Industry Question: Could you please provide a clarification to the below questions regarding the ATMO Key West solicitation?
3.4.2 Labor Hours states "A work-year is defined as 1920 hours for hourly rate labor categories".
However FAR 52.222-62, Paid Sick Leave Under Executive Order 13706 (Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors, applies to all contracts subject to the Service Contract Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.) is included in the solicitation which requires contractors to provide 56 hours of sick leave. Should the hours proposed reflect this requirement? 2080 minus 80 hours of vacation, minus 80 hours of holiday, minus 56 hours of sick leave = 1864 productive hours.
Government Response: For purposes of preparing the cost proposal, offerors shall use the hours specified in Section L , Part B, paragraph 3.4.2 (labor Hours) of the solicitation.
Industry Question: .3 Price/Cost Information states "As required by the Wage Determination, the contractor shall include that cost associated with those rates on their Attachment P3 (e.g. Health and Welfare - $4.41 per hour)". The wage determinations provided by the government require contractors to provide HEALTH & WELFARE EO 13706: $4.13 per hour. Should the solicitation list $4.13 as the Health and Welfare rate?
Government Response: The reference to the Health and Welfare rate in the Price/Cost section of Section L was meant to be an example only. Offerors shall use the Health and Welfare rate specified in the applicable Wage Determination in preparation of their proposal.
