ADDENDUM TO FAR 52.212-1
INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS
1. Offerors shall submit their proposals in accordance with the following preparation instructions. Offerors are not required to submit any fill-in clauses with their proposal. The Government will consider any failure on the part of an offeror to comply with these instructions to be an indication of the quality of performance it can expect during contract performance. Therefore, the Government encourages offerors to contact the contracting officer (KO) and contract specialist in writing in order to request an explanation of any aspect of these instructions.
A proposal should not simply rephrase or restate the Government’s requirements but rather provide convincing rationale to address how the offeror meets these requirements. Offerors shall assume that the Government has no prior knowledge of their facilities and experience and will base its evaluation on the information presented in the offeror’s proposal.
If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the KO in writing with supporting rationale as well as the remedies the offeror is asking the KO to consider as related to the omission or error.
2. Relationship between Instructions and Evaluation: Your attention is directed to the functional relationship between INSTRUCTIONS TO OFFERORS and EVALUATION FACTORS of this solicitation. INSTRUCTIONS TO OFFERORS provides information for the purpose of organizing the proposal and is not intended to be all inclusive. EVALUATION FACTORS describes evaluation factors for award. Since the Government evaluation of proposals will cover areas identified INSTRUCTIONS TO OFFERORS, proposals should address all such areas of evaluation.
3. ALL INQUIRIES shall be made via email and directed to Contract Specialist and Contracting Officer listed below. To ensure the Government is able to adequately address and respond to offeror Requests for Clarification (RFC) via amendment if applicable, it is requested questions be submitted no later than August 24, 2018 at 3:00 PM PDT. The government reserves the right to not answer any questions received after the designated date and time.
Furthermore, offerors should note that the proposal due date will not be extended solely on the basis of questions received. RFCs shall reference the solicitation and specification page and paragraph number and be submitted on a request for clarification form (Attachment 4) provided with this solicitation. A request via clarification form shall be submitted for each separate question.
All proposals shall be sent via email to Tim Smart, Contract Specialist, at timothy.smart@navy.mil and James Walker, Contracting Officer, at james.m.walker11@navy.mil.
All proposals shall include delivered price(s), a point of contact, name and phone number, CAGE Code, business size under NAICS Code 336611. Each response must clearly indicate the capability of the vendor to meet all Performance Work Statement, specifications and period of performance requirements.
4. Evaluation Factors Technical Capability: The prospective offeror must demonstrate specific experience providing services of the complexity similar to or exceeding the scope identified in the Performance Work Statement (PWS) (Attachment 1), through a narrative of three (3) contracts within the last three (3) years. Offerors shall provide sufficient explanation that the experience provided demonstrate that the offeror has the necessary management, technical personnel and material resources available to successfully complete services in accordance with the PWS.
Submission Requirements: Offerors are required to provide narratives that are clear, coherent, and prepared in sufficient detail for effective evaluation of the offeror’s proposal. Any supporting documentation included should clearly substantiate claims and be verifiable. Offeror’s shall include ongoing or complete contract numbers, to include specific delivery/task order numbers as applicable, within the narrative to allow for the verification of claims. However, copies of contracts referenced are not required as part of the proposal. If referencing non-government corporate experience contracts, offeror’s shall include an associated point of contact with the customer company which includes: name, company title, phone number, and email to allow for government verification.
Past Performance: Evidence of past performance on three (3) separate contracts actions within the last three (3) years that demonstrates performance relevant to preservation and maintenance projects similar in scope of the PWS.
Submission Requirements: Offerors are required to provide Past Performance Data Sheets Attachment 2 on three (3) of the firm’s recently completed contracts or task orders (not to exceed five years since completion) that demonstrate relevant work as outlined in to PWS of the solicitation. Altered or substituted questionnaires will not be evaluated.
Offerors may submit performance data regarding current contract performance as long as a minimum of one year of performance has been completed as of the closing date of this RFP. Supporting documentation should clearly substantiate claims and be verifiable. Offeror’s shall include complete contract numbers, to include specific delivery/task order numbers as applicable, within the narrative to allow for the verification of claims. However, copies of contracts referenced are not required as part of the proposal. If referencing a non-government past performance, ensure that the Past Performance Data Sheets list a current customer point of contact with name, company title, phone number, and email included for government verification. Past performance information obtained from established systems such as the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases. Past performance information may also be obtained from other sources available to the Government, such as the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, Fee Determining Officials.

