SECTION M - EVALUATION FACTORS FOR AWARD
EVALUATION FACTORS FOR AWARD
I. GENERAL
A. The Government intends to award a Firm-Fixed-Price contract for the completion of FY22 Docking Planned Maintenance Availability (DPMA) for the DYNAMIC (AFDL-6) and Barge (YFND-30) to the Offeror whose proposal represents the Best Value to the Government. Proposal due date is 3 November 2021 at 1200pm local time.
B. Offerors are advised that the Government intends to make award on the basis of initial proposals without conducting discussions with Offerors, but reserves the right to conduct discussions if determined by the Contracting Officer to be necessary (see paragraph (f)(4) of FAR 52.215-1). Therefore, each initial offer should contain the Offeror’s best terms from a technical, past performance and price standpoint.
C. Offerors are advised that the Government will not evaluate any proposal information not contained within the body of the proposal.
II. BASIS OF AWARD
A. The Government will select the best overall offer, based upon an assessment of non-price factors and Cost/Price. A contract shall be awarded to the Offeror who is deemed responsible in accordance with FAR 9.104, whose proposal conforms to the RFP’s requirements (to include all stated terms, conditions, representations, certifications, and all other pre-award proposal information required by Section L of this solicitation) and represents the best value to the Government in accordance with the evaluation criteria.
The Government will make a Best Value source selection using Tradeoff source selection process in accordance with FAR 15.101-1.
B. Trade off process is appropriate because of the required experience needed for this requirement. .
Best value trade-off, technical and past performance are more important than price. Technical is more important than past performance. Overall, Non-Price factors, when combined, are considered significantly more important than the Price Factor. As other factors become equal, price becomes more relevant.
This may result in an award to a higher rated, higher priced Offeror, where the decision is consistent with the evaluation factors, and the Source Selection Authority (SSA) reasonably determines that the benefits associated with award to the higher price Offeror outweigh the difference in price. The SSA will base the source selection decision on an assessment of proposals against all source selection criteria in the solicitation.
In evaluating an offeror’s proposal, the Government may consider information from other sources, such as the Defense Contract Audit Agency (DCAA), Mid-Atlantic Regional Maintenance Center (MARMC) and other sources, as appropriate
C. Award will be made to the Offeror whose proposal is most advantageous to the Government under the selection criteria in this solicitation. The best value basis for award will be based on the following evaluation factors:
1. Non- Price Factors
a) Factor 1: Technical
b) Factor 2: Past Performance
2. Price Factor
a) Factor : Price
D. The Government intends to award the contract without discussions. Accordingly, each Offeror should submit its most favorable terms from a price and non-price standpoint. However, the Government reserves the right to establish a competitive range and conduct discussions if later determined by the PCO to be necessary. All proposals will be reviewed for timeliness. If the proposal is received after the closing date and does not meet the criteria for “late submissions” in the solicitation, the proposal will not be opened. Timely proposals will be reviewed for compliance to the solicitation. If the proposal is not compliant to the solicitation, it will not be evaluated and the Offeror will be notified that the proposal is non-responsive.
E. In evaluating an offeror’s proposal, the Government may consider information from other sources, such as the Defense Contract Audit Agency (DCAA), Mid-Atlantic Regional Maintenance Center (MARMC) and other sources, as appropriate.

• The Offeror’s workload during each proposed Availability, accounting for work the Offeror currently has under contract and work the Offeror may complete, including the resources to complete ALL outstanding proposals and the resources required to complete any other anticipated requirements from “Avail Start” through “Contract Complete.”
• Additionally, the Government will apply its understanding of the forecast port wide workload from “Avail Start” through “Contract Complete” in parallel to its evaluation of the offeror’s workload.
a. Assess the extent to which the Offeror’s proposed manpower curves (total) demonstrate a detailed, substantiated and complete understanding of how the Offeror will provide the trade manpower to successfully complete each Availability’s requirements and all existing and proposed work. The Government will assess these curves in relation to the narrative provide. Emphasis will be placed on how the Offeror plans to de-conflict anticipated manning shortfalls and manning inefficiencies.
b. As an indicator of the Offeror’s ability to provide manning for the efforts that are the subject of the proposed solicitation in accordance with the proposed manning, the Government will evaluate the adequacy of the Offeror’s prior manning performance for current projects, as defined in Section L, including planned to actual manning performance

4. Extent to which the Offeror’s documentation explains how the Offeror has scheduled the performance of all work items included in each Availability work package including base and option items
B. Factor (2) Two – Past Performance
For the Past Performance Factor, the ratings tables entitled “Past Performance Relevancy Ratings Table” and “Past Performance Confidence Assessment Ratings Table,” respectively will be used for the assignment of ratings for relevancy and confidence assessment. Relevancy includes scope, magnitude and complexity as described in Section L. The Offeror’s past performance information will be evaluated to determine the quality and usefulness as it applies to performance confidence assessment.
