MILITARY SEALIFT COMMAND NORFOLK

JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC).
2. Description of the Action Being Approved: This is a justification for work to be provided under Work Items (WIs) 0211, 0307, 0505, 0510, 0651, and 0653 of the Statement of Work (SOW) for the Mid Term Availability (MTA) of the USNS HUMPHREYS (T-AO 188) under RFP N3220521R4013. This Justification is covering only the portion of the acquisition which an Original Equipment Manufacturer (OEM) Authorized Facility/Manufacturer/Representative is required and the approval level requirements will then only apply to that portion.
3. Description of Supplies/Services: MSC requires OEM authorized technical field service representatives and OEM parts to accomplish the requirements of WI 0211, 0307, 0505, 0510, 0651, and 0653 for the 50-day MTA Availability. These WIs require the provision of highly skilled, specialized, and unique services and associated OEM replacement parts. The estimated dollar value of the six (6) WIs is which will be funded utilizing FY 21 Navy Working Capital Funds (NWCF).
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).
5. Rationale Justifying Use of Cited Authority: The use of required OEM authorized field technical service representatives and OEM parts is necessary for mission essential purposes. The required OEM authorized field technical service representatives and OEM parts maintain mission critical ship equipment and systems, the failure of which could have serious consequences for deployed military forces and the crew on the vessel during deployments. Further, the required OEM authorized field technical service representatives and OEM parts are necessary to achieve the highest possible reliability, readiness and effectiveness required by MSC for the T-AO class of vessels. Use of required OEM authorized field technical service representatives and OEM parts also maintains all OEM warranties and ensures equipment reliability, crew safety and applicable American Bureau of Shipping (ABS) and United States Coast Guard (USCG) certifications.
a. WI 0211, Main Reduction Gear Inspection
The OEM for the Main Reduction Gear is Cincinnati Gear. Cincinnati Gear provides OEM repair parts and service for their equipment. Proper refurbishment and maintenance of the Main Reduction Gears is critical to the safe operation of the Main Propulsion Engines and Shaft Line Components onboard USNS HUMPHREYS (T-AO 188). Cincinnati Gear factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-01-AO lists the Main Reduction Gears as critical equipment. Failure of the Main Reduction Gears will severely impede the ships ability to get underway and complete mission requirements. Proper refurbishment and maintenance of this system is critical to the safe operations of the USNS HUMPHREYS (T-AO 188).
b. WI 0307, CARGO Console Repair and Groom
The Original Equipment Manufacturer (OEM) for the vessel’s Cargo Console is EMS Marcon.
EMS Marcon, as the OEM, is the only authorized vendor to provide parts to their equipment.
Factory parts and proprietary technical data/drawings are only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Failure of the Cargo Console System will severely impact the safe operation of the ship by controlling the stability of the vessel. Proper refurbishment and maintenance of the Cargo Console is critical to the safe operations of the USNS HUMPHREYS (T-AO 188).
c. WI 0505, NO.3 SSDG Flexible Coupling Elements
Fair Banks Morse Engine is the provider for the Ship Service Diesel Generator (SSDG). The MFR:
ALCO Power INC./ Fairbanks Morse Engine Owns all rights and documentation for the Model 251 F V-18 Cylinder 4 Cycle Diesel Engine.
SMS number 10.4-001-ALL Revision 2.2 ensures that the vessel equipment is maintained in accordance with original equipment manufacturer (OEM) recommendations, MSC policy and regulatory body requirements. SMS number 10.6-002-ALL lists the SSDGs as critical equipment. Failure of the SSDGs would restrict the ship to port and prevent it from performing its required mission. Proper refurbishment and maintenance of the SSDGs is critical to the safe operations of the USNS HUMPHREYS (T-AO 188).
d. WI 0510, CT Winch Test and Calibrate
Eaton corporation is the Original Equipment Manufacturer (OEM) for the vessel’s CT Winch.
Eaton corporation is the sole source to provide repair parts and service to their equipment, for the CT Winch’s controllers at Station 1,2,3,4,5, and 6. Factory authorized parts and proprietary technical data/drawings only available from the authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Without the CT Winches, the ship capability to safely moor and take on Cargo fuel is reduced. Proper refurbishment and maintenance of the auxiliary boilers is critical to the safe operations of the
USNS HUMPHREYS (T- AO 188).
e. WI 0651, Annual Lifeboat Davits and Winches Inspection
The OEM for the vessel’s Lifeboat Winches is Fassmer Inc. and the OEM for the Davits is Lakeshore. They are the OEM authorized vendor and supplier of approved repair parts and service for their equipment. Proper refurbishment and maintenance of Lifeboats and Davits is critical to the safe operation of the USNS HUMPHREYS (T-AO 188) as required by USCG and ABS regulations. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-ALL lists the Lifeboat Davits and Winches as critical equipment. Proper operation of the Lifeboat Winches and Davits is a safety requirement for the vessel to get underway for vessel operations. The inability to use major safety and lifesaving equipment poses a hazard to the crew. Proper refurbishment and maintenance of the Lifeboat Winches and Davits is critical to the safe operations of the USNS HUMPHREYS (T-AO 188).
f. WI 0653, Annual Rescue Boat & Davit Inspection
The United States Coast Guard (USCG) and the American Bureau of Shipping (ABS) requires the annual inspection of the Rescue Boats and all safety equipment to satisfy Regulatory Requirements. The OEM for the vessel’s Rescue Boats is Willard Marine and the OEM for the Davits are Schat Marine Safety. Proper refurbishment and maintenance of Rescue Boats is critical to the safe operation of the USNS HUMPHREYS (T-AO 188) and essential to crew safety in the event of an emergency. Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured or services provided by another company.
SMS number 10.6-002-ALL lists the Rescue Boat and Davit Assemblies as critical equipment.
Failure of RHIB and Davit Assemblies is a major loss in safety and lifesaving equipment required for the vessel to get underway for vessel operations. The loss of major safety and lifesaving equipment poses a hazard to the crew. Proper refurbishment and maintenance of the RHIB and Davit Assemblies is critical to the safe operations of the USNS HUMPHREYS (T-AO 188).
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The Government intends to post a synopsis and a Request for Proposal (RFP) at the Government Point of Entry, beta.sam.gov website, with the intent of awarding a firm-fixed-price contract. Any prospective contractor will be required to use the OEM, OEM authorized vendor(s), or an MSC-designated OEM-equivalent as a subcontractor to perform the work in the aforementioned WIs.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR Part 15.
8. Market Research: The USNS HUMPHREYS (T-AO 188) is home ported on the East Coast and therefore considered an East Coast asset. All non-emergent vessel repairs are required to be conducted on the East Coast. The purpose of market research was to collect historical information from the ship’s last three (3) CONUS availabilities. Purchase Orders N3220518C401, N3220517C4011, and N3220516C1000 were the contract numbers identified. In researching this information, it was discovered that the aforementioned acquisitions were solicited and awarded as 100% total small business set-asides under NAICS code 336611 with a standard business size of 1,250 employees.
9. A Listing of the Sources, if any that expressed, in writing, an interest in the Acquisition: No sources to date, have expressed an interest in any of the aforementioned WIs.
10. Actions to Remove Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
