About this file
This is an amendment to a solicitation for the design and construction of one Auxiliary Floating Dry Dock Medium (AFDM). The Navy seeks to award a fixed-price contract for detail design, construction, testing, delivery, and certification of one AFDM. The amendment responds to questions from potential offerors, revising delivery and certification requirements for cranes to be installed. It also updates the list of attachments to include additional submissions required from offerors. Proposals are due as previously indicated, with no extension resulting from this amendment. The Navy intends to award to the responsible offeror whose compliant proposal results in the best value to the government, considering technical approach, past performance, and total evaluated price including delivery and certification costs.

REVISED SUMMARY OF CHANGES
The purpose of this amendment to solicitation N00024-22-R-2243 is to:
a) Respond to question submitted by potential Offerors; and
b) Revise Section J, LIST OF DOCUMENTS, EXHIBITS AND OTHER ATTACHMENTS.
1. The following questions were submitted by potential Offerors. The Government’s response follows each question. Question and Answer 002 through 004 are provided in this Amendment 0002.
Question 002: CLIN 0005 Packaging and Delivery to San Diego, CA is a Firm Fixed Price (FFP) option CLIN which is an element of the price contained in Addendum L-8 Pricing Summary. CLIN 0005 is included as part of the Total Evaluated Price (TEP). Delivery to San Diego, CA will not occur for over three years after contract award. The actual cost to package and deliver to San Diego, CA will be influenced by the future uncertain costs of fuel and chartering a heavy lift vessel. Use of FFP terms for CLIN 0005 necessitates contractors to price additional cost risk into their bid, increasing the cost to the Government. Will the Government consider:
1) Changing CLIN 0005 from FFP to cost plus fixed fee (CPFF) recognizing the potential cost risk associated with delivery to San Diego over three years after contract award?
2) Excluding CLIN 0005 from the Total Evaluated Price (TEP) (or alternatively include only the fixed fee from the revised CPFF type CLIN 0005)?
Answer 002: No, due to the manner in which funds are appropriated for the AFDM, the Government must have fixed pricing on the AFDM contract. An Offeror should consider market fluctuations when pricing fuel and chartering. The Navy will not exclude CLIN 0005 from the Total Evaluate Price.
Question 003: J-1, Section 3.589a CRANES states,
• “Each crane shall be in accordance the ABS Guide for Certification of Lifting Appliances.”
• “If CLIN 1010 is exercised, cranes shall be installed, tested, and certified at the delivery destination by the Contractor.”
Will the Navy confirm that the cranes shall be designed and manufactured in accordance the ABS Guide for Certification of Lifting Appliances, but that crane certification and/or related notation by ABS is not required?
Answer 003: Yes, The Navy confirms cranes shall be designed and manufactured in accordance with the ABS Guide for Certification of Lifting Appliances. The Navy also confirms the crane shall be certified by ABS at the delivery destination. Specification Section 3.589a has been updated to clarify the requirement as follows: “If CLIN 1010 is exercised, cranes shall be installed, and tested and certified at the delivery destination by the Contractor. The Contractor shall obtain ABS certification of the cranes at the delivery destination.”
Question 004: Per DFARS Tracking Number 2021-O0009, solicitations issued on or after October 15, 2021 are to include clause 252.223-7999, Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors (Deviation 2021-O0009). Clause 252.223-7999 was not included in this solicitation or any subsequent amendments.
Answer 0004: No, The Navy does not intend to include 252.223-7999 at this time.
2. As a result of the above, Section J, LIST OF DOCUMENTS, EXHIBITS AND OTHER ATTACHMENTS, is hereby revised as follows:
