1 67 RFP Section L.1.2.a LHD-2 Shipcheck #1 (11 May 2020 – 29 May 2020) Would the Navy consider making the September 2020 ship check the first ship check required under the solicitation?

The May ship check is still scheduled. Update 4/24/2020 - The May ship check has been removed from the solicitation.

14 RFP Section C.7 AutoCAD go-by drawings source files, for repeat alterations, will be made available upon request.

Will AutoCAD source files be provided for repeat alterations as stated in 7.17 and is the contractor permitted to roll over source files from previously developed SIDs?

Paragraph 7.17 also states that AutoCad go-by drawings source files, for repeat alterations, will be made available upon request.

Paragraph 7 states that all SID development (excluding revisions) shall assume use of zero rollover of source files from previously developed SIDs.

3 3, 10, 12 RFP Section B, Item 3000;

RFP

Sections C.7.3 and C.7.22

LHD 7 requirements What LHD 7 efforts will be included in this contract? There may be Technical Instructions issued under this contract for SID development to support

LHD-7 SID efforts. This contract does not include LHD-7 ship check efforts.

66 RFP Section L.4.1 Offerors shall propose the labor hours required to perform the requirements of the PWS for the period of performance specified in

Section F.

Government Furnished Information was not identified in the draft

RFP. What information is the Navy going to provide to develop the basis of estimate for the labor hours? Or, is it the Navy's intent to provide the LOE hours to propose on each CLIN?

LOE man-hours were added to Section B.

5 7, 22, 61 RFP Section C.6.1, Section

F, Section L 1.2

Period of Performance for the first pre-ship check is 27 April 2020.

Period of Performance to begin 24 April 2020.

What is the Navy's anticipated timeline for submittal of the proposal in order to meet the start of the PoPs identified in the Draft RFP?

Proposal submittals are required by 1000 on April 15, 2020. Update 4/24/2020 - Proposals are required by 1000 on May 11, 2020.

6 17 C-215-H002

Contract Proposal

(NAVSEA)(OCT 2018)

Paragraphs (a) and (b) What is the Navy's intent for incorporating this clause into the contract?

The technical volume(s) of the awarded Contractor's proposal will be incorporated by reference as stated in this clause.

81 L-215-H004

INSTRUCTIONS FOR

PRICING OF CONTRACT

DATA REQUIREMENTS

LIST (NAVSEA)

Provision This clause is rarely used anymore because it does not result in CDRL pricing that is meaningful and CDRL costs are not separately evaluated. This pricing would usually only include the cost to deliver the data item to the Government. The costs to develop the data item are included elsewhere in the labor portion of the proposal. For the same reason, Data CLINs are Not Separately Priced (NSP). Will the

Government delete this requirement from the RFP?

Provision is required and included in the RFP.

8 7 RFP Section B N/A

Will the final solicitation contain a "Payment of Fees" Clause? Added B-232-H004 PAYMENTS OF FEE(S) (LEVEL OF EFFORT)-- BASIC (NAVSEA)

(OCT 2018).

9 41 RFP Section H N/A

Will the final solicitation contain a "Level of Effort" Clause? Added H-216-H001 LEVEL OF EFFORT--BASIC (NAVSEA) (OCT 2018).

91 Section M 3.2.2 Large business offerors will not be eligible for award if they fail to submit an acceptable Small Business Subcontracting Plan where small business subcontracting possibilities exist.

With the SOW that is provided within the draft RFP, there are not specific engineering/design discipline level requirements (i.e. Ship Alt identification with supporting GFI). As such, the ability to identify and thoroughly evaluate small businesses that are qualified to perform the intended work scope is limited.

Furthermore, a less specific SOW does not support the selection or competitive pricing of small business subcontractors. With the near-term ship check schedule of 11 May 2020, it is anticipated that the proposal submittal response will be short and not fully support a detailed, analyzed small business selection. It is recommended that the small business plan/requirement

Specific verbiage was removed from Section M. Provision L-219- H001 SUBMISSION OF

SMALL BUSINESS SUBCONTRACTING PLAN

(NAVSEA) (JAN 2019) is still invoked in the RFP.

