About this file

This is an RFP template document prepared by the Virginia Office of the Attorney General (OAG) for the Medical Fraud Control Unit (MFCU) to solicit qualified suppliers for the replacement of its current eDiscovery platform. The RFP seeks proposals through competitive negotiations to establish a contract for infrastructure replacement of the existing eDiscovery system. The document provides a standardized template framework for the procurement process, outlining the structure and format that will be used to evaluate supplier proposals. The template establishes the foundation for soliciting sealed proposals from qualified vendors capable of delivering a comprehensive eDiscovery platform solution to replace the MFCU's current system.

The template document does not specify detailed pricing terms, contract duration, renewal options, or other specific procurement parameters in this particular file, as it serves as a procedural template rather than a finalized RFP with complete specifications. The actual procurement details, including response due dates, site visits, bidders' conferences, technical specifications, pricing structures, contract term length, and award timeline, would be populated in the final RFP document that incorporates this template. Additional information regarding funding sources, budget allocation, incumbent contractor status, and current system environment details would be contained in supplementary procurement documents accompanying the formal RFP release.

I. PURPOSE:

The purpose of this Request for Proposal (“RFP”) is to solicit sealed proposals from qualified Suppliers to establish a contract through competitive negotiations for infrastructure replacement of current eDiscovery platform for our Medical Fraud Control Unit (“MFCU”) at the Virginia Office of the Attorney General (“OAG” or “Purchasing Agency” or “Agency”).

For the purposes of this RFP, “Contractor,” “Supplier” (or “Bidder” or “Offeror”) means any entity that submits a proposal in response to this RFP.

II. BACKGROUND:

The OAG currently operates Relativity Server 2024 on an on‑premises hardware environment supporting 25–50 concurrent users and maintaining approximately 100 TB of scalable storage. The existing infrastructure requires replacement to ensure continued operational reliability, improved performance, enhanced data protection, and alignment with modern eDiscovery best practices.

The current contract for these products and services is set to expire September/October of 2026 with an estimated cost total of $500k. OAG is seeking to procure a new contract for product and services through this RFP prior to expiration.

III. STATEMENT OF NEEDS:

OAG desires a solution that will provide a turnkey replacement solution, including all hardware, software, professional services, and support necessary to deploy a fully functional environment.

The solution must include:

1. Core Infrastructure Replacement

· Full replacement of the existing Relativity Server hardware environment.

· Minimum capacity to support 25–50 simultaneous users.

· Minimum 100 TB of scalable storage, with architecture designed for high‑performance eDiscovery workloads.

· All required networking components, including redundant firewalls and network switches, to maximize uptime and reliability.

· A virtualization layer (e.g., VMware or equivalent) enabling future repurposing of compute and storage resources for other eDiscovery or SQL‑based applications.

2. Backup and Disaster Recovery

· Hardware and software to support onsite backup of all Relativity data.

· Hardware and software to support offsite backup at the existing OAG disaster recovery site located in Northern Virginia.

· Configuration of backup workflows, retention policies, and validation processes.

3. Software and Licensing

· All required software licenses to operate the solution for a minimum of three (3) years, excluding Relativity user licenses (provided by OAG). If VMware is identified as the proposed virtualization and hypervisor solution, and the vendor is not an authorized reseller, OAG may be able to provide those licenses.

4. Professional Services

· Full installation and configuration of all hardware and software.

· Complete data migration from the existing Relativity Server environment, including:

· MD5/SHA hash validation

· Reconciliation and integrity confirmation

· Post‑migration smoke testing

· Onsite deployment at a forthcoming office location in the Richmond, Virginia metropolitan statistical area.

· Preferred Delivery of all hardware no later than October 2026, with installation completed within two weeks of delivery.

5. Warranty and Support

· Minimum three‑year hardware warranties and software licenses for all components.

· Bidder must be capable of providing an optional comprehensive managed services agreement, including:

· 24x7x365 remote monitoring

· Proactive maintenance, patching, and updates

· Troubleshooting and system upgrades

· Access to eDiscovery industry experts

· Ongoing optimization and reporting

· Full lifecycle support for the deployed environment

IV. PROPOSAL PREPARATION AND SUBMISSION INSTRUCTIONS:

A. General Instructions:

1. RFP Response: In order to be considered for selection, Offerors must submit to the issuing agency a complete response to this RFP electronically via eVA as follows:

a. One (1) full original copy marked “ORIGINAL” in the file name and noticeable marked “ORIGINAL” at the beginning of the document.

b. One (1) full redacted copy marked “REDACTED” in the file name and noticeable marked “REDACTED” at the beginning of the document. The redacted version of the proposal shall have all proprietary information deleted and listed on Attachment B, in order, and by the corresponding section and subsections. Offerors must edit, alter, or refine redacted versions of the proposal to protect and maintain complete confidentiality of protected information. In the event no information requires redaction, a complete copy of the proposal marked as “REDACTED” must still be submitted. NOTE: The issuing agency will not accept responsibility for any public disclosure of proprietary information that has occurred as a result of improper redaction by the Offeror.

c. Both versions of the proposal may be submitted via eVA has a single file for each or as multiple files. All files submitted shall be clearly marked “ORIGINAL” or “REDACTED” in the file name and noticeable marked “ORIGINAL” or “REDACTED” at the beginning of the document. Please be aware that there is a 60 MB size limit for each file submitted.

