The purpose of this amendment is to make the following changes, clarifications, and responses to questions received as of July 30, 2017 as described further in this Amendment No. 000003.

CONTRACTOR QUESTIONS:

Please note that the numbering sequence for these questions is continued from previous amendments.

Question 5: Is there a specific color or finish required for the precast concrete tower?

Answer 5: No color is specified, however, the intent of the specifications is for the concrete to be grey concrete with no tinting. Regarding the finish, there are several references to the precast concrete finish in specification 03 45 00 PRECAST ARCHITECTURAL CONCRETE. Among other sections of the specifications, refer to paragraphs 1.3, 1.4, 2.3, 2.8, and 2.9 for additional information regarding finish requirements.

Question 6: Where is the erected mock-up to be located? At the precast plant or on-site?

Answer 6: The mock-up is to be constructed at the project site at a location to be proposed by the contractor and approved by the Contracting Officer.

Question 7: Water repellent coating is listed in the specs under related work. Does all precast require a water repellent coating?

Answer 7: Water repellent coating is required for exposed surfaces. Refer to Note 1 on drawing A2.01 and paragraph 1.1 of specification 07 19 00 WATER-REPELLENT COATING.

Question 8: Anti-graffiti coating is noted at the lower level of tower on detail 1/A2.01. Does all precast require anti-graffiti coating? A noticeable change in color occurs where precast is only partially coated.

Answer 8: Refer to Note 2 on drawing sheet A2.10 and paragraph 3.2 of specification 09 96 23 GRAFFITI-RESISTANT COATING for requirements. The graffiti-resistant coating is to be applied from grade to the lowest connector beam (approximately 15 feet above finished floor).

Mask and protect precast concrete surfaces that are not receive the graffiti-resistant coating.

Precast benches also require the graffiti-resistant coating.

Question 9: On drawings dated 6/19/2017, sheet 4 and 5 of 75, note has mentioned” a digital file will be provided to the contractor for locating trees for base bid and selected bid options” when will this be provided as locations of trees will help to see if walkway locations may/may not be impacted. Please advise.

Answer 9: The digital file will be provided after contract award and is subject to change based on the award of bid options related to plantings. Refer to the Landscape drawing sheets for locations of plantings. The locations are not anticipated to change and walkway locations are not likely to be impacted.

Question 10: Amendment 2 dictates vertical screens have been excluded, is there a new drawing to replace A4.06 (sheet 45 of 75)?

Answer 10: Per Amendment 2, sheet 45 of 75 is to be deleted as the sheet is NOT USED.

There is not a replacement sheet for this deleted sheet.

Question 11: During site visit agenda meeting, mention was made that the Wind Chimes are Govt furnished Equipment. Has the GFE been designed as depicted on drawings for connection corbels of the pre-cast concrete tower?

Answer 11: The wind chimes are provided as Government-furnished equipment. The final chime design is nearing completion. The Government does not anticipate any changes to the precast concrete structure as shown on the solicitation drawings as a result of the final chime design.

Question 12: Is it possible to get information on the vendor used as the basis of design for the precast to be utilized for the tower? We are not seeing that information in the specifications.

Answer 12: The precast tower structure is unique and is not based on any previous designs or vendors. The Architect/Engineer team of record consulted with Clark Pacific (www.clarkpacific.com) during the design process for feedback regarding the precast design.

PRE-PROPOSAL CONFERENCE AGENDA JULY 25, 2017

Location: At the Learning Center at Flight 93. This is the building next to the Visitor Center.

Meeting time: 9 am local time

Welcome: .

Agenda for the meeting: 1st we talk about the contractual requirements, then technical, natural and cultural, visitors, other park/project specific requirements, then walk the site.

Housekeeping: Discuss Restrooms.

Sign in sheet: Make sure you sign in. It will be posted in the next amendment.

Introductions: Have everyone introduce themselves and say what company they are with, what their company provides and if they are a subcontractor or prime.