N/A N/A N/A

While our expertise does extend to creating technical drawings, we do not usually provide Engineering solutions. Do you believe this would be an issue for us if we were to try to become the prime on this contract?

Offerors may submit a proposal if they can meet the requirements specified in the solicitation.

N/A N/A N/A

Because of what I may perceive as shortcomings when it comes to the

Engineering solution side of this RFP, I believe we may be a better match as a subcontractor to the eventual prime contractor awardee.

Have you had any applicants mention a desire to partner with a subcontractor that I might be able to reach out?

Information regarding other bidders may not be disclosed.

13 81 Clauses Incorporated by

Reference

52.222-46 Evaluation of Compensation for Professional Employees

(Feb 1993)

In FAR 22.1103 the requirement is to include this provision in negotiated contracts. The solicitation is identified as full and open.

Can this provision be removed from the RFP?

FAR 22.1103 states that the Contracting Officer shall insert the provision at 52.222-46, Evaluation of Compensation for Professional Employees, in solicitations for negotiated contracts when the contract amount is expected to exceed $700,000 and services are to be provided which will require meaningful numbers of professional employees. FAR 15.002 defines 2 types of negotiated acquisition: sole source acquisitions and competitive acquisitions. This solicitation is for a competitive acquisition. Based on the above rationale, the clause will not be removed.

PRICING OF CONTRACT

DATA REQUIREMENTS

LIST (NAVSEA)

(a) The Offeror shall complete the "Price Group" (Block

17) and "Estimated Total Price" (Block 18) of each data item on the

Contract Data Requirements List (CDRL) of this solicitation using the following instructions.

Exhibit A, released with the Final RFP, on the CDRL 1423, there is not a Block 17 (Price Group) or Block 18 (Estimated Total Price) to fill in as per the instructions. Can the requirement for pricing the

CDRLs in accordance with L-215-H004 be removed from the RFP?

Exhibit A has been updated to include Block 17 and Block 18.

51, 15 Section J, Contract Data

Requirement Lists

(CDRLs)- Exhibit A, CDRL A021 - Section C, paragraph 7.7.1.1

Title of A021 is Priced Bill of Material (BOM). Subtitle Extracted Bill of Materials - Extracted Bill of Material (BOM) (CDRL A021)

Is it the Navy's intent to receive Priced Bills of Material with CDRL

A021 or only extract the BOM in accordance with 7.7.1.1?

It is the Navy's intent to receive extracted BOM only.

Capability ( Volume II)

DOD Statutory Small Business Goals shall be enforced and are as follows: Small Business 22%; Small Disadvantaged Business 5%;

Women Owned Business 5%: HUBZone 3%.

Can the Government elaborate on the mechanism of enforcement that will be used to enforce the statutory small business goals?

Section M has been updated to state: "For informational purposes, DOD Statutory Small

Business Goals are as follows: Small Business 22%; Small Disadvantaged Business 5%; Women

Owned Business 5%; HUBZone 3%."

Specification, DD 254

Form 254-

Attachment 1

Contractor would require access to NNPI and UNNPI information on site at the performing facility, thereby requiring the necessary protections for that level of data. All of the scope of work contemplated under this RFP are centered on LHA 2 and LHA 7

SIDs, to which these requirements do not apply.

Current requirements for the type of work contemplated under this

RFP require authority for NISP information and its associated regulations.

Can the Government re-evaluate the listing of NNPI and UNNPI information and its associated requirements found on the DD 254?

Yes. DD 254 will be updated to remove NNPI/UNNPI and only require access to

CONFIDENTIAL.

18 67 RFP Section L.1.2.a LHD-2 Shipcheck #1 (11 May 2020 – 29 May 2020) Does the Navy still require the performance of the May ship-check, given that the proposals are not due until 11 May?

The May ship check has been removed from the solicitation.

