3. FAR 52.212-1, “Instructions to Offerors–Commercial Items” (Oct 2015)
4. FAR 52.212-4, Contract Terms and Conditions—Commercial Items (Jan 2017)
5. FAR 52.212-2 -- Evaluation -- Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The Offeror’s proposal will be evaluated based upon the degree that it addresses the technical requirements, whether pricing is representative of the market and therefore fair and reasonable, and whether it represents the best value to the Government. In the process of determining which source would provide the best value to the agency, OPIC will consider these factors: technical, oral presentation and costs. Oral Presentation is more important than price.
NOTE: Oral presentations will only be offered to the top five (5), no more than seven (7), Contractors rated after meeting the technical, past performance and price submissions.
PREFERENCE IS GIVEN TO SMALL BUSINESSES ELIGIBLE UNDER THE DESIGNATED NAICS
CODE FOR THIS ACQUISITION. If a Small Business’ proposal is evaluated to be technically acceptable with a fair market price and IAW Evaluation, the award will go to the highest rated Small Business. If no proposals from Small Businesses are evaluated to be technically acceptable with a fair market price, IAW Evaluation, the award will go to the firm with the highest rating, regardless of Small business eligibility.

Section 7.0- Evaluation
The evaluation will be done using the tradeoff method to arrive at the best value for the Government. The oral presentation is more important that price. Technical criteria are all of equal importance.
Evaluation criteria for technical acceptability:
- Proposal is responsive to RFQ.
- Statement of Offeror’s Capabilities.
- Relevant experience/past performance (Please provide a resume of the contractor whom will be performing the tasks.)
- Offeror’s understanding and responsiveness that demonstrates the following:
a. Mastery of the concepts, principles, and methods of Federal equal employment opportunity laws, regulations, Executive orders, court decisions, and issues to develop broad guidelines or regulations or to conduct projects to resolve complex systemic problems of broad scope (e.g., agency-wide).
b. Knowledge of the organizational structure, management policies, procedures, and practices of Federal agencies.
c. Knowledge of the Federal personnel system including detailed knowledge of the kinds of policies and practices regulated or covered by Federal personnel regulations, as well as basic principles involved in recruitment, selection, labor relations, job evaluation, and other personnel areas.
d. Skill in identifying equal employment opportunity problems and developing concrete action plans to solve these problems to advise Federal managers on appropriate courses of action to eliminate barriers to equal employment opportunity.
e. Consulting skills to advise Federal managers on broad, complex, and sensitive equal employment opportunity issues. This includes the ability to develop and advise management on establishment of equal employment opportunity programs, policies, and approaches and propose comprehensive changes in basic management policies and practices designed to solve equal employment opportunity problems within the department that have been unyielding in the past to systematic efforts for solution.
f. Skill in identifying and defining systemic barriers to equal employment opportunity, developing concrete, practical solutions, and assisting Federal managers in integrating equal employment opportunity action into their continuing management strategies.
g. Skill in developing or materially redesigning broad equal employment opportunity programs of Federal agencies.
Evaluation of past performance: The Government may consider information obtained through other sources (i.e., Past Performance Information Retrieval System). Past performance information will be utilized to determine the quality of the contractor’s past performance as it relates to the probability of success of the required effort.
Evaluation of price: Contractors' price quotes will be evaluated to determine reasonableness and realism.
Pricing that is excessively high or low may be considered unrealistic and unreasonable, and may receive no further consideration. The contractor offering the lowest total price that is determined to be technically acceptable in accordance with the aforementioned criteria will receive the award.
Combined Synopsis/Solicitation OPIC-19-R-0003 4

The presentation will cover all questions on the attached questionnaire and but IAW the below set agenda. Each presenter/contractor will be given a ‘confidence’ rating strictly related to the technical capabilities, answers to the questionnaire and experience.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