1. The Government will measure how well an Offeror has performed on recent and relevant contracts in the past as an indicator of the Offeror’s probability of meeting the solicitation requirements and successful performance on the current requirement.
2. The Government will evaluate the recency, relevancy and quality of an Offeror’s past performance to assess a performance confidence assessment. The Government will utilize CPARS data (Attachment S-2) where available; if CPARS data is unavailable, the Government will utilize PPQ (Attachment S-3) as provided. The Government reserves the right to evaluate any other sources of information reasonably available to the Government.
3. Assessment of past performance will be a subjective assessment based on consideration of all relevant facts and circumstances. The Government is seeking to determine whether based on the Offeror’s recent/relevant performance record, the Offeror will successfully perform the requirement.
4. The evaluation will focus only on work experience already performed. Work yet-to-be performed, and work prior to the last three (3) years from the initial solicitation date, will not be considered. In addition, performance data will only be assessed for those references demonstrating at least six (6) months of completed performance and have been performed within three (3) years from the initial solicitation date.
5. Focus will be on an offeror’s corrective measures to prevent the reoccurrence of past performance problems. Prompt actions taken to correct performance problems will be a reflection of management concern for customer satisfaction; however, such action may not mitigate all negative performance trends.
6. In accordance with FAR 15.305(a)(2)(iv), Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably on past performance. However, the proposal of an Offeror with no relevant past performance history, while not rated favorably or unfavorably for past performance, may not represent the most advantageous proposal to the Government. In this instance, the Offeror will receive a rating of “Neutral Confidence” in the past performance factor. The Government may determine that a “Substantial Confidence” or “Satisfactory Confidence” past performance rating provides better value to the Government than a “Neutral Confidence” past performance rating.
7. A separate quality assessment rating is not required; rather, the past performance confidence assessment rating is based on the offeror’s overall record of recency, relevancy, and quality of performance FAR 15.304(c)(2)).
8. In the event an Offeror receives a negative past performance rating, it will be given the opportunity to provide further explanation to the Government. Focus will be on an Offeror’s corrective measures to prevent the reoccurrence of past performance problems. Prompt actions taken to correct performance problems will be a reflection of management concern for customer satisfaction; however, such action may not mitigate all negative performance trends.
Past Performance Quality
After determining recency and relevancy, the third aspect of the past performance evaluation is to establish the overall quality of the Offeror’s past performance. The Government will review all past performance information collected and determine the quality of the Offeror’s performance, including general trends and usefulness of the information, and will incorporate this into the performance confidence assessment. Regarding quality, each past performance reference under each Offeror’s Past Performance submission will be evaluated to determine its performance quality.
In order to determine the quality of performance, the Government may utilize existing data sources, including the Contractor Performance Assessment Reporting System (CPARS), the Federal Awardee Performance and Integrity Information System (FAPIIS), the Electronic Subcontract Reporting System (eSRS), or other databases;
communication with points of contact in the Offeror’s customer’s organization, which could include private sector requirements and contracts personnel, Administrative Contracting Officers, Defense Contract Management Agency (DCMA) personnel, Procuring Contracting Officers, Contracting Officer’s Representatives, and other Government activity requirements personnel.
The Government may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews, and existing data sources. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources, including sources outside of the Government. This information will be used for the evaluation of past performance.
Past Performance Confidence Assessment
The overall assigned rating for Past Performance will be the Past Performance Confidence Assessment rating. The assignment of this rating will be based on the quality of the relevant past performance and will also consider the recency and relevance of the information, source of the information, context of the data, and general trends in Contractor’s performance. The quality of performance under a past performance reference that has no relevance to the instant requirement will not be considered in the overall assessment of Past Performance Confidence. This evaluation and rating is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s past performance will be used as a means of evaluating the relative capability of the Offeror and other competitors to successfully meet the requirements of the RFP. In determining the rating for the past performance evaluation factor, the Government will give greater consideration to the contracts which the Government feels are most relevant to the RFP.
No recent/relevant performance record: The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