Solicitation Issued: July 11, 2017 and can be found at www.fbo.gov by searching under the solicitation number P17PS00501.

Current Amendments: An amendment was issued on July 21, 2017. It provides the answers to the first set of questions. Parties should note the changes in the specifications.

The biggest question was related to who could propose on this project.

Proposals will be accepted from all businesses Large and Small. This is a full and open unrestricted solicitation. Refer to the 1st page of the solicitation and applicable clauses and provisions thereafter. The confusion is understood to be a result of linking the Market Research to the actual Solicitation in the FBO system.

The Market Research was seeking small business contractors to respond to see if the solicitation could be set-aside for them. There was not enough qualified small businesses for the Government to set the project aside. As a result, the solicitation was issued as full and open unrestricted requirement.

Proposal Due Date: Remains August 10, 2017 at 4PM Mountain time. All deliveries from UPS, FedEx and USPS are planned to occur prior to 4PM.

Proposal Questions Due Date: By 8am Mountain Time which is 10am Eastern Time on Wednesday August 2, 2017. The Government will try to answer all the questions and post the questions and answers as an amendment by the end of the day August 7, 2017. Please do not wait until then to submit your questions, submit http://www.fbo.gov/

them as soon as you can so that the Government has the time to research and answer in order to help you prepare your proposals. Any questions received after that date/time there is no guarantee an answer will be provided. This information will be incorporated into the amendment with the sign in sheet for this meeting.

Proposal Question Process: Provide questions by email only to the solicitation primary points of contact, which is myself and Pam Mault. The questions need to be in writing as a matter of record. So even if you have a question that you believe could be answered over the phone, we need it documented and recorded within the contractor file as a matter of record.

Wage Determinations: Make sure all of your subcontractors incorporate the wage determinations into their proposals.

Work Hours: Ensure the work hours identified in Division 1 are considered when developing the proposed schedule.

Self-Performance: In accordance with solicitation clause 52.236-1, the prime contractor is required to perform on site, with its own organization 12% of the total amount of work to be performed under the contract.

Small Business Subcontracting: Page 152 of the solicitation tells you what to submit in relation to the subcontracting plan with your proposal. The plan does not receive a rating and the award is not made until the subcontracting plan is acceptable. The clauses 52,219-9 and 52.219-16 provide further detail. A sample plan is provided as an attachment to solicitation.

The plan should demonstrate the contractor’s proposed subcontracting percentages as they relate to the proposed amount and the small business goals identified in the solicitation. If at any point during the performance of the contract it becomes apparent that the goals will not be met, the appropriate supporting documentation shall be provided to demonstrate the good faith effort. The contractor will not be considered in breach of the contract.

Small Business Participation: Page 21 of the solicitation describes this requirement. It requires a minimum of 20% of the total contract value to be

performed by small business. If at any point during the performance of the contract it becomes apparent that the goals will not be met a recovery plan will be requested and if upon contract completion the 20% is not obtained it will be appropriately documented in the past performance record.

Key Personnel: For this project the Onsite-Superintendent may also be responsible for Quality Control and Safety. The persons proposed as key personnel are required to be persons performing the work as proposed within 90 days.

Proposal Submission Requirements: The submission requirements begin on page 147 and end on page 152 of the solicitation and are part of Section L. (Also provided)

Proposal Evaluation Criteria: The evaluation criteria begins on page 164 and end on page 168 of the solicitation and are part of Section M. (Also provided)

Evaluation/Selection/Award Schedule: Process will likely take 30 days at a minimum. Do not call, your firm will be notified as soon as possible.

Evaluation Process: We first do a responsibility check on the offeror to ensure they are an interested party. Next the technical proposals are reviewed and evaluated by the Technical Panel and consensus ratings are prepared. The Panel presents the finding to the Source Selection Authority and if it is determined the evaluation was consistent and performed only against the solicitation requirements, the prices are revealed and the tradeoff process begins. Trading the benefits against the costs to establish which offeror is the best value to the Government.

