JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) - Norfolk.
2. Description of the Action Being Approved: This is a brand name justification for work to be provided under Work Items (WI) 0201, 0202, 0301, 0302, 0304, 0503, 0504, 0508 and 0511 of the Statement of
Work (SOW) for the Mid-Term Availability (MTA) of the USNS GRASP (T-ARS 51) under RFP
N32205- 17-R-4402. This Justification is covering only the portion of the acquisition which is brand-name and the approval level requirements will then only apply to that portion.
3. Description of Supplies/Services: MSC Norfolk requires Original Equipment Manufacturer (OEM) authorized technical field service representatives and OEM parts to accomplish the requirements of
WIs listed below. The estimated combined dollar value which will be funded utilizing FY 17 Operation & Maintenance funds.
Work Items and Required Service Representative(s):

0504: High Pressure Air Compressor Maintenance (Sauer OEM Rep)
0508: Bowthruster Repair (Brunvoll OEM Rep)
0511: Annual Allied Crane Inspection (Allied System Company)
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).
5. Rationale Justifying Use of Cited Authority:
a. WI 0201: Clutch and Brake Overhaul
This work requires the supply of Eaton OEM parts and representatives for the repairs of USNS GRASP’s Main
Propulsion Diesel Engine (MPDE) clutches. Eaton is the OEM for this equipment. The MPDE Clutches are listed as critical equipment per Safety Management System (SMS) Form T-ARS Critical Equipment List 10.6-
002-01-ARS. Per COMSC INTRUCTION 4490.1, an OEM Representative is required to perform or supervise maintenance and repairs of equipment classified as “Critical.” Only Eaton OEM service and parts providers have access to proprietary drawings and have the expertise, and knowledge to identify and provide OEM parts, components, and qualified services. If the clutches become inoperable, a loss of propulsion while at sea can occur. Additionally, incorrectly installed or deficient parts could cause excess friction leading to smoke and fire in the engine room. Authorized Eaton Representatives will only install genuine OEM parts supplied from within the authorized Eaton Distributor Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.
Notwithstanding the rationale above, MSC further does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
b. WI 0202: Steering Gear Repairs and Alignment
This work requires the supply of Paul-Munroe (currently known as “Curtiss-Wright”) OEM parts and representatives for the repairs and alignment of USNS GRASP’s Steering Gear Systems. Curtiss-Wright is the
OEM for this equipment and Paul-Munroe is its legal successor in interest. The Steering Gear Systems are listed as critical equipment per SMS Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC
INTRUCTION 4490.1, OEM Representative is required to perform or supervise maintenance and repairs of equipment classified as Critical. Only Curtiss-Wright OEM service and parts providers have access to proprietary drawings and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Because this work item requires removal of a temporary repair and possible refabrication of some critical components, access to proprietary drawings is of particular importance. A loss of steering gear would severely inhibit the ship’s ability to maintain a heading, and would be cause for a “no sail”. An improperly tuned or adjusted system would prevent safe and reliable navigation of the vessel, possibly leading to collisions, groundings, and a loss of mission readiness. Authorized Curtiss-Wright
Representatives will know how to properly affect repairs and tuning procedures. They will only install genuine
OEM parts supplied from within the authorized Curtiss-Wright Distributor Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
c. WI 0301: Generator and Engine
This work requires the supply of Caterpillar OEM parts and representatives for the repairs USNS GRASP’s 1A, 1B, 2A & 2B main diesel engines and 1SG, 2SGA & 2SGB diesel engine. Caterpillar is the OEM of the vessel’s main diesel engines and generator engines. The vessel’s engines are Critical Equipment, listed under
SMS Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC INTRUCTION 4490.1, OEM
Representative is required to perform maintenance and repairs of equipment classified as Critical. Only
Caterpillar OEM and Authorized Caterpillar service/parts providers have the expertise and knowledge, including access to proprietary drawings and technical manuals, to identify and provide OEM parts and components. Material must be procured and installed, to prevent the engines from having a mechanical failure.
