Question # RFP Section RFP Para RFP Page Reference Question Answer

10A (follow up)

C 3.13 25 Instructor & Key Personnel Training

The answer to Question 10 contradicts paragraph 3.9.3.2 ‐ First Article Refurbishment. Will the systems used for I&KPT be part of the Production quantity or is I&KPT considered part of FAT?

Please refer to FAR 52.209‐4, First Article Approval—Government Testing regarding the first 44 items delivered for FAT. All other items accepted by the Government become the Governments property, regarless of their use. If additional E‐MMPS are provided by the contractor to facilitate I&KPT, those units will be returned to the contractor at the conclusion of training.

C 3.13 25 Instructor & Key Personnel Training

If items from FAT are used for I&KPT will the government require them to be refurbished after I&KPT or will they accept delivery of the items before I&KPT.

No. After an item recieves FAT approval, the Government accepts the item. Except for latent defects undiscoverable during FAT and warranty matters, the Government is responsible to maintain the item.

C 3.6.5 (originally 3.7.5)

20 Notification of changes to commercial equipment (Follow‐ up to question 11)

The original question was missing language during submission making the answer unclear as to which paragraph applies. Paragraph 3.6.5 and paragraphs 3.6.4 impose significantly different requirements. How is it determined what equipment is governed by what paragraph? Specifically, how should the offeror assume what proposed equipment is considered "Commercial Equipment" and thus be governed by paragraph 3.6.5?

The E‐MMPS and associated components are Commercial Off the Shelf (COTS) items. Any variance in the product delivered to the Government would be subject to Statement of Work Paragraph

3.6.5 Notification of Changes to Commercial Equipment; whereas any variance in the functional baseline would be subject to the requirements contained in paragraph 3.6.4.3 Requests for Variance.

I 52.209‐4 44 (para (a) Initial Unit (First Article Test) delivery

Will First Article units be purchased through Delivery Orders for Item Numbers 0001 and 0002, at the contract prices established for those Line items, or, will the Contractor be required to provide First Article Test units free of charge?

Yes, the Government will initially purchase all items on CLIN 0001 and 0002 and subject the first 44 articles to FAT within than 120 days after contract award to determine acceptability. Please refer to FAR 52.209‐4, First Article Approval—Government Testing.

I 52.209‐6 46 (para (a) Initial Unit (First Article Test) delivery

Of the initial 44 FAT units, can the contractor inspect and reuse or refurbish parachutes used for the 20 mannequin drops?

Yes. The Government will not accept any articles failing FAT. Items failing FAT therefore remain contractor property. Please refer to FAR 52.209‐4, First Article Approval—Government Testing.

I 52.209‐8 48 (para (a) Initial Unit (First Article Test) delivery

If systems from the 44 FAT items are destroyed by the government during testing, is the contractor required to replace them at no cost?

If the basis for FAT failure causes the destruction, the government will not accept the item and therefore will not pay for the item. The parties will have to seek an appropriate remedy at that point. Please refer to FAR 52.209‐4, First Article Approval—Government Testing.

13F (follow up)

I 52.209‐9 49 (para (a) Initial Unit (First Article Test) delivery

Please confirm that the 44 FAT units are the total combined number of systems required, and will be composed of the various system sizes that may be offered.

The sizing for the first order will be determined at the time of award.

Before proposal submissions, the Government cannot predict what sizes offerors will propose. If the awardee propsosed two sizes, for example, the sizes for the 44 will be split 50/50.

C 3.9.1 (originally 3.10.1)

23 Contractor Support to Government Testing

The answer to question states that Government parachutists will be available for the 100 jumps from 19,500 outlined in paragraph 3.9.1. Reserves jumped as mains will result in the pilot chute, deployment bag, and bridle being considered as consumables ‐ as is currently written, but please indicate if the 64 free bags of each size are to be a reserve free bag (stuffed in the main compartment) or a main deployment bag that is not connected. If the quantity of 64 per size is mixed main and reserve bag types, please specify.

Which packing method will be used for the reserve parachutes when used as a main ‐ main or reserve?

The 64 free bags will be used as reserve free bags with hand‐deployed pilot chutes instead of spring‐loaded pilots chutes. The 64 free bags will be used with a reserve parachute in the main container. The free bags will likely be lost each time they are used since they are not connected to the reserve canopy. The reserve parachutes will be packed as closely to a normal reserve as possible.