Importance/Weights: Discuss the importance and weights identified in section M.

Best Value means – the ultimate decision will be based on an assessment of whether the difference in the technical and management merit of the proposals is worth the difference in the price. Even if technical is significantly more important than price, selection of a lower-proposed price is justified if the SSA determines that the technical and management benefits offered by the higher priced offeror are not worth the higher cost.

Notice to Proceed Date: The Notice to Proceed is expected to be issued as soon as (at minimum) the bonds, insurance and accident prevention plan are received and approved.

Completion Date: September 1, 2018. Explain how critical it is and why.

Government Furnished Property Chimes: The government is doing a separate procurement for the fabrication and delivery of the Chimes, the Construction contractor will be responsible for the installation of the chimes. It is estimated the chimes will be delivered to the site in spring of 2018.

Advice:

• Review ALL solicitation requirements so that you have time to ask questions.

• You will be best served if you ask questions as opposed to making assumptions.

• Do not be generic and provide boiler plate narratives, be specific to this requirement.

• With the project experience, be clear on what you performed, do not try to present work that was not performed by your company

• Ensure references are the actual customer and the contact information is up to date.

• Ensure you review the bid sheet thoroughly and that all identified quantities and measurements seem reasonable for the proposed work.

Now is your opportunity, if you see errors (patent defects), it is your responsibility to identify them now, not after contract award. If you choose to wait until after award, you could be held responsible for the associated costs.

TAB A - FACTOR 1 –EXPERIENCE

TAB A – SUBFACTOR 1.1- PRIME CONTRACTOR EXPERIENCE SUBMISSION REQUIREMENT

The offeror shall complete and provide the experience form for up to three (3) substantially completed projects performed by the prime contractor with in the last (5) five years which are proposed to be similar scope, magnitude of effort, and complexities. You may also provide additional experience documentation as long as the page limits are not exceeded.

• Projects considered substantially complete are projects that have been completed enough to determine performance on all phases of the project.

• Projects considered similar include earthwork and micropile installation, forming and placing reinforced concrete foundations and walkways, erection of precast structures, landscaping, and installation of architectural metal features on elevated structures greater than thirty feet tall.

• Projects performed by the prime include projects where the prime contractor was the prime on the contract and self-performed at least 12% of the cost of the contract, not including the cost of materials, with its own employees.

The submission for this factor should not exceed 9 pages, single sided, 12 font, 8 ½ * 11 page size.

NOTE: For purposes of evaluating Prime Contractor experience, the Prime Contractor is defined as the contractor identified in Block 14 of the Standard Form 1442. If more than one contractor is listed in Block 14, then a signed joint venture must be submitted with the proposal and the joint venture shall be registered as such in the System for Award Management (SAM). However, each party of the Joint Venture must submit their own DUNS number with the JV proposal. Projects performed by other contractors than the offeror, such as teaming partners or subcontractors, will not be evaluated for experience, unless those other contractors are part of a joint venture offeror as demonstrated by a signed joint venture agreement. If the Offeror represents the combining of two or more companies as a joint venture for the purpose of this RFP, each company in the joint venture may submit project examples, but the total submitted by the joint venture shall not exceed three (3) projects.

NOTE: If the concrete work will be performed in-house by the Prime Contractor, the submission for the Concrete Subcontractor can include different project examples then the ones provided in the Prime Contractor Experience submission. However, offerors are advised to provide their most relevant project examples. If the project examples provided in Prime Contractor experience also demonstrate the most relevant concrete work, it is better to use the same project examples then to submit different projects just for the purpose of including more project experience.

TAB B -FACTOR 2 – TECHNICAL APPROACH SUBMISSION REQUIREMENT

Provide a narrative of the approach to construct the Tower of Voices. Describe the approach to accessing the site, prepping the site including earthwork and soil loading, installation of micro piles, construction of tower foundation and concrete walkways, handling and erection of precast tower components, installation of landscaping, installation of electrical and security camera components, and final cleaning of the site. Describe the required labor, materials and equipment for the project. Describe any known challenges and proposed solutions specific to this project.

