JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC).
2. Description of the Action Being Approved: This is a justification for work to be provided under Work Items (WI) 201, 202, 203, 204, 205, 302, 305, 401, 403, 404, 405, 501, 502, 503, 505, 507, 511, 604, 607, 608, 610 and 611 of the Statement of Work (SOW) for the Mid-Term Availability of the USNS Laramie (T-AO 203) under RFP N32205-17-R-4013. This Justification is covering only the portion of the acquisition which an Original Equipment Manufacturer (OEM) Authorized Facility/Manufacturer/Representative is required and the approval level requirements will then only apply to that portion.
3. Description of Supplies/Services: MSC requires OEM authorized technical field service representatives and OEM parts to accomplish the requirements of WI 201, 202, 203, 204, 205, 302, 305, 401, 403, 404, 405, 501, 502, 503, 505, 507, 511, 604, 607, 608, 610 and 611 for the 42 day Mid-Term Availability.
These Work Items require the provision of highly skilled, specialized, and unique services and associated OEM replacement parts. The estimated dollar value of the twenty-two (22) WIs is will be funded utilizing FY 18 Navy Working Capital Funds (NWCF).
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).
5. Rationale Justifying Use of Cited Authority: The use of required OEM authorized field technical service representatives and OEM parts is necessary for mission essential purposes. The required OEM authorized field technical service representatives and OEM parts maintain mission critical ship equipment and systems, the failure of which could have serious consequences for deployed military forces and the crew on the vessel during deployments. Further, the required OEM authorized field technical service representatives and OEM parts are necessary to achieve the highest possible reliability, readiness and effectiveness required by MSC for the T-AO class of vessels. Use of required OEM authorized field technical service representatives and OEM parts also maintains all OEM warranties and ensures equipment reliability, crew safety and applicable American Bureau of Shipping (ABS) and United States Coast Guard (USCG) certifications.
a. WI 201, Main Engine Turbo Charger Overhaul
The OEM for the main engine Turbo Chargers is Asea Brown-Boveri (ABB). ABB is the OEM and the only supplier of repair parts and service for their equipment. Proper refurbishment and maintenance of the Main Engine Turbo Chargers is critical to the safe operation of the USNS LARAMIE (T-AO 203). This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Main Propulsion Engines as critical equipment. Failure of the Turbo Chargers would impact the operation of the Main Propulsion Engines, which will severely impede the ships ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Main Engine Turbo Chargers is critical to the safe operations of the USNS LARAMIE (T-AO 203).
b. WI 202, Fuel Injector Overhaul
The OEM for the main engine fuel injectors is Colt-Pielstick. Colt-Pielstick has two (2) OEM authorized suppliers of approved repair parts and service for their equipment. Proper refurbishment and maintenance of the Fuel Injectors is critical to the safe operation of the Main Engines onboard USNS
LARAMIE (T-AO 203). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Main Propulsion Engines as critical equipment. Failure of the Main Propulsion Engines will severely impede the ships ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Fuel Injectors and Main Propulsion Engines are critical to the safe operations of the USNS LARAMIE (T-

c. WI 203, Oil Mist Detector Calibration and Service
The OEM for the Main Propulsion Oil Mist Detection System is QMI Multiplexer. QMI Multiplexer has one (1) OEM authorized supplier of approved repair parts and service for their equipment, ICI Instruments. Proper service and maintenance of the Oil Mist Detection System is critical to the safe operation of the Main Engines onboard USNS LARAMIE (T-AO 203). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Main Propulsion Engines as critical equipment. Failure of the Oil Mist Detection System on the Main Propulsion Engines could result in a catastrophic failure of the engines (Crankcase Explosion) and will severely impact the ships ability to get underway and complete mission requirements. Proper service and maintenance of the Main Propulsion Oil Mist Detection System is critical to the safe operations of the USNS LARAMIE (T-AO 203).
d. WI 204, Main Engine Clutch/Coupling Overhaul
The OEM for the Main Engine Clutch/Coupling Assembly is Eaton Corporation, Airflex Division.
