Addendum to 52.212-1, Instructions to Offerors –Commercial Items.

The award will be made to the vendor whose submission represents the best value to the Government.

The Government may award to other than the lowest priced Offeror or the highest technically rated Offeror utilizing trade-offs. Pricing will be evaluated separately from technical factors and used as a trade-off. The importance of price in the evaluation will increase with the degree of equality among proposals of the non-price factors.

Once the solicitation is closed, the Government intends to award a contract without further communication with respective Offerors. The Government, however, reserves the right to conduct communications if deemed in its best interest. Each initial proposal should contain the Offeror’s best response from both a price and a technical standpoint.

Offer Volume Requirements:

NIST requires one (1) submission via email.

NIST requires two (2) separate volumes for this requirement:

Volume 1 – Technical Offer -

Consists of the actual offer in response to Experience, Past Performance, Key Personnel, and Safety.

The submission shall not merely offer to perform work in accordance with the statement of work, but shall outline the actual work proposed as specifically as practical. The statement of work reflects the objective of the program under consideration; therefore, repeating the statement of work without sufficient elaboration will not be acceptable.

Volume 2 – Price List - Response to price. The offeror shall provide a separate firm fixed price for the base requirement and each option.

Evaluation Factors:

1. Experience:

Submittal Requirements: The Offeror shall submit a maximum of three (3) electrical projects that best demonstrate experience on relevant projects that are similar in size, scope, and complexity to the SOW. For purposes of this evaluation, a relevant project is further defined as a high voltage electrical project, including the replacement of components in an occupied facility, valued at least $250,000.

The attached Project Data Sheet (Attachment V) is MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate construction. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, area, construction methods).

2. Past Performance:

Page | 2

Submittal Requirements: The offeror shall submit a completed Past Performance Questionnaire (Attachment VI) or Contract Performance Assessment Reporting System (CPARS) Evaluation Report for each relevant project submitted for Factor 1. If a completed CPARS Evaluation Report is available for each project, it shall be submitted with the proposal. If there is not a completed CPARS evaluation report, then Offerors shall submit a completed Attachment VI-PPQ for each project included in Factor 1.

If an offeror has no relevant past performance, it should include a statement to that effect in its proposal. A failure to submit past performance or affirmatively state that an offeror does not have any past performance may result in the offeror being considered non-compliant

3. Key Personnel:

Submittal Requirements: The offeror shall submit resumes for the following:

Project Manager Electrical Forman

These positions may be filled by the same person.

The submittal shall not be more than 2 single sided pages for each resume.

4. Safety Plan:

Submittal Requirements: Provide a Safety Plan for this requirement. The Safety Plan shall include, as a minimum, the following to cover all operations, including work by subcontractors:

i. The names, qualifications (in resume format), duties, responsibilities, and authorities of each person assigned in a safety function.

ii. A description of how the offeror will identify products to ensure they do not contain asbestos or other hazardous materials.

iii. Job Hazard Analysis (JHA)

2. Price:

The offeror shall submit a quote showing the parts list with pricing; labor and number of hours for each labor category, and the total firm fixed price. The labor categories associated with the Key Personnel shall be identified or somehow marked. A separate quote is required for the base requirement and each option. Applicable labor categories with the associated hourly rates shall be provided for CLIN 0002.

52.212-2 Evaluation—Commercial Items.

(a) The award will be made to the vendor whose submission represents the best value to the Government. The following factors shall be used to evaluate offers:

TECHNICAL

1. Experience:

NIST will evaluate the offeror’s experience to determine the extent to which it demonstrates that the offeror has successfully completed three relevant contracts in the past 5 years. Each project shall involve significant electrical work, including replacing components, and have an awarded valued of at least $250,000. Each project must have been completed in a facility which remained operational during the replacement of parts. (Examples would be a scientific research facility, a hospital, an electronics manufacturing facility, medical component manufacturing facility, and etc.)

Relevant projects where the Offeror and the proposed subcontracting firms have previously worked together may be considered more favorably than those that have not worked together.

Relevant projects where the prime offeror performed higher percentages of work may be considered more favorably than those that performed smaller percentages of the work.

2. Past Performance:

In assessing the offeror’s past performance, NIST will evaluate the quality, timeliness, and ability to control cost and schedule on projects used to demonstrate experience. NIST, at its discretion, may evaluate past performance by contacting appropriate references, including NIST references. The Government may also consider other information available. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will be evaluated neither favorably nor unfavorably.

3. Key Personnel:

NIST will evaluate the resumes of the proposed key personnel to determine the extent to which they have performed projects similar to those anticipated for the task order and the extent to which their education, training, qualifications and experience indicate they will successfully perform the roles for which they are proposed.

4. Safety Plan:

The assessment of the Offeror’s safety plan will be used as a means of subjectively evaluating the capability of the Offeror to safely meet the requirements of the Statement of Work.

PRICE

NIST will evaluate the price proposals to determine fairness and reasonableness. Fair and reasonable will be determined by comparison to other competitive prices received and the Independent Government Estimate.

The Technical Factors are considered equal. When combined the Technical Factors are significantly more important than Price. However, price will become more important as the degree of equality among proposals of the technical factors increase.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are exchanges after its receipt, unless a written notice of withdrawal is received before award.