Provide a schedule that clearly identifies required activities, major milestones and critical path. The proposed schedule shall be within the period of performance identified in this solicitation.

With the schedule provide a supporting narrative that describes the sequencing of the required activities including the delivery of Government-furnished materials and coordination with the electrical utility company.

The submission for the narrative under this factor shall not exceed 10 pages, single sided, 12 font, 8 ½ * 11 page size.

TAB C -FACTOR 3 – MANAGEMENT PLAN SUBMISSION REQUIREMENT

Provide a narrative that describes the proposed project organizational structure including the prime contractor key personnel and proposed subcontractors. Describe how the prime contractor plans to manage and maintain the contract’s schedule, cost and scope. Describe how safety requirements will be incorporated into the construction activities.

Describe how the quality control requirements will be performed to ensure the Government receives a quality project.

Describe how the subcontractors will be managed and coordinated.

The submission for the narrative under this factor shall not exceed 10 pages, single sided, 12 font, 8 ½ * 11 page size.

Provide the resumes for the following key personnel:

1. Project Manager

2. On-site Superintendent

3. On-site prime contractor employee responsible for on-site safety

4. On-site prime contractor employee responsible for on-site quality control

VOLUME II BUSINESS AND PRICE PROPOSAL SUBMISSION REQUIREMENTS

TAB A - SF 1442-PRICE SCHEDULE-AMENDMENTS SUBMISSION REQUIREMENT

Submit the Standard Form 1442, Solicitation, Offer, and Award, (Construction, Alteration, or Repair), complete blocks 14 through 20C only and have an official having the authority to contractually bind the offeror's company sign the SF 1442 in accordance with the procedures prescribed in the Federal Acquisition Regulation (FAR) 4.102. Submit a completed Contract Price Schedule, found in Section B of the solicitation. Enter the proposed dollar amount for each line item in the price schedule, including any fixed unit prices, if applicable. Acknowledge all solicitation amendments using one of the methods set forth in Block 11 of SF 30, the amendment.

TAB B- BID BOND-PROOF OF FINANCIAL LIABILITY SUBMISSION REQUIREMENT

Submit a Standard Form 24, Bid Bond completed and duly executed between the offeror and the bonding company (surety). Submit proof of financial capability (most recent financial statements covering income, assets and liabilities).

Include the name, address and telephone number of firm’s banking institution.

TAB C - REPRESENTATIONS AND CERTIFICATIONS AND COMPANY INFORMATION SUBMISSION

REQUIREMENT

Submit a completed Section K, Representations, Certifications and Other Statements of Offerors. The Government will also review the offeror’s On-line Representations and Certifications (ORCA) for completeness. In addition provide the offerors (1) Address, (2) Primary Point of Contract (name, email, phone number) (3) Duns Number.

TAB D - SUBCONTRACTING PLAN SUBMISSION REQUIREMENT

In accordance with the solicitation clause 52.219-9 Small Business Subcontracting Plan and 52.219-16 Liquidated Damages – Subcontracting Plan, all large business offerors shall submit a proposed subcontracting plan as required by FAR 19.702(a)(1) and in accordance with FAR 19.704. Small Business Offerors are not required to submit a subcontracting plan.

The stated subcontracting goals are the goals assigned to the Department of the Interior for FY 2017 achievement.

SECTION M – EVALUATION FACTORS FOR AWARD

PROPOSAL EVALUATION CRITERIA

A. BASIS FOR AWARD:

The basis of award is the Best Value Continuum Tradeoff Source Selection Process. The Contracting Officer (CO) will award a firm fixed price contract to the responsible offeror whom the Source Selection Authority (SSA) determines conforms to the solicitation, is fair and reasonable and offers the best overall value to the Government all factors considered. For this acquisition the CO is the SSA.