2. Proposal Preparation:

a. Proposals shall be signed by an authorized representative of the Offeror. All information requested should be submitted. Failure to submit all information requested may result in the issuing agency requiring prompt submission of missing information and/or giving a lowered evaluation of the proposal. Proposals which are substantially incomplete or lack key information may be rejected by the issuing agency. Mandatory requirements are those required by law or regulation or are such that they cannot be waived and are not subject to negotiation.

b. Proposals should be prepared simply and economically, providing a straightforward, concise description of capabilities to satisfy the requirements of the RFP. Emphasis should be placed on completeness and clarity of content.

c. Proposals should be organized in the order in which the requirements are presented in the RFP. All pages of the proposal should be numbered. Each paragraph in the proposal should reference the paragraph number of the corresponding section of the RFP. It is also helpful to cite the paragraph number, subletter, and repeat the text of the requirement as it appears in the RFP. If a response covers more than one page, the paragraph number and subletter should be repeated at the top of the next page. The proposal should contain a table of contents, which cross-references the RFP requirements. Information, which the Offeror desires to present, that does not fall within any of the requirements of the RFP, should be inserted at an appropriate place or be attached at the end of the proposal and designated as additional material. Proposals that are not organized in this manner risk elimination from consideration if the evaluators are unable to find where the RFP requirements are specifically addressed.

d. As used in this RFP, the terms “must”, “shall”, “should” and “may” identify the criticality of requirements. “Must” and “shall” identify requirements whose absence will have a major negative impact on the suitability of the proposed solution. Items labeled as “should” or “may” are highly desirable, although their absence will not have a large impact and would be useful, but are not necessary. Depending on the overall response to the RFP, some individual “must” and “shall” items may not be fully satisfied, but it is the intent to satisfy most, if not all, “must” and “shall” requirements. The inability of an Offeror to satisfy a “must or “shall” requirement does not automatically remove that Offeror from consideration; however, it may seriously affect the overall rating of the Offeror’s proposal.

e. Ownership of all data, materials, and documentation originated and prepared for the State pursuant to the RFP shall belong exclusively to the State and be subject to public inspection in accordance with the Virginia Freedom of Information Act. Trade secrets or proprietary information submitted by an Offeror shall not be subject to public disclosure under the Virginia Freedom of Information Act; however, the Offeror must invoke the protections of 2.2-4342F of the Code of Virginia, in writing, either before or at the time the data or other material is submitted. The written notice must specifically identify the data or materials to be protected and state the reasons why protection is necessary. The proprietary or trade secret material submitted must be identified by some distinct method such as highlighting or underlining and must indicate only the specific words, figures, or paragraphs that constitute trade secret or proprietary information. The classification of an entire proposal document or prequalification application, line item prices, and/or total proposal prices as proprietary or trade secrets is not acceptable and will result in rejection of the proposal. If, after being given reasonable time the Offeror refuses to withdraw an entire classification designation, the proposal will be rejected.

3. Offeror Submission Requirements:

a. RFP #141-123975 is an invitation for an electronic sealed response; therefore, proposals submitted outside of the eVA system, such as via e-mail, mail, or fax WILL NOT be accepted. Sealed proposals will be received until the closing date and time provided in the solicitation. Any proposal received after the closing date and time specified in the solicitation will not be considered and will be date and time stamped, marked “late” and retained unopened in the procurement file.

Prior to the due date, Offerors should:

· Check the status of the solicitation on eVA at www.eva.virginia.gov by clicking on Business Opportunities and then click on Virginia Business Opportunities (VBO) for any updates, changes, amendments, cancellations, etc.;

· Check the Solicitation in VBO for all attachments and documents to be completed and submitted; and

· Complete all attachments, amendments, exhibits, product information, etc. and attach electronically to the Offeror’s electronic submission.

Offerors are solely responsible for reviewing, complying, and returning a complete proposal. Changes to the solicitation’s forms or formats are prohibited except where clearly instructed and permitted.

b. Electronic proposal submission with required documents attached is required. Offeror must be registered in eVA in order to submit an electronic proposal.