Eaton Corporation, Airflex Division provides OEM repair parts and service for their equipment.
Proper refurbishment and maintenance of the Main Engine Clutch/Coupling Assembly is critical to the safe operation of the Main Engines onboard USNS LARAMIE (T-AO 203). Eaton Corporation, Airflex Division Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Main Propulsion Engines as critical equipment. The Main Engine Clutch/Coupling Assembly is in integral part of the Main Propulsion Engines Shafting arrangement and failure of this system will severely impede the ships ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Main Engine Clutch/Coupling Assembly is critical to the safe operations of the USNS LARAMIE
(T-AO 203).
e. WI 205, Power Take Off (PTO) Clutch/Coupling Overhaul WI 305, PTO Clutch Air Control Panel Replacement
The OEM for the Power Take Off (PTO) Clutch/Coupling Assembly and the PTO Clutch Air Control Panel are American Vulkan Corporation. American Vulkan Corporation provides OEM repair parts and service for their equipment. Proper refurbishment and maintenance of the PTO Clutch/Coupling Assembly and the PTO Clutch Air Control Panel are critical to the safe operation of the electrical power generation system onboard USNS LARAMIE (T-AO 203). American Vulkan Corporation Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Electrical Generating System as critical equipment. The PTO Clutch/Coupling Assembly and the PTO Clutch Air Control Panel are an integral part of the Electrical Generating System arrangement and failure of this system will severely impede the ships ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Electrical Generating System is critical to the safe operations of the USNS
LARAMIE (T-AO 203).
f. WI 302, PTO Generator Groom
The OEM for the vessel’s Power Take Off (PTO ) Generator and Synchronous Compensators is Siemens. Proper refurbishment and maintenance of the PTO and Sync Compensator are critical to the safe operation of the Electrical Generation equipment onboard USNS LARAMIE (T-AO 203).

Failure of the PTO’s will severely impede the ships ability to generate electrical power and degrade mission capabilities. Proper refurbishment and maintenance of the PTO’s are critical to the safe operations of the USNS LARAMIE (T-AO 203).
g. WI 401, GMDSS Recertification
The OEM for the vessel’s Global Marine Distress and Safety System (GMDSS) is FURUNO.
FURUNO has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a Certificate of Approved training for the FURUNO FS-5000 GMDSS Console unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as critical equipment, and the Global Marine Distress and Safety System (GMDSS) is required by ABS and USCG. Service of the GMDSS must be accomplished by USCG/ABS Approved and OEM Trained vendors. Proper refurbishment and maintenance of the GMDSS is critical to the safe navigation and operations of the USNS LARAMIE (T-AO 203).
h. WI 403, NAVIGAT X Gyro System Preventive Maintenance
The OEM for the vessel’s new NAVIGAT Gyro Compass repeater system is Northrop Grumman Systems Corp - Sperry Marine Division (NGSC-SMD). NGSC-SMD has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a Certificate of Approved training for the FURUNO FS-5000 GMDSS Console unit that is installed.
Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Gyro Compass as critical equipment. Failure of the Gyro Compass or Steering Stand will severely impede the ships ability to navigate and maneuver the vessel. The reduction of the ability to navigate and maneuver the vessel will also pose a hazard to the crew and the vessel. Proper replacement and maintenance of the Gyro Compass and Steering Stand are critical to the safe operations of the USNS LARAMIE (T-AO 203).
i. WI 404, Radar and ECDIS PM
The OEM for the vessel’s Radar and ECDIS are FURUNO and TRANSAS, respectively.
FURUNO and TRANSAS have numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a Certificate of Approved training for the FURUNO Radars and TRANSAS units that are installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as critical equipment. The Radar and ECDIS are intricate components within the Bridge Navigation equipment. Failure of the Radar and ECDIS will severely impede the ships ability to safely navigate and identify other vessel operating in/around the vessel. Proper refurbishment and maintenance of the Radar and ECDIS are critical to the safe navigation and operations of the USNS LARAMIE (T-AO 203).
j. WI 405, SVDR Annual Recertification
The OEM for the vessel’s Simplified Voice Data Recorded (SVDR) is Japan Radio Company, Ltd (JRC). JRC has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a Certificate of Approved training for the JRC-JCY- 1700S unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as critical equipment, and the SVDR is part of the vessel’s Safety Radio Certificate, as required by ABS.
