proposal Submission requirements TAB D; all large business offers shall submit a proposed subcontracting plan. Small Business Offers are not required to submit a subcontracting plan. From this information it appears to us that no offer is required to submit a subcontracting plan because the solicitation limits the offer to a small business by the limit on the NAICS code provided in the solicitation. Can you please confirm that our interpretation is correct? If not can you please explain why?

Answer 1: Proposals will be accepted from all businesses Large and Small. This is a full and open unrestricted solicitation. Refer to the 1st page of the solicitation and applicable clauses and provisions thereafter. The confusion is understood to be a result of linking the Market Research to the actual Solicitation in the FBO system. The Market Research was seeking small business contractors to respond to see if the solicitation could be set-aside for them. There was not enough qualified small businesses for the Government to set the project aside. As a result, the solicitation was issued as full and open unrestricted requirement.

Question 2: Tab A Prime Contractor Experience Submission requirement seems to be written around the offer needing to be the prime contractor. If the offer has relevant experience but was a subcontractor; will the experience be evaluated or will it be rejected? In preparation of the technical proposal is it more important to show the magnitude of the project or similar type of construction experience?

Answer 2: If you were not the prime contractor on the project you submitted in Subfactor 1.1 Prime Contractor Experience, your experience may be considered less relevant or not relevant at all. The responsibilities and work requirements for a prime contractor significantly differ from the responsibilities and work requirements of a subcontractor.

Question 3: Our firm is interested in submitting a proposal for the Tower of Voices at the Flight 93 National Memorial, Solicitation No. P17PS00501. Is this a small business or set-aside contract or may any qualified contractor submit on this solicitation? The confusion on our part stems from the following wording in section 10 of the solicitation.

“NAICS Code 236220 – Size determination $36.5M.”

And “This is a Full and Open Unrestricted Solicitation for a firm fixed price construction contract.”

These statements seem to contradict one another. Could we get guidance as we are not a small business under these guidelines but we are fully qualified to complete this project?

Question 4: I see in the proposal submission requirements that there is an address listed for hand-delivered or Fed Ex delivered submissions. Is UPS delivery acceptable to this location?

Answer 4: Yes, you may send your proposal via UPS or any other delivery service you choose that will deliver to the location by the time the proposals are due.