20 73; 2 4.3.1. Staffing Plan without

Cost; Section B; Att. 3 and

The Offeror is cautioned that staffing plans for individuals and all proposed tasks must propose the same mix and amount of hours as that of the Cost/Price Proposal, which shall be in accordance with the

Government estimated Level of Effort (LOE); CLINs 1000, 2000;

Attachments 3 and 4 of the RFP (Staffing Plan without Cost and

Staffing Plan with cost) provide three columns for proposed labor hours: “SHIPCHECK 1 PLUS COMPLETED DRAWINGS”, “SHIPCHECK

2 PLUS COMPLETED DRAWINGS”, “SHIPCHECK

Will the Government please consider updating Attachments 3 and 4 to include a fourth Labor Hours column for the 31,200 hours included in CLIN 3000 LHD 7 SIDs to enable Offerors to provide staffing plans that correlate with the proposed cost volume proposal?

Attachments 3 and 4 have been updated to reflect two ship checks for LHD 2 and completed drawings for LHD 7. Attachments have been uploaded to beta.sam.gov along with these Bidder's

Questions under the headings, "Attachment_3_StaffingPlanWithoutCost-REV1 28APR2020" and "Attachment_4_StaffingPlanWithCost-REV1 28APR2020". UPDATE (04MAY2020):

Manning Capability

(Volume II)

The RFP states the “DOD Statutory Small Business Goals shall be enforced and are as follows: Small Business 22%; Small

Disadvantaged Business 5%;

Women Owned Business 5%; HUBZone 3%.”

Would the Government confirm this goal is a percentage of subcontracted dollars in accordance with FAR 52.219-9?

Yes, Small business goals are to be expressed in terms of total dollars subcontracted, and as a percentage of total planned subcontracting dollars. The Government has changed the sentence, "DOD Statutory Small Business Goals shall be enforced and are as follows..." to "For informational purposes, DOD Statutory Small Business Goals are as follows..."

Page 71; 70 Section L.4.2.1 Small

Business Participation;

Section L.3.2

The Government states “The extent participation of small business concerns in terms of the value of the total acquisition. Within this section the SBCs (prime offerors and small business subcontractors) proposed quantitative participation, which should be expressed in terms of whole dollars and percentages based on the total acquisition

(total contract value).” This statement directly contradicts instructions in Section L.3.2 where the Government states that

“Offerors are to ensure that all Technical Capabilities and Experience are contained within VOLUME I and that no cost/price information is included in this volume.”

Will the Government remove this requirement since a Small Business

Subcontracting Plan is being provided in Volume V?

No. Section L.3.2 of the solicitation has been updated to include the extent of participation of small business concerns in terms of the value of the total acquisition covered in Section L.4.2.1.

Due to the modifications made to the scope of work on 04/24/2020, associated with the Ship checks and SID development on the subject

LHD-2 scope of work, does the Government plan to issue a modification to the RFP that would adjust the man-hours for the remaining scope of work associated with LHD-2? If so, the

GOVERNMENT RESPONSES TO LHD PLATFORM SID SOLICITATION #N42158-20-R-N001

- In the event of a conflict between the RFP and the Government responses to the RFP questions, the RFP will govern.

66; 75 Section L.2.1; L.4.5 Ref. 2.1. Major Subcontractor is defined as a subcontractor performing 50%, or more, of total proposed labor hour costs. Ref. 4.5.

THE REQUIREMENTS OF THIS SECTION APPLY EQUALLY TO

THE OFFEROR AND ANY PROPOSED SUBCONTRACTOR(S)

REGARDLESS OF SUBCONTRACT TYPE. It is the Prime Offeror’s responsibility to ensure that ALL PROPOSED SUBCONTRACTORS provide information at this same level of detail regardless of the subcontract pricing arrangement.

The RFP identifies that Major Subcontractor is defined as a subcontractor performing 50%, or more, of total proposed labor hour costs. Question: Will the Government please clarify that the Prime is only required to provide data on the major subcontractor(s) and not on all subcontractors?