5. Proposals must be received no later than August 31, 2018 at 3:00 PM PDT. The timeliness of proposals will be determined in accordance with FAR 52.215-1(c)(3)(ii)(A)
The proper completion and submission to the Government of the above items will constitute a proposal. Unless this solicitation expressly authorizes alternate offers with respect to specific terms and conditions of this solicitation, any exception to any of the terms and conditions shall constitute a deficiency which may make the proposal unacceptable.
ADDENDUM TO FAR 52.212-2
EVALUATION--COMMERCIAL ITEMS
1. The Government intends to award a single, firm-fixed-price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: technical capability of the item offered to meet the Government requirement, past performance, and price. In accordance with 13.106-2(b), the Government is not required to establish a competitive range, conduct discussions, or score proposals. Consistent with simplified acquisition procedures, the evaluation process is as follows:
a. In selecting the best overall offer, the following factors will be considered: (1) technical capability, (2) past performance, and (3) price. The Offeror must be determined to have acceptable technical and past performance before further consideration will be given; that is, selection of the contractor is to be based on the establishment of minimum requirements to be evaluated on an “acceptable” or “unacceptable” basis.
Offers are evaluated for acceptability, but not ranked using the non-price factors.
b. Technical Evaluation Ratings:
Rating: Acceptable Description: Submission meets the minimum requirements of the solicitation
Rating: Unacceptable Description: Submission does not meet the minimum requirements of the solicitation If the technical submittal is determined "Unacceptable", it renders the entire proposal technically unacceptable. Technical submissions that do not meet the minimum requirements will be rated as "Unacceptable", and will no longer be considered for award.
c. Past Performance:
Past performance will be evaluated in accordance with FAR 15.305, however a comparative assessment will not be determined in accordance with FAR 15.305(a)(2)(i). The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements based on recency, relevancy and satisfactory performance. The acceptability of the offeror’s past performance shall be evaluated. This is done through the establishment of criteria to be evaluated on an “acceptable” or “unacceptable” basis as follows:
In order to facilitate the Government's evaluation of this factor, the Vendor shall provide information on no more than three (3) previous contracts whose effort was relevant to the effort required by this solicitation;
the contracts provided should have been performed within the last five (5) years. Evaluation will focus only on work experience already performed. Yet-to be performed work and experience prior to the last five (5) years will not be considered. Vendors may submit performance data regarding current contract performance as long as a minimum of one year of performance has been completed as of the award date of this solicitation. The Government may verify past performance information.
d. Price:
The Government will not evaluate price adjectivally. The Government will analyze the proposed price provided using analysis techniques to determine fair and reasonable pricing. The Government may use one or a combination of price analysis techniques and procedures in FAR 15.404 to ensure a fair and reasonable price is received. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the base requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
2. Award will be made on the basis of the lowest priced proposal that meets the acceptability standards for all non-price factors. The offeror’s total proposed price shall be the total of the base CLIN 0001-0004 and all option CLINs (1001-1006) in the solicitation.
If the Government determines an offeror’s estimates to be inexplicably low or otherwise not fair and reasonable, that offeror may be eliminated from the competition without further discussion.
The price proposals shall be in accordance with the solicitation, and will be evaluated on the basis of price reasonableness. Vendors to complete Attachment 3 Pricing Schedule and shall include pricing for all line items listed. Failure to do this shall be cause for rejection of the proposal for all line items. Prices shall be held firm for thirty (30) days.
Vendors responding to this solicitation are advised that, prior to award, the government may request vendors to submit additional information/data to support price reasonableness such as copies of paid invoices for the same or similar items, or price list with effective date and/or copies of catalog pages along with any applicable discounts.
Failure to submit the requested information may result in disqualification of the submitted proposal.
The Government shall select the Vendor whose proposal is most advantageous to the Government, considering price and other factors when compared to other proposals. The Government reserves the right to issue a contract to other than the lowest priced Vendor. Past Performance will have a higher importance in the evaluation than the Price. The Government also reserves the right to not issue an award if it is not in the best interest of the Government.