The SVDR is a USCG and ABS required system that is integrated into the Radar and ECDIS systems to records ship movements. Service of the SVDR must be accomplished by USCG/ABS Approved and OEM Trained vendors. Proper refurbishment and maintenance of the SVDR is critical to the safe navigation and operations of the USNS LARAMIE (T-AO 203).
k. WI 501, SCBA Compressor/Refill Station Annual Service
The OEM for the vessel’s Self Contained Breathing Apparatus (SCBA) Compressor and Refill Station is MAKO. MAKO has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a Certificate of Approved training for the MAKO Model No. 9400E3 Compressor and Model No. M3100 Refill Station unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the Damage Control Equipment as critical equipment. The vessel’s SCBA Compressor and Refill Station is required to refill expended SCBA bottles used when fighting a shipboard fire or addressing a HAZMAT situation. Failure of the SCBA Compressor and Refill Station will severely reduce the Ship’s Force capability control/extinguish a fire and save the vessel from further damage.
l. WI 502, Auxiliary Boiler Maintenance
The OEM for the vessel’s Auxiliary Boilers is VAPOR Power International. VAPOR has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a Certificate of Approved training for the VAPOR Model FNC7-4748-VHK- NCI Boiler units that are installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
m. WI 503, Atlas Incinerator Troubleshoot and Repair
The OEM for the vessel’s Incinerator is ATLAS Incinerators A/S. ATLAS Incinerators A/S has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a Certificate of Approved training for the ATLAS ASWI-402-AS unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
n. WI 505, Overhaul No. 4 Ship Service Diesel Generator (SSDG)
Stand-alone port and starboard Ship Service Diesel Generator (SSDG) sets provide ship service power and/or provide electrical power to motorize the PTO for emergency propulsion. The OEM for this equipment is Rolls-Royce Commercial Marine. OEM parts are required for all critical equipment onboard T AO class ships. Proper refurbishment and maintenance of the SSDG is critical to the safe operation of the USNS LARAMIE (T-AO 203). Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-ALL lists the Diesel generators as critical equipment. Failure of the SSDGs would restrict the ship to port and preclude the ship from performing its required mission. Proper refurbishment and maintenance of the SSDGs are critical to the safe operations of the USNS LARAMIE (T-AO 203).
o. WI 507, Cargo Oil Content Monitor
The OEM for the vessel’s Cargo Oil Content Monitor is VAF Instruments B-V. VAF Instruments has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a Certificate of Approved training for the MK6, OILCON Ballast Monitor that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002—01-AO lists the Oil Content Monitor as critical equipment. Failure of the Oil Content Monitor will severely impede the ships ability to comply with current environmental regulations. Reduction of the ship’s ability to comply with current environmental regulations, as required by USCG and ABS, will expose the crew to the possibility of an oil discharge. Proper refurbishment and maintenance of the Oil Content Monitor is critical to the safe operations of the
USNS LARAMIE (T-AO 203).
p. WI 511, Westfalia OWS Service and Calibration
The OEM for the Oily Water Separator onboard the USNS LARAMIE (T-AO 203) is GEA Westfalia, Inc. Westfalia the only known OEM authorized supplier of approved repair parts and service for their equipment. Proper refurbishment and maintenance of the Oily Water Separator is critical to the safe operation of the USNS LARAMIE (T-AO 203) as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002—01-AO lists the Oily Water Separator as critical equipment. Failure of the Oily Water Separator will severely impede the ships ability to comply with current environmental regulations. Reduction of the ship’s ability to comply with current environmental regulations will expose the crew to the possibility of an oil spill. Proper refurbishment and maintenance of the Oily Water Separator is critical to the safe operations of the USNS LARAMIE (T-AO 203).