It is the Prime Offeror’s responsibility to ensure that ALL PROPOSED SUBCONTRACTORS provide information at this same level of detail regardless of the subcontract pricing arrangement. In this procurement, the Government will perform a cost realism analysis of each

Offeror’s (and subcontractor’s) proposed costs.

69 Section L.2.3.8 Section L and Proposal Volume Cross-Reference Table. Staffing Plan w/o Cost (excel file w/o rates), included in page limit, ‘Y’.

Question: Will the Government please remove Staffing Plan Without

Cost - Attachment 3 from the page limit for Volume II?

Yes. Attachment 3 has been removed from the page limitation listed in the cross reference Table in Section L.2.3.8

2 Section B

N/A

CLIN 1000 still indicates that three (3) ship checks are required. The remainder of the solicitation indicates that only two are required.

Could you please amend the solicitation to correct this disparity?

CLIN 1000 has been updated to reflect two (2) ship checks.

2 Section B

N/A

Section B requires the same number of hours be delivered for the two ship checks as was required when there were three ship checks. Is this intentional?

The Level of Effort (LOE) hours stated in Section B of the solicitation remain unchanged.

15 Section C.11.1 Section C, Performance Work Specification, paragraph 11.1 indicates that “Overtime may be authorized when specifically authorized by the

TI.”

Will all work under this solicitation be covered by TIs? Yes, all work executed under this contract will be authorized via Technical Instructions.

7 Section C.3 Section C Paragraph 3, states “Contractor employees assigned to performance under this contract shall be U.S. Citizens and hold a

DoD Clearance of at least Confidential.”

Are all employees assigned to the LHD effort under the pending contract required to have a confidential clearance, or is it only those employees who have access to secured spaces for ship check purposes who are required to have a confidential clearance?

Yes. During drawing development there may be a need for access to confidential information or generation of confidential information in order to complete drawing development.

66 Section L.2.1(b) Section L, paragraph 2.1(b) states in part “Offerors shall acknowledge receipt of any amendment to this solicitation…”

The requirements of the solicitation have been changed a few times since the solicitation’s release, but no amendments have been issued.

How would the Navy like the offeror to acknowledge the changes that have been made?

Since no amendment has been issued, there is no requirement to acknowledge changes that have been made.

69 Section L.3.1(d) Section L, paragraph 3.1(d) states “A statement that the proposal is valid through 180 days from the date specified for receipt of proposals;”

If the contract resulting from this solicitation is not awarded for 180 days, the September ship check will be completely missed, and the

December ship check will be at risk. Will the Navy please consider changing this proposal validity requirement to 60 days.

Proposal validity will remain at 180 days.

88 Section L, provision L-215-

H007

Section L, provision L-215-H007 Submission of Questions by

Offerors, paragraph (b) states “The deadline for receipt of questions is

72 hours prior to the solicitation close date and time. Although every effort will be made, the Government makes no guarantee that questions received after the date above will be answered.”

Based upon this language, may the offerors assume that all questions submitted prior to the 72 hour cut-off will be answered prior to the closing date and time for receipt of offers?

Yes, provided they contain the solicitation number, document, page number, paragraph number or other identifier relating to the question, as called for in provision L-215-H007.

78 Section L.4.5.5 Proposed cost reimbursement and T&M major subcontractors are required to submit Cost/Price Proposals (showing direct labor rates, indirect rates, and fee rate) through the , using the Subcontractor Cost

Summary, provided as Attachment in Section J.

Will the Navy please complete the first sentence of this paragraph by filling in the blank? “Proposed cost reimbursement and T&M major subcontractors are required to submit Cost/Price Proposals (showing direct labor rates, indirect rates, and fee rate) through the________, using the Subcontractor Cost Summary, provided as Attachment in

Section J.”

Sentence has been corrected.

