3.0 REQUIREMENTS
The contractor’s technical proposal, as negotiated and accepted by the Government, may be incorporated by reference into the resultant contract. Any changes in these arrangements are to be submitted to the contracting officer in advance for approval. In the event of conflict or ambiguity between the contractor’s technical proposal and the Government SOW, the SOW shall take precedence.
The contractor shall accomplish delivery of the specified number of JMIC as set forth in the contract and each delivery order.
The contractor shall ensure that stated performance capabilities of the JMIC are certified and warranted. Limited government acceptance and/or user’s testing (e.g., operator/maintainer and safety/environmental) may also be accomplished upon commencement of production.
The contractor shall propose and deliver JMIC and support items which are compliant with the performance capabilities stated in the attached PD.
Technical compliance shall be based upon evidence of said items to meet the performance standards set forth in the Technical Data Package, as well as conformance to the delivery schedule.
The Government reserves the right to perform, at its own expense, Production Acceptance
Testing on production units to ensure conformance to the PD and TDP. Failure of any production unit to meet the requirements contained in the PD and TDP shall be cause for rejection of all units of the lot until corrections are made. In the event of a failure, and within 30 days, the Contracting Officer will notify the Contractor of the failure. The Contractor shall provide a Corrective Action Report to the Contracting Officer no later than 30 days after receipt of notice.

3.1.1 Program Management. The contractor shall establish a management structure that ensures overall quality of the JMIC Program, as well as compliance with delivery schedules. A designated Program Manager (PM) shall be identified to serve as the principal representative of the contractor throughout the warranty periods. This individual shall coordinate with the Government Program Management Office on all activities related to successful performance of the contract, including coordination of training schedules, interface with Marine Corps logistics activities, and conduct appropriate meetings and reviews with Government personnel. At all times, the PM shall have the responsibility for ensuring program integrity and overall contract performance. As appropriate, the contractor shall ensure that administration, logistics, financial and other task requirements pertinent to contract performance are adequately addressed (e.g., dedicated Service
Manager, etc.). Program documentation shall be readily available to Government representative(s) during planned visits.
3.1.2. Schedule Planning. The contractor shall include a schedule that addresses maximum production capability and maximum surge capability. Monthly production shall equal a minimum of 100 JMIC per month. The contractor shall commence delivery of the first system no later than 90 days after contract award. Subsequent deliveries shall be negotiated with each delivery order. The contractor shall immediately notify the
Government in writing of any anticipated or projected work stoppages or delays that will impact schedules.

The Contractor shall introduce and present management, key personnel, and program implementation processes.
System Verification Review. The System Verification Review (SVR) will be conducted in conjunction with the PCA. It shall be a presentation by the contractor of a summary of all studies, estimates, analyses, designs, audits, test results, and reports. These efforts shall be available for the Government to review at least 30 days prior to the SVR.