The Government reserves the right to accept other than the lowest priced offer or to reject all offers.

Offers are advised to provide their best technical and price proposal and not to assume that they will have the opportunity to participate in discussions or be asked to submit a revised offer. The Government may make award of a conforming proposal without discussion, if deemed to be with in the best interest of the Government.

It also remains the Government’s right to enter into discussions if it is determined to be in the best interest of the Government.

B. EVALUATION PROCESS:

A Source Selection Technical Evaluation Panel (TEP) comprised of National Park Service (NPS) personnel will evaluate the proposals. Offerors are advised that the technical evaluation and rating of proposals will be conducted in strict confidence. Any and all information gained during the evaluation process will not be shared with any person that is not on the TEP or involved with the award process. Technical Proposals will be evaluated without knowledge of the price offered.

The evaluation process consists of the following four steps:

(1) Proposal Compliance Review and Responsibility Determination – This is the initial review to ensure that all submission requirements have been met, certifications are complete, the offeror is an interested party and is responsible to receive an award of a federal contract.

(2) Technical Evaluation – The TEP will review, evaluate and rate the proposals against the solicitation requirements. A ranking of offers will not be performed.

(3) Price Evaluation – The TEP and the CO/SSA will perform a price analysis.

(4) Trade Off – The CO/SSA will perform the price/technical tradeoff by comparing the advantages and disadvantages of the technical proposals to the price proposals. The CO/SSA will then select the proposal that offers the best value to the Government.

Proposed schedules that demonstrate the most advantageous critical path are within and/or less than the period of performance in this solicitation, and most appropriately organize the activity may receive additional consideration. TAB C - FACTOR 3 – MANAGEMENT PLAN EVALUATION CRITERIA

The TEP will evaluate the proposed management plan and key personnel. Plans that clearly identify the roles and responsibilities of the prime contractor and all subcontractors and demonstrate a hierarchy and structure that offers the most value to the Government may receive additional consideration. Plans that demonstrate the best management practices to control the schedule, scope and cost may receive additional consideration. Plans that demonstrate the project specific safety requirements and the best management practices of them may receive additional consideration.

Plans that demonstrate the project specific quality control requirements and the best management practices of them may receive additional consideration. Plans that clearly describe sound selection and award processes for obtaining labor, materials and equipment that provide the best value to the Government may receive additional consideration. Plans that clearly describe effective and efficient on-site management and coordination of subcontractors may receive additional consideration. Conversely, plans that do not demonstrate value to the government and best management practices for the above criteria, may receive less consideration or no consideration at all. Key personnel that possess higher qualifications in regards to experience, past performance and education may receive additional consideration. • If negative past performance information is obtained where the contractor has not been afforded the opportunity to address, they will be provided that opportunity during the evaluation process.

The Government reserves the right to utilize other tools to obtain past performance information, such as PPIRS, FAPPIS, other customers and references possessing relevant and recent knowledge of the offeror’s past performance.

In order to be considered for award, all large businesses are required to submit an acceptable subcontracting plan in accordance with the requirements of FAR 19.704. The NPS subcontracting goals for Fiscal Year 2017 are as follows: Small Businesses (44.5%), Small Disadvantaged Businesses (5%), Women-Owned Businesses (5%), HUBZone (3%), and Service Disabled Veteran-Owned Businesses (3%). The stated subcontracting goals are the goals assigned to the Department of the Interior for FY 2017 achievement; therefore, they will be used as the baseline by which to measure a contractor's proposed subcontracting goals. Subcontracting plans that include goals less than those stated, shall include rationale as to why the goals cannot be met. Large Business contractors submitting a proposal without a subcontracting plan will be considered nonresponsive and will not be considered for award. No rating will be assigned.

SPECIAL PROVISION 1: EVALUATION OF OPTIONS

Except when it is determined not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