76 Section L.4.5.3(a) Current Named Individual Direct Rate Supporting Documentation Will the Navy remove the requirement to name all individuals who may perform work on the contract? The offeror considers several factors when assigning adaptable personnel to projects, including other scheduled work and personal preference, if allowed by contract.

The offeror can clearly demonstrate the realism of its proposed costs through comparisons to other projects and its FPRA, and can demonstrate staffing capability through the other requirements of

Factor II.

Paragraph labeled, "Current Named Individual Direct Rate Supporting Documentation" has been removed.

75 Section L.4.5 FACTOR IV – COST/PRICE PROPOSAL (VOLUME IV) Will the Government remove the requirement for subcontractors to provide the same data required of the Offeror if that subcontractor does not meet the definition of a major subcontractor?

No. It is the Prime Offeror’s responsibility to ensure that ALL PROPOSED

SUBCONTRACTORS provide information at this same level of detail regardless of the subcontract pricing arrangement. In this procurement, the Government will perform a cost realism analysis of each Offeror’s (and subcontractor’s) proposed costs.

49 N/A N/A

Attachment 4, Staffing Plan With Cost The header of Attachment 4 is identical to the header of Attachment

3. Will the Navy provide a revised Attachment 4 spreadsheet, or should the Offeror correct the spreadsheet?

The header of Attachment 4 has been corrected and has been uploaded to beta.sam.gov under label, "Attachment_4_StaffingPlanWithCost-REV1 28APR2020". UPDATE (04MAY2020):

Attachment 4 has been uploaded to beta.sam.gov under heading, "Attachment_4_StaffingPlanWithCost-04MAY2020"

50 N/A N/A

Attachment 4, Staffing Plan with Cost Will the Government confirm that Attachment 4 will not be included in the contract? If the Government intends to include Attachment 4 in the contract, will the Government redact names, hourly rate, and other sensitive information?

In accordance with “C-215-H002 CONTRACTOR PROPOSAL (NAVSEA) (OCT 2018),” the technical volume(s) of the Contractor's proposal is(are) hereby incorporated by reference and made subject to the "Order of Precedence" (FAR 52.215-8) clause of this contract. Under the

"Order of Precedence" clause, the technical volume(s) of the Contractor's proposal referenced herein is (are) hereby designated as item (f) of the clause, following "the specifications" in the order of precedence.

2 Section B

N/A

Amendment 01 removed the May (first) Ship Check and related SID requirements in Section C, however the hours identified in Section B for Items 1000 and 2000 have not been adjusted to suit.

The Level of Effort (LOE) hours stated in Section B of the solicitation remain unchanged.

81 Section L Contract requires production of Ship Installation Drawings.

Applicability of FAR Part 22, Subpart 11 and 52.222-46, Evaluation of Compensation for Professional Employees.

Response to Bidder's Question in relation to 52.222-46.

The requirements of FAR Part 22, Subpart 11 apply to service contracts. Does the government agree that this is a supply contract and FAR Part 22, Subpart 11 and 52.222-46 should not apply?

This is a service contract.

45 Section I Contract requires production of Ship Installation Drawings. 52.222-

41, Service Contract Labor Standard, is applicable to the Service

Contract Act and 52.222-62, Paid Sick Leave Under Executive Order

13716, applies to covered contracts.

Does the government agree that this is a supply contract covered by the Walsh-Healy Public Contracts Act and therefore 52.222-62 and

52.222-41 can be removed from the solicitation?

This is a service contract.

68 and 69 Section L , paragraph 2.3.8 Cross Reference Table, 4.3.1 Staffing Plan w/o Cost (excel file w/o rates), Included in Page Limitation, Y

Per section 4.3.1, the Staffing Plan shall be provided as a separate file. Does the Government concur that the Staffing Plan should not be included in the Page Limitation and should be identified as an N on page 69?

Yes. Attachment 3 has been removed from the page limitation listed in the cross reference Table in Section L.2.3.8

68 and 69 Section L, paragraph 2.3.8 Cross Reference Table, 4.4.2 Past Performance Questionnaire, Included in Page Limitation, Y