q. WI 604, Self Contained Breathing Apparatus (SCBA) Equipment Annual Service
The OEM for the vessel’s SCBA’s is Interspiro. Interspiro factory authorized suppliers provide parts and proprietary technical data only available from the original manufacturer to Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-01-AO lists Damage Control Equipment as critical equipment. Failure of the SCBA equipment will severely impact the ship’s ability to properly respond to fires, confined space entry and crew rescue. Proper maintenance of the SCBA Equipment is critical to the safe operations of the USNS LARAMIE (T-AO 203)
r. WI 607, Lifeboat Recertification
The OEM for the vessel’s Lifeboats is Survival Systems International. PALFINGER is the OEM authorized vendor and supplier of approved repair parts and service for their equipment. Proper refurbishment and maintenance of Lifeboats is critical to the safe operation of the USNS LARAMIE (T-AO 203) as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-ALL lists the Lifeboats as critical equipment. Failure of Lifeboats is a major loss in safety and lifesaving equipment required for the vessel to get underway for vessel operations.
The loss of major safety and lifesaving equipment poses a hazard to the crew. Proper refurbishment and maintenance of the Lifeboats is critical to the safe operations of the USNS LARAMIE (T-AO 203).
s. WI 608, Recertify Lifeboat Winches and Davits
The OEM for the vessel’s Lifeboat Winches is PALFINGER. PALFINGER is the OEM authorized vendor and supplier of approved repair parts and service for their equipment. Proper refurbishment and maintenance of Lifeboat Winches is critical to the safe operation of the USNS LARAMIE (T-AO
203) as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-ALL lists the Lifeboats as critical equipment. Proper operation of the Lifeboat Winches is a safety requirement for the vessel to get underway for vessel operations. The inability to use major safety and lifesaving equipment poses a hazard to the crew. Proper refurbishment and maintenance of the Lifeboat Winches is critical to the safe operations of the USNS LARAMIE (T-AO 203).
t. WI 610, Recertify Rescue Boat Winch and Davit
The OEM for the vessel’s Starboard Rescue Boat Davit is PALFINGER. PALFINGER is the OEM authorized vendor and supplier of approved repair parts and service for their equipment.
Proper refurbishment and maintenance of Rescue Boat Davit is critical to the safe operation of the USNS LARAMIE (T-AO 203). Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-ALL lists the RHIB and Davit Assemblies as critical equipment. Proper operation of safety and lifesaving equipment is required for the vessel to get underway for vessel operations. The inability to use major safety and lifesaving equipment poses a hazard to the crew.
Proper refurbishment and maintenance of the Winch Davit Assembly is critical to the safe operations of the USNS LARAMIE (T-A0 203).
u. WI 0611, Annual Port RHIB Davit and Winch Inspection
The OEM for the vessel’s Port Rescue Boat Davit is Allied Technical Services. Allied Technologies is the OEM authorized vendor and supplier of approved repair parts and service for their equipment. Proper refurbishment and maintenance of Port Boat Davit is critical to the safe operation of the USNS LARAMIE (T-AO 203). Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-ALL lists the RHIB and Davit Assemblies as critical equipment. Proper operation of safety and lifesaving equipment is required for the vessel to get underway for vessel operations. The inability to use major safety and lifesaving equipment poses a hazard to the crew.
Proper refurbishment and maintenance of the Port Boat Davit Assembly is critical to the safe operations of the USNS LARAMIE (T-A0 203).
MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. The work items listed in this section require special tools, specialized repair parts, and technical expertise unique to this equipment; only approved OEM parts are authorized to be installed on this highly sophisticated equipment. The OEM Representative has access to provide parts and technical data / drawings from the original manufacturer, as required to properly repair and maintain the equipment.
All OEM repair parts are in compliance with USCG and ABS IMO regulatory requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The Government intends to post a synopsis and a Request for Proposal (RFP) at the Government Point of Entry, FedBizOpps website, with the intent of awarding a firm-fixed-price contract to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work in the related WIs.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR Part 15.
8. Actions to Remove Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