The following are instructions for submitting an electronic proposal:

4. Oral Presentation: Offeror who submit proposals in response to this RFP may be required to give an oral presentation of their proposal to the issuing agency. This provides an opportunity for the Offeror to clarify or elaborate on their proposal. This is a fact finding and explanation session only and does not include negotiation. The issuing agency will schedule the time and location of these presentations. Oral presentations are an option of the issuing agency and may or may not be conducted.

B. Specific Proposal Submission Instructions:

All Suppliers must adhere to the specific format set forth in Table 1 below in order to aid the evaluation team in its efforts to evaluate all proposals fairly and equitably. Proposals that deviate from the requested format will require additional time for review and evaluation. OAG may reject any proposal that is not in the required format, or does not address all the requirements of this RFP.

Proposals should be written specifically to answer this RFP. General “sales” material should not be used within the body of the proposal and any additional terms or conditions on the “sales” material will be considered invalid. If desired, you may attach its “sales” material in a separate appendix to your response.

It is essential that your proposal be thorough and concise. You should avoid broad, unenforceable, or immeasurable responses and should include all requested information in each section as indicated below.

In order to facilitate OAG’s review of the submitted proposals, you must provide the requested information in the following format: YOU MUST PLACE YOUR NAME, not “OAG”, IN EACH FILE NAME (e.g., ABC Corp Background Checks, Verification Screening & Additional Services Transmittal.docx).

V. EVALUATION AND AWARD CRITERIA:

A. EVALUATION PROCESS:

OAG will review each proposal received by the due date and time to determine whether it meets the Must Have factors of this RFP. All Must Have factors are evaluated on a met or not met basis. Any proposal that does not meet all of the Must Have factors will be set aside and receive no further consideration.

The proposals that meet all the Must Have criteria will be distributed to the evaluation team who will assess and score each Supplier’s response to this RFP based on a review of the submitted materials.

OAG may elect to continue the evaluation of the most qualified proposal (s) and may request that Suppliers clarify or explain certain aspects of their proposals.

A numerical scoring system will be used in evaluation of proposals. The point values assigned to each of the evaluation criteria shall be posted in eVA prior to the due date and time for receiving proposals.

At any point in the evaluation process OAG may employ any or all of the following means of evaluation:

· Reviewing industry research

· Supplier presentations

· Site visits

· Supplier’s status as a small business or micro business, including small or micro businesses that are owned by minorities, women, or disabled veterans, and certified by the Department of Small Business and Supplier Diversity (“DSBSD”)

· Supplier’s planned amount of spend with certified SWaM or micro business (as defined in Attachment D) subcontractors, and Non-SWaM businesses.

· Supplier’s employment of persons with disabilities to perform the specifications of the contract.

· Contacting Supplier's references

· Review of Supplier’s ability and willingness to comply with the commonwealth’s security and data privacy policies, standards, guidelines and related contract terms as specified in the RFP

· Product demonstrations/pilot tests/detailed demonstrations

· Review of pricing

· Contacting Supplier’s customers

· Interviewing key personnel

OAG may limit all of the above to the most qualified proposals. No Supplier is guaranteed an opportunity to explain, supplement or amend its initial proposal. Each Supplier is encouraged to ensure that its initial proposal contains and represents its best offering. You should submit your best proposal and not assume there will be an opportunity to negotiate, amend or clarify any aspect of your initial submitted proposal.

Each Supplier should be prepared to conduct product demonstrations, pilot tests, presentations or site visits at the time, date and location of OAG’s choice, should OAG so request.

OAG will select for negotiation those proposals deemed to be fully qualified and best suited based on the factors as stated in the RFP. Negotiations will be conducted with these Suppliers. After negotiations, OAG may select the proposal(s) that, in its opinion, is the best proposal(s) representing best value and may award a contract to that Supplier(s). For purposes of this RFP, OAG will determine best value based on the value relative to the cost of the Service/Solution, giving consideration to the project's budget objectives.

If any Supplier fails to provide the necessary information for negotiations in a timely manner, or fails to negotiate in good faith, OAG may terminate negotiations with that Supplier at any time.

OAG reserves the right, at its sole discretion, to reject any proposal or cancel and re-issue the RFP. In addition, OAG reserves the right to accept or reject in whole or in part any proposal submitted, and to waive minor technicalities when in the best interest of the Commonwealth.

OAG SHALL NOT BE CONTRACTUALLY BOUND TO ANY SUPPLIER PRIOR TO THE EXECUTION OF A DEFINITIVE WRITTEN CONTRACT.

Such exceptions shall be considered during negotiation but shall not be used as a basis for scoring or evaluating which offerors are selected for negotiations. Price shall be considered, but need not be the sole determining factor. After negotiations have been conducted with each offeror so selected, the agency shall select the offeror which, in its opinion, has made the best proposal, and shall award the contract to that offeror.