The main engines are critical element in the propulsion system. If the main engines fail to operate, then the vessel will lose its propulsion system and will not be able to move/navigate through water: resulting in a “No
Sail”, stopping all mission operations. Ship Service Generators, must be serviced, tested and documented IAW
ABS strict maintenance guidance. Authorized Caterpillar repair representatives will only install genuine OEM parts supplied from within the authorized Caterpillar distributor Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
d. WI 0302: Generator Cleaning
This work requires the supply of General Electric OEM parts and representatives for the cleaning and repairs of
USNS GRASP’s Ship’s Service Generators. General Electric is the OEM for this equipment. The Ship’s
Service Generators are listed as critical equipment per SMS Form T-ARS Critical Equipment List 10.6-002-01-
ARS. Per COMSC INTRUCTION 4490.1, OEM Representative is required to perform or supervise maintenance and repairs of equipment classified as Critical. Only General Electric OEM service and parts providers have access to proprietary drawings and have the expertise and knowledge to identify and provide
OEM parts, components, and qualified services. Cleaning and repairs to the Ship’s Service Generators must be completed with strict adherence to OEM procedures. Errors in workmanship could cause a loss of ship’s power while underway, a threat to the safety of life at sea. Premature equipment failure could also lead to damage of other systems or an electrical fire in the engine room. Authorized General Electric Representatives will only install genuine OEM parts supplied from within the authorized General Electric Distributor Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
e. WI 0304: CAPAC Upgrade
This work requires the supply of Wilson Walton OEM parts and representatives for the upgrade USNS
GRASP’s Cathodic Protection Impressed Current (CAPAC) System. The CAPAC System is an integral system as applied to the protection of the ship’s hull steel and coating system. Historic data from USNS Grasp’s ROH demonstrated the importance of the system due to the severe deterioration of the hull coating system which is contributed to the over current operation of the existing outdated system. OEM (Wilson Walton) equipment was utilized in the development of the Alteration Equivalent to Repair (AER) approved by MSC Engineering. The use of the OEM equipment and representatives maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. MSC does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and parts are equivalent to the OEM service and parts.
f. WI 0503: LP Air Compressor Overhaul
This work requires the supply of Quincy OEM parts and representatives for the repairs on USNS GRASP’s
Low Pressure (LP) Air Compressors. LP Air Compressors supply air to many critical components throughout the ship. The loss of LP Air could cause failures on components such as the emergency stern tube seal, fuel/lube oil purifier operating air and engine E-stop control air. If LP Air could not be supplied when the emergency stern tube seal is required to be inflated, there is a potential of flooding the shaft alleys and damaging main propulsion equipment. A loss of LP Air would also prevent the engine emergency shutdown system from operating correctly, and it would also prevent the fuel or lube oil purifiers from running. Authorized Quincy repair representatives will only install genuine OEM parts supplied from within the authorized Quincy distributor Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. MSC does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
g. WI 0504: High Pressure Air Compressor Maintenance
This work requires the supply of Sauer OEM parts and representatives for the repairs USNS GRASP’s High
Pressure (HP) Air Compressors. The HP Air Compressors are listed as critical equipment per SMS Form T-
ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC INTRUCTION 4490.1, OEM Representative is required to perform or supervise maintenance and repairs of equipment classified as Critical. HP Air
Compressors supply air to many critical components such as the Main Propulsion Diesel Engines (MPDE), MPDE Clutches and Brakes, and Ship Service Diesel Generators (SSDG). The loss of HP Air could cause a loss of starting air for the MPDEs and SSDGs, rendering them inoperable, causing total loss of propulsion and/or power throughout the ship. Insufficient HP air to the clutches and brakes would also cause a loss of propulsion. Authorized Sauer repair representatives will only install genuine OEM parts supplied from within the authorized Sauer distributor Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. MSC does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
h. WI 0508: Bowthruster Repair (Brunvoll OEM Rep)
This work requires the supply of Brunvoll OEM parts and representatives for the repairs to USNS GRASP’s
Bowthruster. The Bowthruster is a critical component for ship operation and maneuvering. The loss of the bowthruster could affect the ship’s ability to perform operations for mission requirements and cause limited maneuvering during critical times. Authorized Brunvoll repair representatives will only install genuine OEM parts supplied from within the authorized Brunvoll distributor Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. MSC does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
i. WI 0511: Annual Allied Crane Inspection
The work item requires an OEM, Allied Service Representative to perform the services and repair of Model
D6000FCTS davits onboard USNS Grasp. RHIB and davit assembly are listed as critical equipment per SMS
Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC INTRUCTION 4490.1, OEM
Representative is required to perform or supervise maintenance and repairs of equipment classified as Critical.
The davit is used to deploy and retrieve the ship’s SOLAS Rescue Boat. The Davit is critical to personnel safety and in maintaining the requirements of regulatory body for SOLAS. Employment of an Allied Service
Representative trained and certified to inspect, maintain, and service the davit greatly mitigates risk associated with crane/davit failure. Such a failure could result in ship/equipment damage and/or grave personnel injury or death. Parts and services provided by the OEM maintains all OEM warranties, ensures equipment reliability, and ensures crew safety, therefore precluding consideration of non-OEM parts and non-OEM authorized technical representative services. The engineering, construction drawings, and technical characteristics for the manufactured parts for these engines are proprietary to the OEM and the Government did not acquire rights in this data.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The requirement has been synopsized at the Government Point of Entry (GPE), FedBizOpps website, and
The Government intends to post a Request for Proposals (RFP) along with this justification at the GPE with the intent of awarding a firm-fixed-price contract to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM authorized vendor as a subcontractor to perform the work in the related WIs.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
