52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will make an award to only one offeror whose quotation, conforming to the requirements, will be most advantageous to the Government based upon Lowest Price Technically Acceptable (LPTA) on a Firm-Fixed Price basis.
The Government intends to award based on initial quotations but reserves the right to conduct discussions. Should the Government hold discussions and request revised quotations, the Government reserves the right to use relevant test data obtained from having evaluated the initial proposal in lieu of conducting a full testing protocol.
(b) Evaluation Process.
Evaluation of quotations and product samples will occur in two steps:
1. Product Sample Initial Evaluation. Offerors are required to submit ten product samples for each mount proposed (total of 20). The Government will first verify product sample compliance with the solicitation requirements per Table M-1 below prior to evaluation of written quotations:
Table M-1. SSDS IM Compliance Requirements
Attribute
Threshold
Weight
Weight is less than or equal to 9 ounces in accordance with PSPEC
Improved Mount Design
Improved Mount’s design consists of a single mount base with integrated dual scope rings
Improved Mount Attachment Method
Improved Mount’s design does not damage the M8541/M8541A SSDS or MIL-STD-1913 rail during installation or uninstallation
Scope Height Above Rail
The Improved Mount’s design keeps the SSDS’s optical centerline at no more than 1.5 (+/- 0.005) inches above the rail while still allowing the installation and removal of the Anti-Reflective Device and lens covers (M110 and M107 configurations).
Improved Mount Bias
The Improved Mount’s bias is zero Minutes of Angle (MOA) (M107 configuration).
The Improved Mount’s bias is 20 MOA (M110 configuration).
Quotations with product samples not complying one or more threshold requirement in Table M-1 will not receive further evaluation or consideration.
2. Evaluation of Full Quotation (to include Technical Capability, Price and Past Performance). The Government will evaluate full quotations that have product samples complying with all the threshold requirements in Table M-1.
(c) The following evaluation factors will be reviewed during the evaluation of the full quotation:
Factor 1 – Technical Capability. The Government will evaluate each quotation on an Acceptable/Unacceptable basis based on the offeror’s understanding of the SOW and PSPEC as well as it’s articulation of the offeror’s approach and capability (e.g., detailed procedures, plans, and methods) to meet the solicitation’s requirements. Evaluations will assess the quotation’s articulation of design, analysis, testing, its ability to meet or exceed delivery schedule timelines, safety measures in accordance with the Safety Assessment Report (SAR), and provisioning support such as the program’s warranty and maintenance assurances. This will include all product samples undergoing performance verification testing in accordance with the SSDS-IM PSPEC and Evaluation Factors. Test events include performance baseline testing, environmental testing, user evaluation testing, endurance testing, and a performance degradation assessment. It is the Government’s right to reduce the amount of rounds it expends during zero retention testing based upon the availability of personnel and funding to perform test events on offeror submissions.
i. It is the Government’s right to make changes to the test plan, test events, and test schedule based upon availability of personnel and funding to perform test events on submissions by offerors. Failure to meet one or more of the performance requirements will render the entire quotation Unacceptable.
ii. Factor 2 – Price. The Government will conduct a Price Evaluation to determine completeness of pricing and to determine the Total Evaluated Price by calculating the total price Contract Line Item Numbers (CLIN) 0001 through 0005, including all sub-CLINs. Any delivery fees or other charges will be included in the Total Evaluated Price. A quotation that fails to price all required items is incomplete. The Government will also determine whether prices are fair and reasonable using any of the proposal techniques at FAR 15.404-1, including comparison of quotes received, historical prices paid, or published price lists.. The price for CLINS 0004 and 0005 will be determined by taking a randomly selected quantity within the step ladder pricing and pricing out each of the recommended spares at that quantity. This will be added to the total evaluated price for CLINS 0001 and 0002 for the total quantity of those CLINS to determine the Total Evaluated Price. Incomplete pricing will render the entire quote Unacceptable and is ineligible for award. The Government will rank all quotations that have complete, fair and reasonable pricing by price from lowest Total Evaluated Priced to highest Total Evaluated Price.
iii. Factor 3 – Past Performance. The Government will conduct an evaluation to determine whether the offeror has an acceptable record of past performance using sources provided by the offeror and other sources available to the Government.
The offeror has acceptable past performance if it:
· Has a record of successfully fulfilling efforts of similar scope, magnitude, and complexities of this solicitation; or
· Demonstrates to the evaluators’ satisfaction that any adverse past performance issues have been resolved.
The offeror’s past performance is neutral if the vendor cannot demonstrate a record of past performance of similar orders. An offeror with neutral past performance is eligible for award.
The offeror’s past performance is unacceptable if adverse information in the offeror’s relevant past performance record gives the Government reason to doubt the vendor’s ability to successfully perform the required effort. A vendor with unacceptable past performance is ineligible for award.
The Government will rate past performance on an Acceptable/Neutral or Unacceptable basis.
Price and Technical Capability weigh equally and are more significant than Past Performance.
In order to be acceptable for award, the offeror’s evaluated quotation shall have an Acceptable in Technical Capability AND Acceptable/Neutral in Past Performance. Quotations that received an Unaccaptable in either non-price factor will be ineligible for award.
